<strong>Permit</strong> Requirements<strong>To</strong> <strong>Cross</strong> Or <strong>Parallel</strong> A <strong>County</strong> <strong>Drain</strong>In consideration of the granting of this permit, <strong>Permit</strong>tee does hereby agree to complywith all terms and conditions as set f<strong>or</strong>th in this permit, together with the rules andregulations as established by the <strong>Calhoun</strong> <strong>County</strong> Water Resources Commissioner, acopy of which rules and regulations are as follows:1. All utilities and/<strong>or</strong> facilities must be minimum of four (4) feet below theestablished drain bottom when crossing <strong>or</strong> paralleling a county drain <strong>or</strong> right-ofway.2. Any structures removed such as headwalls, wingwalls, concrete slabs, rip rap,erosion protection, tiling and culverts-metal <strong>or</strong> concrete, must be replaced withnew material and reconstructed to <strong>or</strong>iginal condition <strong>or</strong> better.3. All ditch banks, when disturbed, must be reshaped to <strong>or</strong>iginal slope,compacted, topsoiled and seeded, fertilized and mulched <strong>or</strong> hydroseeded.4. A minimum of seventy-two (72) hours notice is required to the inspectiondepartment pri<strong>or</strong> to any construction that will involve a county drain.5. Equipment and materials may not be st<strong>or</strong>ed in any way so as to causeblockage of a county drain.6. <strong>Permit</strong>tee is responsible f<strong>or</strong> maintaining all st<strong>or</strong>m drainage during the time ofconstruction, whether by use of pumping equipment <strong>or</strong> construction of abypass system.7. <strong>Permit</strong> fee will be Two-Hundred Fifty Dollars ($250.00) per occurrence, payableby check to the <strong>Calhoun</strong> <strong>County</strong> Water Resources Commissioner. Pri<strong>or</strong> toissuance of a permit proof of Contract<strong>or</strong>'s Liability Insurance must be filed withthe Office of Water Resources Commissioner, with the named insured, incompliance with the <strong>Calhoun</strong> <strong>County</strong> Water Resources Commissioner'sstandards. Also indemnity insurance in the amount of $1,000,000.00.8. This <strong>Permit</strong> does not relieve applicant from meeting any applicationrequirement of law <strong>or</strong> of other public bodies <strong>or</strong> agencies. Additionally, theissuance of this permit does not relive the utility of any future expense f<strong>or</strong>relocation of said utility to accommodate f<strong>or</strong> future drain improvements.


9. <strong>Permit</strong>tee shall be responsible f<strong>or</strong> and pay all costs f<strong>or</strong> the engineering andinspection services incurred by the <strong>Calhoun</strong> <strong>County</strong> Water ResourcesCommissioner in the review of the <strong>Permit</strong> <strong>App</strong>lication and inspection of thew<strong>or</strong>k perf<strong>or</strong>med hereunder. Payment to be made within thirty (30) days ofinvoice.10. Other: ___________________________________further agrees, either to payany increased cost to the <strong>Drain</strong>age District due to this utility occupying saiddrain, said cost to be determined as a separate bid item during construction <strong>or</strong>reconstruction, <strong>or</strong> if determined necessary by the <strong>Calhoun</strong> <strong>County</strong> WaterResources Commissioner, the utility company occupying said drain right-ofway,shall relocate <strong>or</strong> lower if the location of the utility shall increase the cost ofperf<strong>or</strong>ming drain improvements <strong>or</strong> drain maintenance.All expenses pertaining to said relocation shall be paid by the owner of the utilitycompany. Relocation shall be completed within 90 days from receipt of written requestby the Water Resources Commissioner.Additional time may be granted by the Water Resources Commissioner if determinednecessary.<strong>Permit</strong>tee does hereby acknowledge and agree, that in the event that the area of theright-of-way f<strong>or</strong> which this permit is granted is necessary f<strong>or</strong> the future maintenance andoperation of the _________________________<strong>Drain</strong>, the <strong>Permit</strong>tee, at its own expense, shall remove all conflicting facilities,structures, pipelines, cables and other appurtenances to said use in and during the timeof the maintenance of said <strong>Drain</strong>.
