Executive Officer Comments
Michigan Tax System Reform:
A Time For Bold Action
WRITTEN BY MICHAEL C. STOSKOPF, CGP, EXECUTIVE OFFICER
The tremendous, outbound migration of
Michigan residents over the past several
years is well-documented. In April 2009,
a Detroit News article reported that, since 2001,
outbound migration has cost Michigan 465,000
residents. The economic impact of this loss
equates to billions of dollars in paychecks and
hundreds of millions of dollars in payroll taxes,
sales and use taxes and property taxes.
Why are so many Michiganders – the majority
of whom are younger and college educated –
leaving our beautiful state? The answer is clear:
the current job market and the perception
of future job prospects is much brighter
elsewhere.
If you accept the premise that americans
are hard-working people who desire a good
job by which to earn the income needed to take
care of themselves and their families, then the
only solution to turning this migration trend
around is creating a business environment
that results in state-wide, year-over-year job
growth.
Without a doubt, economic conditions in
Michigan and elsewhere are affected by a
myriad of internal and external forces and
conditions. As time goes on, a deteriorating
economy will result in changes that extend well
4 Building Business & Apartment Management x September 2009
beyond what basic structural, legislative and
regulatory systems can control or influence.
Unquestionably, a significant factor in
creating job growth during any type of economic
condition is through tax policy. According
to Joshua Barro, Staff Economist for the
Tax Foundation “…companies will locate
where they have the greatest competitive
advantage. states with the best tax systems
will be the most competitive in attracting
new businesses and most effective at
generating economic and employment
growth…”
In his paper entitled “2009 State Business
Tax Climate Index” (http://taxfoundation.org/
files/bp58.pdf), Mr. Barro points out, “…while
we live in a global marketplace, the Department
of Labor reports that most mass job relocations
are from one US state to another rather than
overseas. This means that state lawmakers
must be aware of how their states’ business
climates stack up to others in their region and
nationwide…”
Mr. Barro goes on to say, “…state lawmakers
are typically tempted to lure business with
lucrative tax incentives and subsidies under
the banner of job creation and economic
development. however, the truth is that if
a state needs to offer such packages, it is
most likely covering for a woeful business
climate plagued by bad tax policy.” I
agree with Mr. Barro that a far more effective
approach is to systematically improve the
business tax climate for the long term.
The Tax Foundation’s State Business Tax
Climate Index (SBTCI) is comprised of the
following five weighted component indexes:
Corporate Tax Index, Individual Income Tax
Index, Sales Tax Index, Unemployment Tax Index
and Property Tax Index. So, according to the
2009 SBTCI rankings, how does Michigan stack
up?
As far as overall taxation, Michigan was
ranked 20th by the SBTCI in 2009. That’s
the good news. The bad news is Michigan’s
Corporate Tax Index – composed of the factors
by which businesses evaluate states when
deciding to relocate – was ranked a dismal 48th
out of 50.
These rankings inspired me to do a little
research. My findings were eye-opening to say
the least!
Using data collected by the US Bureau of
Economic Analysis (www.bea.gov), I compared
three relatively simple but telling economic
measures over the 2004-2008 timeframe:
BBAM_909_1-8.indd 4 8/20/2009 10:26:04 AM
- gross domestic Product (gdP) by State,
adjusted for inflation using the US Bureau of
Labor Statistics’ Consumer Price Index (CPI)
- Per Capita income, by State and adjusted
for inflation using the CPI
- Population, by State
Calculating the annual growth rate
percentage for each measure – and using
the Tax Foundation’s 2009 SBTCI overall tax
rankings – analysis quickly revealed that the
“Top 7 States” in Overall Rank performed
markedly better than the 42 other states.
Furthermore, as the graph shows, both the
“top 7 states” and the forty-two others both
significantly outperformed michigan.
The results also extend to the current wave of
unemployment. Using data from the US Bureau
of Labor Statistics for June 2009, the “Top 7
States” have a collective unemployment rate of
8.9%, compared to 9.4% for the other forty-two
states and 15.2% for Michigan.
Some will rationalize Michigan’s poor
performance as being directly reflective of the
worldwide automotive recession and resultant
impact to the “Big 3” automakers. While
this fact is indisputable, the fact that other
businesses – automotive or otherwise – are,
by and large, not selecting michigan for
their operations serves as the rationale for
necessary action.
Beyond their clear economic performance
shown in the graph, which states
comprise the “top 7” and what major tax
characteristics do they share that result in
their high ranking?
The “Top 7 States” in Overall Rank for the
2009 SBTCI are, in order, Wyoming, South
Dakota, Nevada, Alaska, Florida, Montana and
Texas.
the absence of a major tax is a dominant
factor in vaulting these states to the
top of the rankings. Property taxes and
unemployment insurance taxes are levied in
every state, but there are several states that
do without one or more of the major taxes (i.e.,
Corporate, Individual Income, or Sales). To
this end, Wyoming, Nevada and South Dakota
have no corporate tax or individual income tax;
Alaska has no individual income or state-level
sales tax; Florida and Texas have no individual
income tax; and Montana has no sales tax.
According to Mr. Barro, “…The lesson is
simple; a state that raises sufficient revenue
without one of the major taxes will, all things
being equal, out-compete those states that levy
every tax in the state tax collector’s arsenal.”
We must challenge ourselves as citizens
and ask if our state’s current structural,
legislative and regulatory systems are the
best for michigan as it transitions into an
economy that will have fewer manufacturing
sector jobs in the future. Acknowledging that
Michigan faces many hard decisions – unions
vs. right-to-work; part-time vs. full-time
legislature; an over-crowded criminal justice
system – Michigan’s legislators and Executive
Branch must consider revisions to Michigan’s
entire tax system if we are to fundamentally
transform michigan to become a national
leader in business…to become one of the “Top
7 States.”
There is an old sports adage, “To BE the best,
you must BEAT the best.”
now is the time for michigan to become
one of the best by creating a comprehensive
new tax system that will encourage
economic growth and vitality for years to
come. ■
NAHBR Professional Remodelers Council
Champagne Taste On A Beer Budget
WRITTEN BY BRAD HINKSON, CGR, PRESIDENT, HINKSON CONSTRUCTION, INC.,
BLOOMFIELD HILLS, AND CHAIRPERSON OF THE NAHBr PROFESSIONAL REMODELERS COUNCIL
Thirty-two NAHBR Professional Remodelers
Council members gathered on July 8 for a
presentation that is particularly important
during the current economic times. Michael
Gordon, RA, of MGA Architects and Kristen
Shellenbarger of Midwest Cabinet & Counter
presented examples from their own work on
how, working within limited budgets, they have
been able to produce spectacular, high end
results.
“It is typical of the times,” commented
Michael, “that people are staying in their homes
and want to make upgrades and changes that
cost little but look great.” He and Kristen began
with the example of a laundry and mud room
where slate flooring was used, cabinets were
“dressed up” with hardware and the washer and
dryer were made to look as if they were built in.
“Slate is inexpensive and beautiful,” said
Kristen. “And, in this case and many of the
others you will see, we were able to use a
remnant piece of granite for the countertop. This
is a huge savings and allows the client to include
a material that is high end at a reasonable
price.”
In another instance, the homeowner wanted
to use most of their kitchen remodeling budget
Presenters for the event, Kristen Shellenbarger of Midwest Cabinet and
Counter and Michael Gordon, RA, of MGA Architects.
6 Building Business & Apartment Management x September 2009
for large, top of the
line appliances,
leaving very little for
the rest of the room.
“Think out of the
box,” recommended
Kristen. “In this
case we used
stock cabinets
and added warmth
and variation with
frosted glass, which
is inexpensive. We
were able to build
in wine cubbies at
very little expense,
a mosaic tiled area for $300 and simple doors
that save a lot of money.”
Michael and Kristen continued their
presentation by showing a number of
other stunning examples of how to create
“champagne taste” rooms. A few suggestions
that they used in a number of instances include:
• Use taller cabinets rather than adding
expensive crown molding. It costs less, adds
height to the room and gives the homeowner
more storage space.
• Finish the interior of the
cabinets to match the outside, or
when there are glass door-inserts,
paint the inside of the cabinet to
highlight what will be stored there.
• Use a new ceiling product of
4’ by 4’ acoustic tiles that clip into
a grid, especially for basement
renovations. It is less expensive than
drywall, looks almost seamless and
can come down easily for access to
mechanicals.
• Try buying old furniture from
antique dealers or second-hand
stores, then refinishing it. This is not
only cost-effective; it is “green.”
• Use discontinued and remnant
material whenever possible.
Council Chairperson Brad Hinkson, CGR (left) and Council Vice Chairperson Bill Borchert.
• Paint is a great accent: it is
cheap and can be changed easily
and often.
• Add mirrors to make spaces look bigger.
• Invert a simple base molding with a crown
molding set into it to get the look of a larger
piece of molding at less expense.
• Subway tile is very popular now, as are
ceramic, glass and slate. They bring in the
1930’s look and can be inexpensive.
• There are some new laminates that look
and feel like stone and other high end materials.
• Talk to your suppliers. Take advantage of
their expertise.
Michael commented that sometimes the cost
savings begins with smart design. “If you can
design the kitchen without corners, you will save
money by avoiding mitered edges and you won’t
have to pay for expensive edge treatments.
You can also add elegant architectural details
in small areas rather than bringing them
throughout large areas. A little trim, for instance,
goes a long way.”
Kristen added, “Unify everything with design.
Decide what will be the “signature piece” in a
room and spend the money there. Be creative
and use a focal point in the room that brings in
the style the homeowners are looking for.”
There are ways to satisfy homeowners with
expensive taste and limited budgets as long as
you are creative and know where to use high
end material and where you can cut back while
still adding to the appeal of the room. ■
Legislative Update
WRITTEN BY FORREST WALL, CAE, STAFF VICE PRESIDENT AND INDUSTRY RELATIONS
Proposed Tax Tribunal Fee
Increases Opposed by AAM
On July 22, 2009, I testified on behalf of
AAM in opposition to a proposed set of fee
increases for tax appeals to the Michigan Tax
Tribunal. Included in the proposal is a narrowing
of valuation appeal categories and dramatically
increased filing fees for each category of
valuation appeal before the entire tribunal. The
proposed structure would increase fees as
follows:
• Where the value in contention is $100,000
or less the fee would increase from the present
fee of between $50 - $100 to a new fee of $250
(150% to 400% increase)
• Where the value in contention is
$100,000.01 to $500,000 the fee would
increase from $150 to $400 (167% increase)
• Where the value in contention is more than
$500,000 the fee would increase from $250 to
$600 (140% increase)
As many of you know, the Tribunal is made up
of two divisions, small claims (where residential
appeals go), and the entire tribunal (where
commercial rental property cases go). There is
a huge backlog of cases in both divisions, but
the significant fee increases are proposed for
appeals before the entire tribunal. Essentially,
the State of Michigan is forcing business owners
to further subsidize residential tax appeals. Most
of the additional revenue this proposal would
generate would go toward hiring staff to reduce
the small claims caseload, and not toward
the caseload before the entire tribunal, where
apartment appeals are heard.
The Tribunal’s rationale for seeking this
increase is that they have not had a fee
increase since 1974, it would make them a
self-funded entity not requiring an appropriation,
and, it would allow for the additional staff
referenced above. In addition to opposing the
fee increases, part of my testimony requested
additional reforms to the process, including a
statutory timeframe for adjudication of cases,
as recommended by the AAM Executive
Committee.
New Energy Optimization Program
A Great Opportunity for Apartment
Owners
In the wake of energy legislation passed in
Michigan last year, Consumers Energy, DTE
Energy, and MichCon launched programs in
July designed to improve the energy efficiency
of homes and businesses in their service
territories. These programs include low and
no cost energy efficiency upgrades for both
individual apartment units and common areas.
Some examples include:
Common areas
• Exterior Lighting (Consumers & DTE)
• LED Exit Signs (Consumers & DTE)
• Hard Wired CFL Fixtures (Consumers &
DTE)
• Boiler Upgrades and High Efficiency
Furnaces (Consumers)
in unit
• CFL Bulbs (Consumers & DTE)
• Programmable Thermostats (DTE)
• Energy Efficient Showerheads & Faucet
Aerators (Consumers & DTE)
In addition to being good for the environment,
increased efficiency means lower energy costs
for you and your residents! If you missed our
August seminar on this topic and are interested
in more information, feel free to contact me by
Everyday Noises Can
Cause Hearing Loss
WRITTEN BY JOE ELMORE, SMITH-PEABODY-STILES
8 Building Business & Apartment Management x September 2009
Noise is not a new hazard. It has been a constant threat since
the industrial revolution. Too much noise exposure may cause a
temporary change in hearing (your ears may feel stuffed up) or
a temporary ringing in your ears (tinnitus). These short-term problems
usually go away within a few minutes or hours after leaving the noise.
However, repeated exposures to loud noise can lead to permanent,
incurable hearing loss or tinnitus.
There are two rules of thumb to tell if noise situation is too loud: First,
if you have to raise your voice to talk to someone who is an arm’s length
away, then the noise is likely to be hazardous. Second, if your ears are
ringing or sounds seem dull or flat after leaving a noisy place, then you
probably were expose to hazardous noise.
The solution to this is twofold: remove hazardous noise from the
workplace whenever possible and use hearing protectors in those
situations where dangerous noise exposures have not yet been controlled
or eliminated.
Frequently Asked Questions About Hearing Protectors:
Q: Can you poke out your eardrums with earplugs?
A: That is unlikely for two reasons. First, the average ear canal is about
1 1/4 inches long. The typical ear plug is between 1/2 to 3/4 of an inch
long. So even if you inserted the entire earplug, it would still not touch
the eardrum. Second, the path from the opening of the ear canal to the
eardrum is not straight. In fact, it is quite irregular. This prevents you from
poking objects into the eardrum.
Q: Can you hear warning sounds, such as backup beeps, when
wearing hearing protectors?
A:. Using hearing protectors will bring both the noise and the warning
sound down equally. So if the warning sound is audible without the
hearing protector, it will usually be audible when wearing the hearing
protector. For the unusual situations where this is not the case, the
solution may be as simple as using a different hearing protector. Also,
many warning systems can be adjusted or changed so warning signals are
easier to detect.
Q: Won’t hearing protectors interfere with our ability to hear
important sounds our machinery and equipment make?
A: Hearing protectors will lower the noise level of your equipment; it
won’t eliminate it. However, some hearing protectors will reduce certain
BBAM_909_1-8.indd 8 8/20/2009 10:26:11 AM
Apartment Association of Michigan & Property Management Council News
frequencies more than others; so wearing
them can make noises sound different. In
cases where it’s important that the sound just
be quieter without any other changes, there
are hearing protectors that can provide flat
attenuation.
Q: Will we be able to hear each other
talk when wearing hearing protectors?
A: Some people find they can wear hearing
protectors and still understand speech. Others
will have trouble hearing speech while wearing
hearing protectors. Being able to hear what
other people say depends on many things:
distance from the speaker, ability to see the
speaker’s face, general familiarity with the topic,
level of background noise, and whether or not
one has an existing hearing impairment. In some
cases, wearing hearing protectors can make it
easier to understand speech.
Q: How long does it take to get used to
hearing protectors?
A: Think about getting a new pair of shoes.
Some shoes take no time to get used to. Others
- even though they are the right size - can take
a while to get used to. Hearing protectors are no
different from other safety equipment in terms
of getting used to them. But if hearing protectors
are the wrong size, or are worn out, they will not
be comfortable. Also, workers may need more
than one kind of protector at their job.
Q: How long can someone be in a loud
noise before it’s hazardous?
A: The degree of hearing hazard is related
to both the level of the noise as well as to the
duration of the exposure. But this question is
like asking how long can people look at the sun
without damaging their eyes. The safest thing
to do is to ensure workers always protect their
ears by wearing hearing protectors anytime they
are around loud noise.
Q: Since I already have hearing loss and
wear a hearing aid, hearing prevention
programs don’t apply to me, right?
A: If you have hearing loss, it’s important
to protect the hearing that you have left. Loud
noises can continue to damage your hearing
making it even more difficult to communicate at
work and with your family and friends. ■
Congratulations and
thanks to Remodelers
Council Chairperson
Brad Hinkson of
Hinkson Construction
who worked with Jewish
Family Services (JFS) to
provided desperately needed work for a Detroit
client. Thank you also to Richard Cherkasky
of The Richard Group for putting BIA and the
Remodelers Council in touch with JFS.
Brad Hinkson wrote, “The client is a lovely
woman with a radiance and a loving attitude in
spite of her physical disabilities and immediate
home maintenance needs. The only bathroom
in her 1870 home had no working toilet and no
sink at all. To make matters more difficult, the
bathroom is on the second floor.
manager, and I pick up a used toilet, sink and
faucet from Architectural Salvage Warehouse
in Detroit. Tom Friesen, executive director
of ASW and fellow BIA/NAHBR member,
worked with us by giving a discounted total for
the plumbing fixtures. Hinkson Construction
supplied all of the other necessary materials and
donated our labor. We installed the plumbing
fixtures, tested all and cleaned up. We then
asked the client if she would like to take a look.
She crawled up the stairs, fighting back the
tears as she climbed each tread. Once at the
top of the stairs and before she could even see
in the bathroom, the flood of tears let loose.
She wept with tears of joy and gratitude as she
entered the bathroom. It was a very emotional
experience. She gave me the tightest, most
loving hug I have ever received in my life. She
thanked us over and over again, telling us how
much she loved us and how she was going to
reach out and help others in her neighborhood
who are in need. Of all the projects we have done
in 19 years, this was by far the most gratifying.
I was and continue to be grateful for the
opportunity to represent the NAHBR and JFS.”
