<strong>Michigan</strong> Tax System Reform:<br />

A Time For Bold Action<br />

The tremendous, outbound migration <strong>of</strong><br />

<strong>Michigan</strong> residents over the past several<br />

years is well-documented. In April <strong>2009</strong>,<br />

a Detroit News article reported that, since 2001,<br />

outbound migration has cost <strong>Michigan</strong> 465,000<br />

residents. The economic impact <strong>of</strong> this loss<br />

equates to billions <strong>of</strong> dollars in paychecks and<br />

hundreds <strong>of</strong> millions <strong>of</strong> dollars in payroll taxes,<br />

sales and use taxes and property taxes.<br />

Why are so many <strong>Michigan</strong>ders – the majority<br />

<strong>of</strong> whom are younger and college educated –<br />

leaving our beautiful state? The answer is clear:<br />

the current job market and the perception<br />

<strong>of</strong> future job prospects is much brighter<br />

elsewhere.<br />

If you accept the premise that americans<br />

are hard-working people who desire a good<br />

job by which to earn the income needed to take<br />

care <strong>of</strong> themselves and their families, then the<br />

only solution to turning this migration trend<br />

around is creating a business environment<br />

that results in state-wide, year-over-year job<br />

growth.<br />

Without a doubt, economic conditions in<br />

<strong>Michigan</strong> and elsewhere are affected by a<br />

myriad <strong>of</strong> internal and external forces and<br />

conditions. As time goes on, a deteriorating<br />

economy will result in changes that extend well<br />

beyond what basic structural, legislative and<br />

regulatory systems can control or influence.<br />

Unquestionably, a significant factor in<br />

creating job growth during any type <strong>of</strong> economic<br />

condition is through tax policy. According<br />

to Joshua Barro, Staff Economist for the<br />

Tax Foundation “…companies will locate<br />

where they have the greatest competitive<br />

advantage. states with the best tax systems<br />

will be the most competitive in attracting<br />

new businesses and most effective at<br />

generating economic and employment<br />

growth…”<br />

In his paper entitled “<strong>2009</strong> State Business<br />

Tax Climate Index” (http://taxfoundation.org/<br />

files/bp58.pdf), Mr. Barro points out, “…while<br />

we live in a global marketplace, the Department<br />

<strong>of</strong> Labor reports that most mass job relocations<br />

are from one US state to another rather than<br />

overseas. This means that state lawmakers<br />

must be aware <strong>of</strong> how their states’ business<br />

climates stack up to others in their region and<br />

nationwide…”<br />

Mr. Barro goes on to say, “…state lawmakers<br />

are typically tempted to lure business with<br />

lucrative tax incentives and subsidies under<br />

the banner <strong>of</strong> job creation and economic<br />

development. however, the truth is that if<br />

a state needs to <strong>of</strong>fer such packages, it is<br />

most likely covering for a woeful business<br />

climate plagued by bad tax policy.” I<br />

agree with Mr. Barro that a far more effective<br />

approach is to systematically improve the<br />

business tax climate for the long term.<br />

The Tax Foundation’s State Business Tax<br />

Climate Index (SBTCI) is comprised <strong>of</strong> the<br />

following five weighted component indexes:<br />

Corporate Tax Index, Individual Income Tax<br />

Index, Sales Tax Index, Unemployment Tax Index<br />

and Property Tax Index. So, according to the<br />

<strong>2009</strong> SBTCI rankings, how does <strong>Michigan</strong> stack<br />

up?<br />

As far as overall taxation, <strong>Michigan</strong> was<br />

ranked 20th by the SBTCI in <strong>2009</strong>. That’s<br />

the good news. The bad news is <strong>Michigan</strong>’s<br />

Corporate Tax Index – composed <strong>of</strong> the factors<br />

by which businesses evaluate states when<br />

deciding to relocate – was ranked a dismal 48th<br />

out <strong>of</strong> 50.<br />

These rankings inspired me to do a little<br />

research. My findings were eye-opening to say<br />

the least!<br />

Using data collected by the US Bureau <strong>of</strong><br />

Economic Analysis (www.bea.gov), I compared<br />

three relatively simple but telling economic<br />

measures over the 2004-2008 timeframe:<br />

- gross domestic Product (gdP) by State,<br />

adjusted for inflation using the US Bureau <strong>of</strong><br />

Labor Statistics’ Consumer Price Index (CPI)<br />

- Per Capita income, by State and adjusted<br />

for inflation using the CPI<br />

- Population, by State<br />

Calculating the annual growth rate<br />

percentage for each measure – and using<br />

the Tax Foundation’s <strong>2009</strong> SBTCI overall tax<br />

rankings – analysis quickly revealed that the<br />

“Top 7 States” in Overall Rank performed<br />

markedly better than the 42 other states.<br />

Furthermore, as the graph shows, both the<br />

“top 7 states” and the forty-two others both<br />

significantly outperformed michigan.<br />

The results also extend to the current wave <strong>of</strong><br />

unemployment. Using data from the US Bureau<br />

<strong>of</strong> Labor Statistics for June <strong>2009</strong>, the “Top 7<br />

States” have a collective unemployment rate <strong>of</strong><br />

8.9%, compared to 9.4% for the other forty-two<br />

states and 15.2% for <strong>Michigan</strong>.<br />

Some will rationalize <strong>Michigan</strong>’s poor<br />

performance as being directly reflective <strong>of</strong> the<br />

worldwide automotive recession and resultant<br />

impact to the “Big 3” automakers. While<br />

this fact is indisputable, the fact that other<br />

businesses – automotive or otherwise – are,<br />

by and large, not selecting michigan for<br />

their operations serves as the rationale for<br />

necessary action.<br />

Beyond their clear economic performance<br />

shown in the graph, which states<br />

comprise the “top 7” and what major tax<br />

characteristics do they share that result in<br />

the absence <strong>of</strong> a major tax is a dominant<br />

factor in vaulting these states to the<br />

top <strong>of</strong> the rankings. Property taxes and<br />

unemployment insurance taxes are levied in<br />

every state, but there are several states that<br />

do without one or more <strong>of</strong> the major taxes (i.e.,<br />

Corporate, Individual Income, or Sales). To<br />

this end, Wyoming, Nevada and South Dakota<br />

have no corporate tax or individual income tax;<br />

Alaska has no individual income or state-level<br />

sales tax; Florida and Texas have no individual<br />

income tax; and Montana has no sales tax.<br />

According to Mr. Barro, “…The lesson is<br />

simple; a state that raises sufficient revenue<br />

without one <strong>of</strong> the major taxes will, all things<br />

being equal, out-compete those states that levy<br />

every tax in the state tax collector’s arsenal.”<br />

We must challenge ourselves as citizens<br />

and ask if our state’s current structural,<br />

legislative and regulatory systems are the<br />

best for michigan as it transitions into an<br />

economy that will have fewer manufacturing<br />

sector jobs in the future. Acknowledging that<br />

<strong>Michigan</strong> faces many hard decisions – unions<br />

vs. right-to-work; part-time vs. full-time<br />

legislature; an over-crowded criminal justice<br />

system – <strong>Michigan</strong>’s legislators and Executive<br />

Branch must consider revisions to <strong>Michigan</strong>’s<br />

entire tax system if we are to fundamentally<br />

transform michigan to become a national<br />

leader in business…to become one <strong>of</strong> the “Top<br />

7 States.”<br />

Champagne Taste On A Beer Budget<br />

Thirty-two NAHBR Pr<strong>of</strong>essional Remodelers<br />

Council members gathered on July 8 for a<br />

presentation that is particularly important<br />

during the current economic times. Michael<br />

Gordon, RA, <strong>of</strong> MGA Architects and Kristen<br />

Shellenbarger <strong>of</strong> Midwest Cabinet & Counter<br />

presented examples from their own work on<br />

how, working within limited budgets, they have<br />

been able to produce spectacular, high end<br />

results.<br />

“It is typical <strong>of</strong> the times,” commented<br />

Michael, “that people are staying in their homes<br />

and want to make upgrades and changes that<br />

cost little but look great.” He and Kristen began<br />

with the example <strong>of</strong> a laundry and mud room<br />

where slate flooring was used, cabinets were<br />

“dressed up” with hardware and the washer and<br />

dryer were made to look as if they were built in.<br />

“Slate is inexpensive and beautiful,” said<br />

Kristen. “And, in this case and many <strong>of</strong> the<br />

others you will see, we were able to use a<br />

remnant piece <strong>of</strong> granite for the countertop. This<br />

is a huge savings and allows the client to include<br />

a material that is high end at a reasonable<br />

price.”<br />

In another instance, the homeowner wanted<br />

to use most <strong>of</strong> their kitchen remodeling budget<br />

leaving very little for<br />

the rest <strong>of</strong> the room.<br />

“Think out <strong>of</strong> the<br />

box,” recommended<br />

Kristen. “In this<br />

case we used<br />

stock cabinets<br />

and added warmth<br />

and variation with<br />

frosted glass, which<br />

is inexpensive. We<br />

were able to build<br />

in wine cubbies at<br />

very little expense,<br />

a mosaic tiled area for $300 and simple doors<br />

that save a lot <strong>of</strong> money.”<br />

Michael and Kristen continued their<br />

presentation by showing a number <strong>of</strong><br />

other stunning examples <strong>of</strong> how to create<br />

“champagne taste” rooms. A few suggestions<br />

that they used in a number <strong>of</strong> instances include:<br />

• Use taller cabinets rather than adding<br />

expensive crown molding. It costs less, adds<br />

height to the room and gives the homeowner<br />

more storage space.<br />

• Finish the interior <strong>of</strong> the<br />

cabinets to match the outside, or<br />

when there are glass door-inserts,<br />

paint the inside <strong>of</strong> the cabinet to<br />

highlight what will be stored there.<br />

• Use a new ceiling product <strong>of</strong><br />

4’ by 4’ acoustic tiles that clip into<br />

a grid, especially for basement<br />

renovations. It is less expensive than<br />

drywall, looks almost seamless and<br />

can come down easily for access to<br />

mechanicals.<br />

• Try buying old furniture from<br />

antique dealers or second-hand<br />

stores, then refinishing it. This is not<br />

only cost-effective; it is “green.”<br />

• Use discontinued and remnant<br />

material whenever possible.<br />

• Paint is a great accent: it is<br />

cheap and can be changed easily<br />

and <strong>of</strong>ten.<br />

• Add mirrors to make spaces look bigger.<br />

• Invert a simple base molding with a crown<br />

molding set into it to get the look <strong>of</strong> a larger<br />

piece <strong>of</strong> molding at less expense.<br />

• Subway tile is very popular now, as are<br />

ceramic, glass and slate. They bring in the<br />

1930’s look and can be inexpensive.<br />

• There are some new laminates that look<br />

and feel like stone and other high end materials.<br />

• Talk to your suppliers. Take advantage <strong>of</strong><br />

their expertise.<br />

Michael commented that sometimes the cost<br />

savings begins with smart design. “If you can<br />

design the kitchen without corners, you will save<br />

money by avoiding mitered edges and you won’t<br />

have to pay for expensive edge treatments.<br />

You can also add elegant architectural details<br />

in small areas rather than bringing them<br />

throughout large areas. A little trim, for instance,<br />

goes a long way.”<br />

Kristen added, “Unify everything with design.<br />

Decide what will be the “signature piece” in a<br />

room and spend the money there. Be creative<br />

and use a focal point in the room that brings in<br />

the style the homeowners are looking for.”<br />

There are ways to satisfy homeowners with<br />

expensive taste and limited budgets as long as<br />

you are creative and know where to use high<br />

end material and where you can cut back while<br />

still adding to the appeal <strong>of</strong> the room. ■<br />

Legislative Update<br />

Proposed Tax Tribunal Fee<br />

Increases Opposed by AAM<br />

On July 22, <strong>2009</strong>, I testified on behalf <strong>of</strong><br />

AAM in opposition to a proposed set <strong>of</strong> fee<br />

increases for tax appeals to the <strong>Michigan</strong> Tax<br />

Tribunal. Included in the proposal is a narrowing<br />

<strong>of</strong> valuation appeal categories and dramatically<br />

increased filing fees for each category <strong>of</strong><br />

valuation appeal before the entire tribunal. The<br />

proposed structure would increase fees as<br />

follows:<br />

• Where the value in contention is $100,000<br />

or less the fee would increase from the present<br />

fee <strong>of</strong> between $50 - $100 to a new fee <strong>of</strong> $250<br />

(150% to 400% increase)<br />

• Where the value in contention is<br />

$100,000.01 to $500,000 the fee would<br />

increase from $150 to $400 (167% increase)<br />

• Where the value in contention is more than<br />

$500,000 the fee would increase from $250 to<br />

$600 (140% increase)<br />

As many <strong>of</strong> you know, the Tribunal is made up<br />

<strong>of</strong> two divisions, small claims (where residential<br />

appeals go), and the entire tribunal (where<br />

commercial rental property cases go). There is<br />

a huge backlog <strong>of</strong> cases in both divisions, but<br />

the significant fee increases are proposed for<br />

appeals before the entire tribunal. Essentially,<br />

the State <strong>of</strong> <strong>Michigan</strong> is forcing business owners<br />

to further subsidize residential tax appeals. Most<br />

<strong>of</strong> the additional revenue this proposal would<br />

generate would go toward hiring staff to reduce<br />

the small claims caseload, and not toward<br />

the caseload before the entire tribunal, where<br />

apartment appeals are heard.<br />

The Tribunal’s rationale for seeking this<br />

increase is that they have not had a fee<br />

increase since 1974, it would make them a<br />

self-funded entity not requiring an appropriation,<br />

and, it would allow for the additional staff<br />

referenced above. In addition to opposing the<br />

fee increases, part <strong>of</strong> my testimony requested<br />

additional reforms to the process, including a<br />

statutory timeframe for adjudication <strong>of</strong> cases,<br />

as recommended by the AAM Executive<br />

Committee.<br />

<strong>Michigan</strong> last year, Consumers Energy, DTE<br />

Energy, and MichCon launched programs in<br />

July designed to improve the energy efficiency<br />

<strong>of</strong> homes and businesses in their service<br />

territories. These programs include low and<br />

no cost energy efficiency upgrades for both<br />

individual apartment units and common areas.<br />

Everyday Noises Can<br />

Cause Hearing Loss<br />

Noise is not a new hazard. It has been a constant threat since<br />

the industrial revolution. Too much noise exposure may cause a<br />

temporary change in hearing (your ears may feel stuffed up) or<br />

a temporary ringing in your ears (tinnitus). These short-term problems<br />

usually go away within a few minutes or hours after leaving the noise.<br />

However, repeated exposures to loud noise can lead to permanent,<br />

incurable hearing loss or tinnitus.<br />

There are two rules <strong>of</strong> thumb to tell if noise situation is too loud: First,<br />

if you have to raise your voice to talk to someone who is an arm’s length<br />

away, then the noise is likely to be hazardous. Second, if your ears are<br />

ringing or sounds seem dull or flat after leaving a noisy place, then you<br />

probably were expose to hazardous noise.<br />

The solution to this is tw<strong>of</strong>old: remove hazardous noise from the<br />

workplace whenever possible and use hearing protectors in those<br />

situations where dangerous noise exposures have not yet been controlled<br />

or eliminated.<br />

Frequently Asked Questions About Hearing Protectors:<br />

Q: Can you poke out your eardrums with earplugs?<br />

A: That is unlikely for two reasons. First, the average ear canal is about<br />

1 1/4 inches long. The typical ear plug is between 1/2 to 3/4 <strong>of</strong> an inch<br />

long. So even if you inserted the entire earplug, it would still not touch<br />

the eardrum. Second, the path from the opening <strong>of</strong> the ear canal to the<br />

eardrum is not straight. In fact, it is quite irregular. This prevents you from<br />

poking objects into the eardrum.<br />

Q: Can you hear warning sounds, such as backup beeps, when<br />

wearing hearing protectors?<br />

A:. Using hearing protectors will bring both the noise and the warning<br />

sound down equally. So if the warning sound is audible without the<br />

hearing protector, it will usually be audible when wearing the hearing<br />

protector. For the unusual situations where this is not the case, the<br />

solution may be as simple as using a different hearing protector. Also,<br />

many warning systems can be adjusted or changed so warning signals are<br />

easier to detect.<br />

Q: Won’t hearing protectors interfere with our ability to hear<br />

important sounds our machinery and equipment make?<br />

A: Hearing protectors will lower the noise level <strong>of</strong> your equipment; it<br />

won’t eliminate it. However, some hearing protectors will reduce certain<br />

frequencies more than others; so wearing<br />

them can make noises sound different. In<br />

cases where it’s important that the sound just<br />

be quieter without any other changes, there<br />

are hearing protectors that can provide flat<br />

attenuation.<br />

Q: Will we be able to hear each other<br />

talk when wearing hearing protectors?<br />

A: Some people find they can wear hearing<br />

protectors and still understand speech. Others<br />

will have trouble hearing speech while wearing<br />

hearing protectors. Being able to hear what<br />

other people say depends on many things:<br />

distance from the speaker, ability to see the<br />

speaker’s face, general familiarity with the topic,<br />

level <strong>of</strong> background noise, and whether or not<br />

one has an existing hearing impairment. In some<br />

cases, wearing hearing protectors can make it<br />

easier to understand speech.<br />

Q: How long does it take to get used to<br />

hearing protectors?<br />

A: Think about getting a new pair <strong>of</strong> shoes.<br />

Some shoes take no time to get used to. Others<br />

- even though they are the right size - can take<br />

a while to get used to. Hearing protectors are no<br />

different from other safety equipment in terms<br />

<strong>of</strong> getting used to them. But if hearing protectors<br />

are the wrong size, or are worn out, they will not<br />

be comfortable. Also, workers may need more<br />

than one kind <strong>of</strong> protector at their job.<br />

Q: How long can someone be in a loud<br />

noise before it’s hazardous?<br />

A: The degree <strong>of</strong> hearing hazard is related<br />

to both the level <strong>of</strong> the noise as well as to the<br />

duration <strong>of</strong> the exposure. But this question is<br />

like asking how long can people look at the sun<br />

without damaging their eyes. The safest thing<br />

to do is to ensure workers always protect their<br />

ears by wearing hearing protectors anytime they<br />

are around loud noise.<br />

Q: Since I already have hearing loss and<br />

wear a hearing aid, hearing prevention<br />

programs don’t apply to me, right?<br />

A: If you have hearing loss, it’s important<br />

to protect the hearing that you have left. Loud<br />

noises can continue to damage your hearing<br />

making it even more difficult to communicate at<br />

work and with your family and friends. ■<br />

provided desperately needed work for a Detroit<br />

client. Thank you also to Richard Cherkasky<br />

<strong>of</strong> The Richard Group for putting <strong>BIA</strong> and the<br />

Remodelers Council in touch with JFS.<br />

Brad Hinkson wrote, “The client is a lovely<br />

woman with a radiance and a loving attitude in<br />

spite <strong>of</strong> her physical disabilities and immediate<br />

home maintenance needs. The only bathroom<br />

in her 1870 home had no working toilet and no<br />

sink at all. To make matters more difficult, the<br />

bathroom is on the second floor.<br />

worked with us by giving a discounted total for<br />

the plumbing fixtures. Hinkson Construction<br />

supplied all <strong>of</strong> the other necessary materials and<br />

donated our labor. We installed the plumbing<br />

fixtures, tested all and cleaned up. We then<br />

asked the client if she would like to take a look.<br />

She crawled up the stairs, fighting back the<br />

tears as she climbed each tread. Once at the<br />

top <strong>of</strong> the stairs and before she could even see<br />

in the bathroom, the flood <strong>of</strong> tears let loose.<br />

She wept with tears <strong>of</strong> joy and gratitude as she<br />

entered the bathroom. It was a very emotional<br />

experience. She gave me the tightest, most<br />

loving hug I have ever received in my life. She<br />

thanked us over and over again, telling us how<br />

much she loved us and how she was going to<br />

reach out and help others in her neighborhood<br />

who are in need. Of all the projects we have done<br />

in 19 years, this was by far the most gratifying.<br />

I was and continue to be grateful for the<br />

opportunity to represent the NAHBR and JFS.”<br />
