4 No.BASIC CONDITIONS OF EMPLOYMENT AMENDMENT BILL, 2012on the case-load <strong>of</strong> the CCMA, the social partners believe that an investigation <strong>of</strong>the implications <strong>of</strong> such a change should be undertaken before any legislativechange is made.Amendment to section 68The mandatory requirement that inspectors must seek to secure a writtenundertaking from defaulting employers to comply with the Act before issuing acompliance order is removed. While seeking to obtain a written undertakingremains part <strong>of</strong> the statutory enforcement process, making this stagediscretionary will prevent habitually non-compliant employers from using this as abasis for resisting enforcement processes.If an employer fails to comply with a written undertaking that it has given, theDepartment <strong>of</strong> Labour will be able to apply directly to the Labour Court to enforcecompliance with the undertaking.Amendment to section 69Section 69 is amended to provide that a compliance order may specify the date –(a) by which the employer must make any representations it wishes to makeas to why it is not in breach <strong>of</strong> the BCEA;(b) on which the Department <strong>of</strong> Labour will apply to the Labour Court to havethe order made into a court order if the employer does not comply with theorder.4


5 No.BASIC CONDITIONS OF EMPLOYMENT AMENDMENT BILL, 2012These amendments are intended to expedite the process for enforcingcompliance with the BCEA while allowing the employer an adequate opportunityto state its case in representations to the Labour Court.Amendment to section 70Section 70 dealing with the limitations on the power <strong>of</strong> inspectors to issuecompliance orders is clarified. These amendments are <strong>of</strong> a technical nature.Repeal <strong>of</strong> sections 71 and 72The procedure in terms <strong>of</strong> which an employer is able to make objections to theDirector -General concerning a compliance order is removed from the Act. Anyobjections that employers have to compliance orders, that are contested by theDepartment <strong>of</strong> Labour, will now be adjudicated by the Labour Court.Amendment to section 74The jurisdiction <strong>of</strong> the Labour Court and the CCMA to adjudicate on claims underthe BCEA in the course <strong>of</strong> hearing an unfair dismissal case are to be broadenedto cover any claim by the employee under the BCEA that has not prescribed.Once the Court or arbitrator has determined the matter, no compliance order orother proceedings can be continued or brought in respect <strong>of</strong> the claim. This willavoid “splitting” <strong>of</strong> claims and thus prevent the unnecessary duplication <strong>of</strong>proceedings for employers and employees. It will also ensure the most effectiveuse <strong>of</strong> the resources <strong>of</strong> the Labour Court, CCMA and Department <strong>of</strong> Labour.5


6 No.BASIC CONDITIONS OF EMPLOYMENT AMENDMENT BILL, 2012Amendment to section 77The jurisdiction <strong>of</strong> the Labour Court is clarified by specifying that it hasjurisdiction to grant civil remedies (such as interdicts) in respect <strong>of</strong> matters whichare criminal <strong>of</strong>fences. This clarifies that the Labour Court can, for instance,interdict an employer from requiring children to work in breach <strong>of</strong> the child labourprovisions <strong>of</strong> the Act.Amendment to section 93The maximum term <strong>of</strong> imprisonment for an <strong>of</strong>fence involving child labour orforced labour is increased from three years to six years, and the maximum term<strong>of</strong> imprisonment in respect <strong>of</strong> an <strong>of</strong>fence under section 33A is set at 3 years.Amendment to Schedule 2The maximum penalties that may be imposed for a breach <strong>of</strong> the BCEA notinvolving an underpayment are increased by 200%. These penalties have notchanged since the Act first came into effect.6
