32.11 The word “Employee” when used throughout this Agreement shall mean aperson included in the above described Bargaining Unit.ARTICLE 3 – MANAGEMENT RIGHTS3.01 The Union acknowledges that all management rights and prerogatives are vestedexclusively with the Employer and without limiting the generality of the <strong>for</strong>egoing;it is the exclusive function of the Employer:(a)(b)(c)(d)To determine and establish standards and procedures <strong>for</strong> the care,welfare, safety and com<strong>for</strong>t of the residents in the Home.To maintain order, discipline and efficiency and in connection therewith toestablish and en<strong>for</strong>ce reasonable rules and regulations.To hire, transfer, lay-off, schedule, recall, promote, demote, classify,assign duties, discharge, suspend or otherwise discipline employees <strong>for</strong>just cause, provided that a claim of discriminatory transfer, promotion,demotion of classification or a claim that an employee has beendischarged or disciplined without just cause, may be the subject of agrievance and dealt with as hereinafter provided.To have the right to plan, direct, and control the work and direction ofemployees and the operation of the Home. This includes the right tointroduce new and improved methods, facilities, equipment and to controlthe amount of supervision necessary, work schedules, the combining orsplitting up of departments, and the increases or reduction of personnel ina particular area or on the whole.3.02 The Employer will exercise these rights in a manner consistent with theCollective Agreement and apply the provisions of the Collective Agreement in areasonable manner.ARTICLE 4 – RELATIONSHIPThe Employer and the Union are committed to providing a positive environment <strong>for</strong> staff. Allindividuals have the right to be treated with respect and dignity. Each individual has the right towork in an atmosphere which promotes respectful interactions and is free from discrimination,harassment, aggression and violence.4.01 The Employer and the Union agree that there will be no discrimination,interference, intimidation, restriction or coercion exercised or practised by any oftheir representatives with respect to any employee because of her membershipor non-membership in the Union or activity or lack of activity on behalf of theUnion or by reason of exercising her rights under the Collective Agreement.4.02 There shall be no discrimination or harassment on the part of the Employer, theUnion or any employees covered by this Agreement by reason of race, creed,colour, ethnic origin, marital status, family status, sex, citizenship, ancestry,sexual orientation, disability, place of origin, residence, age, political or religiousYEEHG01.C14
