Chapter 15 • Protection <strong>and</strong> Redress <strong>for</strong> Victims <strong>of</strong> Crime <strong>and</strong> Human Rights Violations“set up a centralized public register <strong>of</strong> complaints <strong>of</strong> torture <strong>and</strong> ill-treatment <strong>and</strong> <strong>of</strong> theresults <strong>of</strong> the investigations”. 154 *****Article 2(b) <strong>and</strong> (c) <strong>of</strong> the Convention on the Elimination <strong>of</strong> All Forms <strong>of</strong>Discrimination against Women requires the States parties “to adopt appropriatelegislative <strong>and</strong> other measures, including sanctions where appropriate, prohibiting alldiscrimination against women” <strong>and</strong> “to establish legal <strong>protection</strong> <strong>of</strong> the <strong>rights</strong> <strong>of</strong>women on an equal basis with men <strong>and</strong> to ensure through competent national tribunals<strong>and</strong> other public institutions the effective <strong>protection</strong> <strong>of</strong> women against any act <strong>of</strong>discrimination”. Although these provisions are applicable to all <strong>for</strong>ms <strong>of</strong> gender-baseddiscrimination, they assume special importance in the case <strong>of</strong> all <strong>for</strong>ms <strong>of</strong> violenceagainst <strong>and</strong> abuse <strong>of</strong> women.On this issue the Committee on the Elimination <strong>of</strong> Discrimination againstWomen recommends that the States parties to the Convention take“Effective legal measures, including penal sanctions, civil remediescompensatory provisions to protect women against all kinds <strong>of</strong> violence,including, inter alia, violence <strong>and</strong> abuse in the family, sexual assault <strong>and</strong>sexual harassment in the workplace”. 155Commenting on the situation in the Republic <strong>of</strong> Moldova, the Committeeemphasized that violence against women, “including domestic violence, constitutes aviolation <strong>of</strong> the <strong>human</strong> <strong>rights</strong> <strong>of</strong> women under the Convention”. It called on theGovernment “to ensure that such violence constitutes a <strong>crime</strong> punishable undercriminal law, that it is prosecuted <strong>and</strong> punished with the required severity <strong>and</strong> speed”. 156It urged Uzbekistan to ensure that women <strong>and</strong> girls who are <strong>victims</strong> <strong>of</strong> violence,including domestic violence, “have immediate means <strong>of</strong> <strong>redress</strong> <strong>and</strong> <strong>protection</strong>”. 1573.5.2 The regional levelThe Inter-American Court <strong>of</strong> Human Rights held in the Street Children casethat it is clear from article 1(1) <strong>of</strong> the American Convention on Human Rights “that theState is obliged to investigate <strong>and</strong> punish any violation <strong>of</strong> the <strong>rights</strong> embodied in theConvention in order to guarantee such <strong>rights</strong>”. 158 In the earlier Velásquez Rodríguez case,the Court had set <strong>for</strong>th at some length its views on States parties’ duty to investigate<strong>human</strong> <strong>rights</strong> <strong>violations</strong>, which in that case involved the abduction <strong>and</strong> subsequentdisappearance <strong>of</strong> Mr. Velásquez.
