Part 4 – Sale <strong>of</strong> Goods Technical Guidance InformationApplication for Sale <strong>of</strong> Goods PermitSection 222 Sale <strong>of</strong> Goods Permit means an authorisation and permit on the same terms and conditions asthe Authorisation and Permit for Sale <strong>of</strong> Goods annexed to this agreement and where context permits Sale <strong>of</strong>Goods permit has the same meaning.Prior to being granted any Section 222 Sale <strong>of</strong> Goods Permit, applicants will need to appreciate and accept thefollowing significant technical requirements:-1 The applicant accepts that any proposed Sale <strong>of</strong> Goods area may require Development Approval andwill be referred to Council's Planning Section for comment. If a Development Approval is required, thena Development Application must be submitted containing a detailed plan <strong>of</strong> the proposed Sale <strong>of</strong> GoodsArea.2 Should it be determined that a Development Application is required, the applicant further accepts thatupon receipt <strong>of</strong> Development Approval, the applicant will then complete and execute an Authorisationand Permit for Sale <strong>of</strong> Goods on the same terms and conditions as the Authorisation and Permit for Sale<strong>of</strong> Goods annexed to this application. Alternatively, should it be determined that a DevelopmentApplication is not required, the applicant will still be required to complete and execute an Authorisationand Permit for Sale <strong>of</strong> Goods on the same terms and conditions as the Authorisation and Permit for Sale<strong>of</strong> Goods annexed to this application. Subject to final Permit approval and payment <strong>of</strong> the below permitfee, a countersigned permit shall be provided to the applicant, at which time the applicant will becomelegally entitled to provide Sale <strong>of</strong> Goods upon a Council footpath.3 The issuing <strong>of</strong> a Sale <strong>of</strong> Goods permit for will be at the discretion <strong>of</strong> the Council after assessing thefollowing:• Impact on public safety and vehicular traffic;• Community benefit;• Impact on the amenity <strong>of</strong> the street and locality;• Availability <strong>of</strong> car parking;• Nuisance from noise on adjoining land uses;• Disability Discrimination Act requirements and disabled access;• Character and heritage (particularly where in a State Heritage area); and• Adverse Sale <strong>of</strong> Goods activities including public behaviour.4 That the level <strong>of</strong> public protection required at different Sale <strong>of</strong> Goods sites, will differ. The need forprotection is determined through an advanced and comprehensive risk assessment process.5 A risk assessment process will also consider the likelihood <strong>of</strong> a vehicle leaving the road and entering anSale <strong>of</strong> Goods site, as well as the consequences <strong>of</strong> that occurrence. Likelihood is affected by suchaspects as traffic volumes and curves. Consequence is affected by such aspects as vehicle speeds.6 If a potential public risk is significant, the risk shall be managed through the use <strong>of</strong> crash barriers(generally known energy absorbing bollards) or by vehicles parked in front <strong>of</strong> the Sale <strong>of</strong> Goods site andtrading hours. Applicants will need to understand and accept that when parked cars are used to protectdiners, the times <strong>of</strong> Sale <strong>of</strong> Goods trade will generally need to be constrained to predictable peak tradingperiods, when there is some certainty that parked cars will in fact be present and <strong>of</strong>fer sufficientprotection.7 If the Sale <strong>of</strong> Goods is proposed within the <strong>Port</strong> <strong>Adelaide</strong> Centre, the applicant shall be required toensure that all roadside furniture to be <strong>of</strong> a type and installed in accordance with Council’s Standardsand as advised by the Chief Executive Officer or nominee.8 The specific conditions set out in this clause are to be maintained at all times by the applicant. Application for Sale <strong>of</strong> Goods Permit• Install barriers at both ends <strong>of</strong> the allocated Sale <strong>of</strong> Goods area at right angles to the barriers describedabove to delineate the extremes <strong>of</strong> the allocated Sale <strong>of</strong> Goods area.9 That the layout <strong>of</strong> the permit area will depend on the space available after satisfying the followingrequirements:(a) Maintain at all times a distance <strong>of</strong> 2.0 metres between the dining area and the building as athoroughfare for pedestrians and people with disabilities; and(b) Required setback <strong>of</strong> furniture from the top <strong>of</strong> the kerb or from a protective crash barrier.(c) Provision <strong>of</strong> 300mm distance from the inner edge <strong>of</strong> any <strong>of</strong>f road bicycle path for the full length <strong>of</strong> anyallocated dining area to provide physical separation between the dining area and moving cyclist.10 To ensure that so far as reasonably practicable the minimum floor area required for each table/chairconfiguration is as follows:• Sale <strong>of</strong> Goods furniture shall not be permanently fixed to the ground surface unless with the writtenapproval <strong>of</strong> Council; and• Approval to secure any Sale <strong>of</strong> Goods equipment to the ground surface during trading hours, andthe method <strong>of</strong> fixing shall be approved by Chief Executive Officer or nominee in order to ensure thatno hazard remains after the furniture is removed.• The style, structure and colour <strong>of</strong> Sale <strong>of</strong> Goods furniture should complement the surroundingstreetscape and where appropriate, be in accordance with Council’s <strong>Port</strong> Centre Public DomainManual.11 Chief Executive Officer or nominee shall determine the boundaries <strong>of</strong> the licensed area and also clearlymark by the means <strong>of</strong> a series <strong>of</strong> prominent disk markers.
