applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the <str<strong>on</strong>g>of</str<strong>on</strong>g>telecommunicati<strong>on</strong> services, with particular reference to teleph<strong>on</strong>e services as well <str<strong>on</strong>g>Europe</str<strong>on</strong>g>an Committee <strong>on</strong> Crime Problems (CDPC) <strong>on</strong> cybercrime in order to bringdomestic criminal law provisi<strong>on</strong>s closer to each other and enable the use <str<strong>on</strong>g>of</str<strong>on</strong>g> effective means <str<strong>on</strong>g>of</str<strong>on</strong>g>investigati<strong>on</strong> c<strong>on</strong>cerning such <str<strong>on</strong>g>of</str<strong>on</strong>g>fences, as well as to Resoluti<strong>on</strong> N° 3, adopted at the 23 rd C<strong>on</strong>ference<str<strong>on</strong>g>of</str<strong>on</strong>g> the <str<strong>on</strong>g>Europe</str<strong>on</strong>g>an Ministers <str<strong>on</strong>g>of</str<strong>on</strong>g> Justice (L<strong>on</strong>d<strong>on</strong>, June 2000), which encouraged the negotiating parties topursue their efforts with a view to finding appropriate soluti<strong>on</strong>s so as to enable the largest possiblenumber <str<strong>on</strong>g>of</str<strong>on</strong>g> States to become parties to the <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g> and acknowledged the need for a swift andefficient system <str<strong>on</strong>g>of</str<strong>on</strong>g> internati<strong>on</strong>al co-operati<strong>on</strong>, which duly takes into account the specific requirements<str<strong>on</strong>g>of</str<strong>on</strong>g> the fight against cybercrime;Having also regard to the Acti<strong>on</strong> Plan adopted by the Heads <str<strong>on</strong>g>of</str<strong>on</strong>g> State and Government <str<strong>on</strong>g>of</str<strong>on</strong>g> the <str<strong>on</strong>g>Council</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g><str<strong>on</strong>g>Europe</str<strong>on</strong>g>, <strong>on</strong> the occasi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> their Sec<strong>on</strong>d Summit (Strasbourg, 10 - 11 October 1997), to seekcomm<strong>on</strong> resp<strong>on</strong>ses to the development <str<strong>on</strong>g>of</str<strong>on</strong>g> the new informati<strong>on</strong> technologies, based <strong>on</strong> the standardsand values <str<strong>on</strong>g>of</str<strong>on</strong>g> the <str<strong>on</strong>g>Council</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> Except as specifically otherwise provided in Article 21, each Party shall apply the powers andprocedures referred to in paragraph 1 to:a. the criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fences established in accordance with articles 2-11 <str<strong>on</strong>g>of</str<strong>on</strong>g> this <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>;b. other criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fences committed by means <str<strong>on</strong>g>of</str<strong>on</strong>g> a computer system; andc. the collecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> evidence in electr<strong>on</strong>ic form <str<strong>on</strong>g>of</str<strong>on</strong>g> a criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fence.3. a. Each Party may reserve the right to apply the measures referred to in Article 20 <strong>on</strong>ly to<str<strong>on</strong>g>of</str<strong>on</strong>g>fences or categories <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>fences specified in the reservati<strong>on</strong>, provided that the range <str<strong>on</strong>g>of</str<strong>on</strong>g> such <str<strong>on</strong>g>of</str<strong>on</strong>g>fencesor categories <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>fences is not more restricted than the range <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>fences to which it applies themeasures referred to in Article 21. Each Party shall c<strong>on</strong>sider restricting such a reservati<strong>on</strong> to enablethe broadest applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the measure referred to in Article 20.b. Where a Party, due to limitati<strong>on</strong>s in its legislati<strong>on</strong> in force at the time <str<strong>on</strong>g>of</str<strong>on</strong>g> the adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> thepresent <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>, is not able to apply the measures referred to in Articles 20 and 21 tocommunicati<strong>on</strong>s being transmitted within a computer system <str<strong>on</strong>g>of</str<strong>on</strong>g> a service provider, which systemi. is being operated for the benefit <str<strong>on</strong>g>of</str<strong>on</strong>g> a closed group <str<strong>on</strong>g>of</str<strong>on</strong>g> users, andii. does not employ public communicati<strong>on</strong>s networks and is not c<strong>on</strong>nected with anothercomputer system, whether public or private,that Party may reserve the right not to apply these measures to such communicati<strong>on</strong>s. EachParty shall c<strong>on</strong>sider restricting such a reservati<strong>on</strong> to enable the broadest applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> themeasures referred to in Articles 20 and 21.Article 15 – C<strong>on</strong>diti<strong>on</strong>s and safeguards1. Each Party shall ensure that the establishment, implementati<strong>on</strong> and applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the powers andprocedures provided for in this Secti<strong>on</strong> are subject to c<strong>on</strong>diti<strong>on</strong>s and safeguards provided for under itsdomestic law, which shall provide for the adequate protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> human rights and liberties, includingrights arising pursuant to obligati<strong>on</strong>s it has undertaken under the 1950 <str<strong>on</strong>g>Council</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Europe</str<strong>on</strong>g> <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>for the Protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Human Rights and Fundamental Freedoms, the 1966 United Nati<strong>on</strong>s Internati<strong>on</strong>alCovenant <strong>on</strong> Civil and Political Rights, and other applicable internati<strong>on</strong>al human rights instruments,and which shall incorporate the principle <str<strong>on</strong>g>of</str<strong>on</strong>g> proporti<strong>on</strong>ality.2. Such c<strong>on</strong>diti<strong>on</strong>s and safeguards shall, as appropriate in view <str<strong>on</strong>g>of</str<strong>on</strong>g> the nature <str<strong>on</strong>g>of</str<strong>on</strong>g> the power or procedurec<strong>on</strong>cerned, inter alia, include judicial or other independent supervisi<strong>on</strong>, grounds justifying applicati<strong>on</strong>,and limitati<strong>on</strong> <strong>on</strong> the scope and the durati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> such power or procedure.3. To the extent that it is c<strong>on</strong>sistent with the public interest, in particular the sound administrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g>justice, a Party shall c<strong>on</strong>sider the impact <str<strong>on</strong>g>of</str<strong>on</strong>g> the powers and procedures in this Secti<strong>on</strong> up<strong>on</strong> therights, resp<strong>on</strong>sibilities and legitimate interests <str<strong>on</strong>g>of</str<strong>on</strong>g> third parties.Title 2 - Expedited preservati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> stored computer dataArticle 16 – Expedited preservati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> stored computer data1. Where a Party gives effect to paragraph 1 above by means <str<strong>on</strong>g>of</str<strong>on</strong>g> an order to a pers<strong>on</strong> to preservespecified stored computer data in the pers<strong>on</strong>’s possessi<strong>on</strong> or c<strong>on</strong>trol, the Party shall adopt suchlegislative and other measures as may be necessary to oblige that pers<strong>on</strong> to preserve and maintainthe integrity <str<strong>on</strong>g>of</str<strong>on</strong>g> that computer data for a period <str<strong>on</strong>g>of</str<strong>on</strong>g> time as l<strong>on</strong>g as necessary, up to a maximum <str<strong>on</strong>g>of</str<strong>on</strong>g> 90days, to enable the competent authorities to seek its disclosure. A Party may provide for such anorder to be subsequently renewed.3. Each Party shall adopt such legislative or other measures as may be necessary to oblige thecustodian or other pers<strong>on</strong> who is to preserve the computer data to keep c<strong>on</strong>fidential the undertaking <str<strong>on</strong>g>of</str<strong>on</strong>g>such procedures for the period <str<strong>on</strong>g>of</str<strong>on</strong>g> time provided for by its domestic law.4. The powers and procedures referred to in this article shall be subject to Articles 14 and 15.Article 17 – Expedited preservati<strong>on</strong> and partial disclosure <str<strong>on</strong>g>of</str<strong>on</strong>g> traffic data1. Each Party shall adopt, in respect <str<strong>on</strong>g>of</str<strong>on</strong>g> traffic data that is to be preserved under Article 16, suchlegislative and other measures as may be necessary to:a. ensure that such expeditious preservati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> traffic data is available regardless <str<strong>on</strong>g>of</str<strong>on</strong>g> whether<strong>on</strong>e or more service providers were involved in the transmissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> that communicati<strong>on</strong>; andb. ensure the expeditious disclosure to the Party’s competent authority, or a pers<strong>on</strong>designated by that authority, <str<strong>on</strong>g>of</str<strong>on</strong>g> a sufficient amount <str<strong>on</strong>g>of</str<strong>on</strong>g> traffic data to enable the Party to identifythe service providers and the path through which the communicati<strong>on</strong> was transmitted.3. The powers and procedures referred to in this article shall be subject to Articles 14 and 15.Article 18 – Producti<strong>on</strong> orderTitle 3 – Producti<strong>on</strong> order1. Each Party shall adopt such legislative and other measures as may be necessary to empower itscompetent authorities to order:a. a pers<strong>on</strong> in its territory to submit specified computer data in that pers<strong>on</strong>’s possessi<strong>on</strong> orc<strong>on</strong>trol, which is stored in a computer system or a computer-data storage medium; andb. a service provider <str<strong>on</strong>g>of</str<strong>on</strong>g>fering its services in the territory <str<strong>on</strong>g>of</str<strong>on</strong>g> the Party to submit subscriberinformati<strong>on</strong> relating to such services in that service provider’s possessi<strong>on</strong> or c<strong>on</strong>trol;2. The powers and procedures referred to in this article shall be subject to Articles 14 and 15.3. For the purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> this article, "subscriber informati<strong>on</strong>" means any informati<strong>on</strong>, c<strong>on</strong>tained in theform <str<strong>on</strong>g>of</str<strong>on</strong>g> computer data or any other form, that is held by a service provider, relating to subscribers <str<strong>on</strong>g>of</str<strong>on</strong>g> itsservices, other than traffic or c<strong>on</strong>tent data, by which can be established:a. the type <str<strong>on</strong>g>of</str<strong>on</strong>g> the communicati<strong>on</strong> service used, the technical provisi<strong>on</strong>s taken thereto andthe period <str<strong>on</strong>g>of</str<strong>on</strong>g> service;b. the subscriber’s identity, postal or geographic address, teleph<strong>on</strong>e and other accessnumber, billing and payment informati<strong>on</strong>, available <strong>on</strong> the basis <str<strong>on</strong>g>of</str<strong>on</strong>g> the service agreement orarrangement;c. any other informati<strong>on</strong> <strong>on</strong> the site <str<strong>on</strong>g>of</str<strong>on</strong>g> the installati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> communicati<strong>on</strong> equipment available<strong>on</strong> the basis <str<strong>on</strong>g>of</str<strong>on</strong>g> the service agreement or arrangement.http://c<strong>on</strong>venti<strong>on</strong>s.coe.int/Treaty/en/Treaties/Html/<strong>185</strong>.htm 28.11.2001

Where a Party, due to the established principles <str<strong>on</strong>g>of</str<strong>on</strong>g> its domestic legal system, cannot adopt themeasures referred to in paragraph 1 (a), it may instead adopt legislative and other measures as maybe necessary to ensure the real-time collecti<strong>on</strong> or recording <str<strong>on</strong>g>of</str<strong>on</strong>g> traffic data associated with specifiedcommunicati<strong>on</strong>s in its territory through applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> technical means <strong>on</strong> that territory.3. Each Party shall adopt such legislative and other measures as may be necessary, in relati<strong>on</strong> to arange <str<strong>on</strong>g>of</str<strong>on</strong>g> serious <str<strong>on</strong>g>of</str<strong>on</strong>g>fences to be determined by domestic law, to empower its competent authorities to:a. collect or record through applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> technical means <strong>on</strong> the territory <str<strong>on</strong>g>of</str<strong>on</strong>g> that Party, andb. compel a service provider, within its existing technical capability, to:i. collect or record through applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> technical means <strong>on</strong> the territory <str<strong>on</strong>g>of</str<strong>on</strong>g> thatParty, orii.co-operate and assist the competent authorities in the collecti<strong>on</strong> or recording <str<strong>on</strong>g>of</str<strong>on</strong>g>,c<strong>on</strong>tent data, in real-time, <str<strong>on</strong>g>of</str<strong>on</strong>g> specified communicati<strong>on</strong>s in its territory transmitted bymeans <str<strong>on</strong>g>of</str<strong>on</strong>g> a computer system.2. Each Party shall adopt such measures as may be necessary to establish jurisdicti<strong>on</strong> over the<str<strong>on</strong>g>of</str<strong>on</strong>g>fences referred to in Article 24, paragraph (1) <str<strong>on</strong>g>of</str<strong>on</strong>g> this <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>, in cases where an alleged <str<strong>on</strong>g>of</str<strong>on</strong>g>fenderis present in its territory and it does not extradite him/her to another Party, solely <strong>on</strong> the basis <str<strong>on</strong>g>of</str<strong>on</strong>g>his/her nati<strong>on</strong>ality, after a request for extraditi<strong>on</strong>.4. This <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g> does not exclude any criminal jurisdicti<strong>on</strong> exercised in accordance with domesticlaw.5. When more than <strong>on</strong>e Party claims jurisdicti<strong>on</strong> over an alleged <str<strong>on</strong>g>of</str<strong>on</strong>g>fence established in accordancewith this <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>, the Parties involved shall, where appropriate, c<strong>on</strong>sult with a view to determiningthe most appropriate jurisdicti<strong>on</strong> for prosecuti<strong>on</strong>.Chapter III – Internati<strong>on</strong>al co-operati<strong>on</strong>Secti<strong>on</strong> 1 – General principlesTitle 1 – General principles relating to internati<strong>on</strong>al co-operati<strong>on</strong>Article 23 – General principles relating to internati<strong>on</strong>al co-operati<strong>on</strong>The Parties shall co-operate with each other, in accordance with the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> this chapter, andthrough applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> relevant internati<strong>on</strong>al instruments <strong>on</strong> internati<strong>on</strong>al co-operati<strong>on</strong> in criminalmatters, arrangements agreed <strong>on</strong> the basis <str<strong>on</strong>g>of</str<strong>on</strong>g> uniform or reciprocal legislati<strong>on</strong>, and domestic laws, tothe widest extent possible for the purposes <str<strong>on</strong>g>of</str<strong>on</strong>g> investigati<strong>on</strong>s or proceedings c<strong>on</strong>cerning criminal<str<strong>on</strong>g>of</str<strong>on</strong>g>fences related to computer systems and data, or for the collecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> evidence in electr<strong>on</strong>ic form <str<strong>on</strong>g>of</str<strong>on</strong>g> acriminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fence.Article 24 – Extraditi<strong>on</strong>Title 2 – Principles relating to extraditi<strong>on</strong>1. a. This article applies to extraditi<strong>on</strong> between Parties for the criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fences established inaccordance with Articles 2 – 11 <str<strong>on</strong>g>of</str<strong>on</strong>g> this <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>, provided that they are punishable under the laws <str<strong>on</strong>g>of</str<strong>on</strong>g>both Parties c<strong>on</strong>cerned by deprivati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> liberty for a maximum period <str<strong>on</strong>g>of</str<strong>on</strong>g> at least <strong>on</strong>e year, or by amore severe penalty.b. Where a different minimum penalty is to be applied under an arrangement agreed <strong>on</strong> thebasis <str<strong>on</strong>g>of</str<strong>on</strong>g> uniform or reciprocal legislati<strong>on</strong> or an extraditi<strong>on</strong> treaty, including the <str<strong>on</strong>g>Europe</str<strong>on</strong>g>an <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g> <strong>on</strong>Extraditi<strong>on</strong> (<strong>ETS</strong> <strong>No</strong>. 24), applicable between two or more parties, the minimum penalty provided forunder such arrangement or treaty shall apply.2. The criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fences described in paragraph 1 <str<strong>on</strong>g>of</str<strong>on</strong>g> this Article shall be deemed to be included asextraditable <str<strong>on</strong>g>of</str<strong>on</strong>g>fences in any extraditi<strong>on</strong> treaty existing between or am<strong>on</strong>g the Parties. The Partiesundertake to include such <str<strong>on</strong>g>of</str<strong>on</strong>g>fences as extraditable <str<strong>on</strong>g>of</str<strong>on</strong>g>fences in any extraditi<strong>on</strong> treaty to be c<strong>on</strong>cludedbetween or am<strong>on</strong>g them.3. If extraditi<strong>on</strong> for a criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fence referred to in paragraph 1 <str<strong>on</strong>g>of</str<strong>on</strong>g> this article is refused solely <strong>on</strong> thebasis <str<strong>on</strong>g>of</str<strong>on</strong>g> the nati<strong>on</strong>ality <str<strong>on</strong>g>of</str<strong>on</strong>g> the pers<strong>on</strong> sought, or because the requested Party deems that it hasjurisdicti<strong>on</strong> over the <str<strong>on</strong>g>of</str<strong>on</strong>g>fence, the requested Party shall submit the case at the request <str<strong>on</strong>g>of</str<strong>on</strong>g> the requestingParty to its competent authorities for the purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> prosecuti<strong>on</strong> and shall report the final outcome tothe requesting Party in due course. Those authorities shall take their decisi<strong>on</strong> and c<strong>on</strong>duct theirinvestigati<strong>on</strong>s and proceedings in the same manner as in the case <str<strong>on</strong>g>of</str<strong>on</strong>g> any other <str<strong>on</strong>g>of</str<strong>on</strong>g>fence <str<strong>on</strong>g>of</str<strong>on</strong>g> acomparable nature under the law <str<strong>on</strong>g>of</str<strong>on</strong>g> that Party.7. a. Each Party shall, at the time <str<strong>on</strong>g>of</str<strong>on</strong>g> signature or when depositing its instrument <str<strong>on</strong>g>of</str<strong>on</strong>g> ratificati<strong>on</strong>,acceptance, approval or accessi<strong>on</strong>, communicate to the Secretary General <str<strong>on</strong>g>of</str<strong>on</strong>g> the <str<strong>on</strong>g>Council</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Europe</str<strong>on</strong>g>the name and addresses <str<strong>on</strong>g>of</str<strong>on</strong>g> each authority resp<strong>on</strong>sible for the making to or receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> a request forextraditi<strong>on</strong> or provisi<strong>on</strong>al arrest in the absence <str<strong>on</strong>g>of</str<strong>on</strong>g> a treaty.b. Each Party shall ensure that the details held <strong>on</strong> the registerare correct at all times.Title 3 – General principles relating to mutual assistanceArticle 25 – General principles relating to mutual assistance1. The Parties shall afford <strong>on</strong>e another mutual assistance to the widest extent possible for the purpose<str<strong>on</strong>g>of</str<strong>on</strong>g> investigati<strong>on</strong>s or proceedings c<strong>on</strong>cerning criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fences related to computer systems and data,or for the collecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> evidence in electr<strong>on</strong>ic form <str<strong>on</strong>g>of</str<strong>on</strong>g> a criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fence.2. Each Party shall also adopt such legislative and other measures as may be necessary to carry outthe obligati<strong>on</strong>s set forth in Articles 27 - 35.3. Each Party may, in urgent circumstances, make requests for mutual assistance orcommunicati<strong>on</strong>s related thereto by expedited means <str<strong>on</strong>g>of</str<strong>on</strong>g> communicati<strong>on</strong>s, including fax or e-mail, tothe extent that such means provide appropriate levels <str<strong>on</strong>g>of</str<strong>on</strong>g> security and authenticati<strong>on</strong> (including the use<str<strong>on</strong>g>of</str<strong>on</strong>g> encrypti<strong>on</strong>, where necessary), with formal c<strong>on</strong>firmati<strong>on</strong> to follow, where required by the requestedParty. The requested Party shall accept and resp<strong>on</strong>d to the request by any such expedited means <str<strong>on</strong>g>of</str<strong>on</strong>g>communicati<strong>on</strong>.4. Except as otherwise specifically provided in Articles in this Chapter, mutual assistance shall besubject to the c<strong>on</strong>diti<strong>on</strong>s provided for by the law <str<strong>on</strong>g>of</str<strong>on</strong>g> the requested Party or by applicable mutualassistance treaties, including the grounds <strong>on</strong> which the requested Party may refuse co-operati<strong>on</strong>. Therequested Party shall not exercise the right to refuse mutual assistance in relati<strong>on</strong> to the <str<strong>on</strong>g>of</str<strong>on</strong>g>fencesreferred to in Articles 2 to 11 solely <strong>on</strong> the ground that the request c<strong>on</strong>cerns an <str<strong>on</strong>g>of</str<strong>on</strong>g>fence which itc<strong>on</strong>siders a fiscal <str<strong>on</strong>g>of</str<strong>on</strong>g>fence.5. A Party may, within the limits <str<strong>on</strong>g>of</str<strong>on</strong>g> its domestic law, without prior request, forward to another Partyinformati<strong>on</strong> obtained within the framework <str<strong>on</strong>g>of</str<strong>on</strong>g> its own investigati<strong>on</strong>s when it c<strong>on</strong>siders that thedisclosure <str<strong>on</strong>g>of</str<strong>on</strong>g> such informati<strong>on</strong> might assist the receiving Party in initiating or carrying outinvestigati<strong>on</strong>s or proceedings c<strong>on</strong>cerning criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fences established in accordance with this<str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g> or might lead to a request for co-operati<strong>on</strong> by that Party under this chapter.2. Prior to providing such informati<strong>on</strong>, the providing Party may request that it be kept c<strong>on</strong>fidential orused subject to c<strong>on</strong>diti<strong>on</strong>s. If the receiving Party cannot comply with such request, it shall notify theproviding Party, which shall then determine whether the informati<strong>on</strong> should nevertheless be provided. Ifthe receiving Party accepts the informati<strong>on</strong> subject to the c<strong>on</strong>diti<strong>on</strong>s, it shall be bound by them.Title 4 – Procedures pertaining to mutual assistance requestsin the absence <str<strong>on</strong>g>of</str<strong>on</strong>g> applicable internati<strong>on</strong>al agreementsArticle 27 – Procedures pertaining to mutual assistance requests in the absence <str<strong>on</strong>g>of</str<strong>on</strong>g> applicableinternati<strong>on</strong>al agreements1. Where there is no mutual assistance treaty or arrangement <strong>on</strong> the basis <str<strong>on</strong>g>of</str<strong>on</strong>g> uniform or reciprocallegislati<strong>on</strong> in force between the requesting and requested Parties, the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> paragraphs 2through 9 <str<strong>on</strong>g>of</str<strong>on</strong>g> this article shall apply. The provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> this article shall not apply where such treaty,arrangement or legislati<strong>on</strong> is available, unless the Parties c<strong>on</strong>cerned agree to apply any or all <str<strong>on</strong>g>of</str<strong>on</strong>g> theremainder <str<strong>on</strong>g>of</str<strong>on</strong>g> this article in lieu there<str<strong>on</strong>g>of</str<strong>on</strong>g>.2. a. Each Party shall designate a central authority or authorities that shall be resp<strong>on</strong>sible forsending and answering requests for mutual assistance, the executi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> such requests, or thetransmissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> them to the authorities competent for their executi<strong>on</strong>.b. The central authorities shall communicate directly with each other.c. Each Party shall ensure that the details held <strong>on</strong> theregister are correct at all times.3. Mutual assistance requests under this Article shall be executed in accordance with the proceduresspecified by the requesting Party except where incompatible with the law <str<strong>on</strong>g>of</str<strong>on</strong>g> the requested Party.4. The requested Party may, in additi<strong>on</strong> to grounds for refusal available under Article 25, paragraph (4),refuse assistance if:a. the request c<strong>on</strong>cerns an <str<strong>on</strong>g>of</str<strong>on</strong>g>fence which the requested Party c<strong>on</strong>siders a political <str<strong>on</strong>g>of</str<strong>on</strong>g>fence oran <str<strong>on</strong>g>of</str<strong>on</strong>g>fence c<strong>on</strong>nected with a political <str<strong>on</strong>g>of</str<strong>on</strong>g>fence; orb. it c<strong>on</strong>siders that executi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the request is likely to prejudice its sovereignty, security, ordrepublic or other essential interests.5. Up<strong>on</strong> receiving the request from another Party, the requested Party shall take all appropriatemeasures to preserve expeditiously the specified data in accordance with its domestic law. For thepurposes <str<strong>on</strong>g>of</str<strong>on</strong>g> resp<strong>on</strong>ding to a request, dual criminality shall not be required as a c<strong>on</strong>diti<strong>on</strong> to providingsuch preservati<strong>on</strong>.4. A Party that requires dual criminality as a c<strong>on</strong>diti<strong>on</strong> for resp<strong>on</strong>ding to a request for mutualassistance for the search or similar access, seizure or similar securing, or disclosure <str<strong>on</strong>g>of</str<strong>on</strong>g> the data may,in respect <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>fences other than those established in accordance with Articles 2 – 11 <str<strong>on</strong>g>of</str<strong>on</strong>g> this<str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>, reserve the right to refuse the request for preservati<strong>on</strong> under this article in cases where ithas reas<strong>on</strong> to believe that at the time <str<strong>on</strong>g>of</str<strong>on</strong>g> disclosure the c<strong>on</strong>diti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> dual criminality cannot be fulfilled.5. A Party may request another Party to search or similarly access, seize or similarly secure, anddisclose data stored by means <str<strong>on</strong>g>of</str<strong>on</strong>g> a computer system located within the territory <str<strong>on</strong>g>of</str<strong>on</strong>g> the requestedParty, including data that has been preserved pursuant to Article 29.2. The requested Party shall resp<strong>on</strong>d to the request through applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> internati<strong>on</strong>al instruments,arrangements and laws referred to in Article 23, and in accordance with other relevant provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g>this Chapter.3. The request shall be resp<strong>on</strong>ded to <strong>on</strong> an expedited basis where:a. there are grounds to believe that relevant data is particularly vulnerable to loss ormodificati<strong>on</strong>; orb. the instruments, arrangements and laws referred to in paragraph 2 otherwise provide forexpedited co-operati<strong>on</strong>.Article 32 – Trans-border access to stored computer data with c<strong>on</strong>sent or where publiclyavailableA Party may, without obtaining the authorisati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> another Party:a. access publicly available (open source) stored computer data, regardless <str<strong>on</strong>g>of</str<strong>on</strong>g> where the datais located geographically; orb. access or receive, through a computer system in its territory, stored computer data locatedin another Party, if the Party obtains the lawful and voluntary c<strong>on</strong>sent <str<strong>on</strong>g>of</str<strong>on</strong>g> the pers<strong>on</strong> who has thelawful authority to disclose the data to the Party through that computer system.Article 33 – Mutual assistance regarding the real-time collecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> traffic data1. The Parties shall provide mutual assistance to each other with respect to the real-time collecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g>traffic data associated with specified communicati<strong>on</strong>s in its territory transmitted by means <str<strong>on</strong>g>of</str<strong>on</strong>g> acomputer system. Each Party shall designate a point <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>tact available <strong>on</strong> a 24 hour, 7 day per week basis in orderto ensure the provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> immediate assistance for the purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> investigati<strong>on</strong>s or proceedingsc<strong>on</strong>cerning criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fences related to computer systems and data, or for the collecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> evidence inelectr<strong>on</strong>ic form <str<strong>on</strong>g>of</str<strong>on</strong>g> a criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fence. Such assistance shall include facilitating, or, if permitted by itsdomestic law and practice, directly carrying out:a. provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> technical advice;b. preservati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> data pursuant to Articles 29 and 30; andc. collecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> evidence, giving <str<strong>on</strong>g>of</str<strong>on</strong>g> legal informati<strong>on</strong>, and locating <str<strong>on</strong>g>of</str<strong>on</strong>g> suspects.2. a. A Party’s point <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>tact shall have the capacity to carry out communicati<strong>on</strong>s with the point<str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>tact <str<strong>on</strong>g>of</str<strong>on</strong>g> another Party <strong>on</strong> an expedited basis.b. If the point <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>tact designated by a Party is not part <str<strong>on</strong>g>of</str<strong>on</strong>g> that Party’s authority or authoritiesresp<strong>on</strong>sible for internati<strong>on</strong>al mutual assistance or extraditi<strong>on</strong>, the point <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>tact shall ensure that itis able to co-ordinate with such authority or authorities <strong>on</strong> an expedited basis.3. Each Party shall ensure that trained and equipped pers<strong>on</strong>nel are available in order to facilitate theoperati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the network.Chapter IV – Final provisi<strong>on</strong>sArticle 36 – Signature and entry into force1. This <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g> shall be open for signature by the member States <str<strong>on</strong>g>of</str<strong>on</strong>g> the <str<strong>on</strong>g>Council</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Europe</str<strong>on</strong>g> and byn<strong>on</strong>-member States which have participated in its elaborati<strong>on</strong>.2. This <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g> is subject to ratificati<strong>on</strong>, acceptance or approval. Instruments <str<strong>on</strong>g>of</str<strong>on</strong>g> ratificati<strong>on</strong>,acceptance or approval shall be deposited with the Secretary General <str<strong>on</strong>g>of</str<strong>on</strong>g> the <str<strong>on</strong>g>Council</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Europe</str<strong>on</strong>g>.3. This <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g> shall enter into force <strong>on</strong> the first day <str<strong>on</strong>g>of</str<strong>on</strong>g> the m<strong>on</strong>th following the expirati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> aperiod <str<strong>on</strong>g>of</str<strong>on</strong>g> three m<strong>on</strong>ths after the date <strong>on</strong> which five States, including at least three member States <str<strong>on</strong>g>of</str<strong>on</strong>g>the <str<strong>on</strong>g>Council</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Europe</str<strong>on</strong>g>, have expressed their c<strong>on</strong>sent to be bound by the <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g> in accordancewith the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> paragraphs 1 and 2.4. If two or more Parties have already c<strong>on</strong>cluded an agreement or treaty <strong>on</strong> the matters dealt with inthis <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g> or otherwise have established their relati<strong>on</strong>s <strong>on</strong> such matters, or should they in futuredo so, they shall also be entitled to apply that agreement or treaty or to regulate those relati<strong>on</strong>saccordingly. A federal State may reserve the right to assume obligati<strong>on</strong>s under Chapter II <str<strong>on</strong>g>of</str<strong>on</strong>g> this <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>c<strong>on</strong>sistent with its fundamental principles governing the relati<strong>on</strong>ship between its central governmentand c<strong>on</strong>stituent States or other similar territorial entities provided that it is still able to co-operateunder Chapter III.2. When making a reservati<strong>on</strong> under paragraph 1, a federal State may not apply the terms <str<strong>on</strong>g>of</str<strong>on</strong>g> suchreservati<strong>on</strong> to exclude or substantially diminish its obligati<strong>on</strong>s to provide for measures set forth inChapter II. Overall, it shall provide for a broad and effective law enforcement capability with respect tothose measures.3. A Party that has made a reservati<strong>on</strong> in accordance with Article 42 may wholly or partially withdrawit by means <str<strong>on</strong>g>of</str<strong>on</strong>g> a notificati<strong>on</strong> addressed to the Secretary General. Such withdrawal shall take effect <strong>on</strong>the date <str<strong>on</strong>g>of</str<strong>on</strong>g> receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> such notificati<strong>on</strong> by the Secretary General. If the notificati<strong>on</strong> states that thewithdrawal <str<strong>on</strong>g>of</str<strong>on</strong>g> a reservati<strong>on</strong> is to take effect <strong>on</strong> a date specified therein, and such date is later than thedate <strong>on</strong> which the notificati<strong>on</strong> is received by the Secretary General, the withdrawal shall take effect <strong>on</strong>such a later date.2. The <str<strong>on</strong>g>Europe</str<strong>on</strong>g>an Committee <strong>on</strong> Crime Problems (CDPC) shall be kept informed regarding theinterpretati<strong>on</strong> and applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>.2. In case <str<strong>on</strong>g>of</str<strong>on</strong>g> a dispute between Parties as to the interpretati<strong>on</strong> or applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>, theyshall seek a settlement <str<strong>on</strong>g>of</str<strong>on</strong>g> the dispute through negotiati<strong>on</strong> or any other peaceful means <str<strong>on</strong>g>of</str<strong>on</strong>g> their choice,including submissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the dispute to the <str<strong>on</strong>g>Europe</str<strong>on</strong>g>an Committee <strong>on</strong> Crime Problems (CDPC), to anarbitral tribunal whose decisi<strong>on</strong>s shall be binding up<strong>on</strong> the Parties, or to the Internati<strong>on</strong>al Court <str<strong>on</strong>g>of</str<strong>on</strong>g>Justice, as agreed up<strong>on</strong> by the Parties c<strong>on</strong>cerned.Article 46 – C<strong>on</strong>sultati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the Parties1. The Parties shall, as appropriate, c<strong>on</strong>sult periodically with a view to facilitating:a. the effective use and implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>, including the identificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> anyproblems there<str<strong>on</strong>g>of</str<strong>on</strong>g>, as well as the effects <str<strong>on</strong>g>of</str<strong>on</strong>g> any declarati<strong>on</strong> or reservati<strong>on</strong> made under this<str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>;b. the exchange <str<strong>on</strong>g>of</str<strong>on</strong>g> informati<strong>on</strong> <strong>on</strong> significant legal, policy or technological developmentspertaining to cybercrime and the collecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> evidence in electr<strong>on</strong>ic form;c. c<strong>on</strong>siderati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> possible supplementati<strong>on</strong> or amendment <str<strong>on</strong>g>of</str<strong>on</strong>g> the <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>.2. The <str<strong>on</strong>g>Europe</str<strong>on</strong>g>an Committee <strong>on</strong> Crime Problems (CDPC) shall be kept periodically informed regardingthe result <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>sultati<strong>on</strong>s referred to in paragraph 1.3. The <str<strong>on</strong>g>Europe</str<strong>on</strong>g>an Committee <strong>on</strong> Crime Problems (CDPC) shall, as appropriate, facilitate thec<strong>on</strong>sultati<strong>on</strong>s referred to in paragraph 1 and take the measures necessary to assist the Parties in theirefforts to supplement or amend the <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>. At the latest three years after the present <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>enters into force, the <str<strong>on</strong>g>Europe</str<strong>on</strong>g>an Committee <strong>on</strong> Crime Problems (CDPC) shall, in co-operati<strong>on</strong> with theParties, c<strong>on</strong>duct a review <str<strong>on</strong>g>of</str<strong>on</strong>g> all <str<strong>on</strong>g>of</str<strong>on</strong>g> the <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>’s provisi<strong>on</strong>s and, if necessary, recommend anyappropriate amendments.4. Except where assumed by the <str<strong>on</strong>g>Council</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Europe</str<strong>on</strong>g>, expenses incurred in carrying out the provisi<strong>on</strong>s<str<strong>on</strong>g>of</str<strong>on</strong>g> paragraph 1 shall be borne by the Parties in the manner to be determined by them.5.
