1.29 “Permit” defined. A Permit is the initial written approval by the Health Authority to design,construct, <strong>and</strong> operate a facility under the provisions of these <strong>Regulations</strong>, <strong>and</strong> is separatefrom any other licensing <strong>and</strong>/or permitting requirements of other agencies of jurisdiction thatmay exist within political subdivisions where the facility is located.1.30 “Permit revocation” defined. Permit revocation occurs when the Health Authorityrevokes all permission to operate a facility due to the presence of significant health, safety, <strong>and</strong>environmental hazards; <strong>and</strong>/or repeated failure to comply with applicable laws <strong>and</strong> regulations.Upon receipt of the revocation Order, the facility must cease immediately all operations at allwork sites operated under the Permit. Revocations are intended to result in permanent closureof the facility. The facility may seek relief through the appeal process outlined in these<strong>Regulations</strong>.1.31 “Permit suspension” defined. Permit suspension occurs when the Health Authoritysuspends all permission to operate a facility due to the presence of significant health, safety,environmental hazards, <strong>and</strong>/or failure to comply with applicable laws <strong>and</strong> regulations that arefacility wide or are of such severity as to cause an imminent hazard to the health <strong>and</strong> safety ofthe public <strong>and</strong> employees. Suspensions may lead to eventual Permit Revocation. The facilitymay seek relief through the appeal process outlined in these <strong>Regulations</strong>.1.32 “Person” defined. Person includes any state or federal agency; any state, including theState of Nevada; a political subdivision of any state; an interstate agency or organization; anyfirm, partnership, corporation, or Limited Liability Company (LLC) meeting all legalrequirements of the State of Nevada; or a natural person.1.33 “Putrescible” defined. Putrescible means capable of being decomposed bymicroorganisms with sufficient rapidity as to cause nuisances from odors or gases.1.34 “Refurbish” defined. “Refurbish” means to make clean or useable again; to restore to anearlier state by repairing, renovating, or remodeling. Mattress refurbishment uses an innerspring assembly from a used mattress wherein the inner spring assembly has been stripped ofits outer covering of ticking <strong>and</strong> some or all of the padding material <strong>and</strong> covered with newticking <strong>and</strong> had any missing padding material replaced. Prior to refurbishment <strong>and</strong> heat orother approved sanitization treatment, the used inner spring assembly has any bent or missingborder wires <strong>and</strong> connecting wires straightened or replaced, displaced components returned totheir proper position, <strong>and</strong> any damaged components replaced with good quality new or usedreplacement components resulting in a similar inner spring assembly structure as to when theassembly was new.1.35 “Responsible person” defined. A responsible person is the person or persons, whoown(s), manage(s), lease(s), or act(s) as the primary point of contact or otherwise controls theconstruction, remodeling, operation or maintenance of a bedding renovation <strong>and</strong>/or sanitizationfacility. The responsible person may be the owner or operator.1.36 “Retailer” defined. A retailer is a person who sells any article of upholstered furniture orbedding or filling materials to a consumer or user of the article as purchased.1.37 “Sanitization facility” defined. A sanitization facility is a location where articles ofbedding, furniture, upholstery, or filling materials <strong>and</strong> similar items are sanitized.- 4 -
