<strong>Care</strong> <strong>and</strong> <strong>Shelter</strong> Function<strong>and</strong> Legal M<strong>and</strong>atesSection1The function of care <strong>and</strong> shelter is to provide temporary emergency relief to disastervictims. Providing temporary emergency relief involves a range of emergency humanservices (e.g., food, shelter, health care, mental health support, etc.). In doing so the<strong>Care</strong> <strong>and</strong> <strong>Shelter</strong> Branch of the City <strong>and</strong>/or County <strong>Emergency</strong> Operations Center(EOC) must prepare themselves to meet the needs of events such as thoseexperienced as a result of 9-11 <strong>and</strong> Hurricane Katrina when care <strong>and</strong> sheltering mustgo beyond st<strong>and</strong>ard government resources <strong>and</strong> embrace the commitment of otherpublic <strong>and</strong> community partners to meet the need of massive care <strong>and</strong> shelter <strong>for</strong> ourcommunity <strong>and</strong> mutual aid m<strong>and</strong>ates.Legal Requirements <strong>for</strong> Local GovernmentCali<strong>for</strong>nia law sets the responsibility <strong>for</strong> emergency care <strong>and</strong> shelter at the local level.As per the Health <strong>and</strong> Safety Code Section 34070 – 34072, local government is toprovide or contract with recognized community organizations to make emergency ortemporary shelter available <strong>for</strong> people made homeless by a natural disaster or otheremergency. Cali<strong>for</strong>nia’s State <strong>Emergency</strong> Plan <strong>and</strong> St<strong>and</strong>ardized <strong>Emergency</strong>Management System (SEMS) puts local government at the first level of response <strong>for</strong>meeting the disaster needs of people in its jurisdiction. People seeking care <strong>and</strong> shelterimmediately after a disaster will look first to local government <strong>for</strong> assistance.Red Cross <strong>and</strong> Local Government RolesThe Red Cross is a partner with local government in helping to fulfill government’s legalresponsibility of providing care <strong>and</strong> shelter <strong>for</strong> its citizens in a disaster. The partnershiprequires that local government <strong>and</strong> the Red Cross work cooperatively during thepreparedness phase to clarify roles <strong>and</strong> responsibilities (as outlined below). The localjurisdiction may also work in cooperation with other volunteer disaster assistanceorganizations to provide disaster relief. In a major disaster where there is widespreaddamage, the national resources of the Red Cross may not fully mobilize until five daysafter the event.
