MESSAGE FROM THE PRINCIPALWELCOME!!On behalf of the U.S.D. #<strong>416</strong> Board of Education, Superintendent, and U.S.D. #<strong>416</strong> staff, I wouldlike to extend a cordial welcome to all the students. We have made every effort to provide you with thebest possible educational opportunities. The patrons of U.S.D. #<strong>416</strong> have provided outstanding facilities.In addition to regular classroom teachers, students will receive instruction in Physical Education,Vocal Music, Computers, Art, and Library on a rotating schedule. For students who qualify for help inreading, U.S.D. #<strong>416</strong> has a Title I Reading teacher. Special education teachers are available at all levelsto provide for the special needs of students. Students who have accelerated abilities may qualify forservices from our teacher of gifted education. Our staff also includes a registered nurse, schoolpsychologist, occupational therapist, speech therapist, and social worker. We are providing you with ahighly qualified, competent staff; so the rest is up to you. With a quality staff like ours, super parents likeyours, and kids that are #1, we are looking forward to a great year. Parents have many options on how to stay current with RES school events. The RES office sendsout weekly announcements via email. Parents also have the option to sign up for the Parent Portalwhere student attendance, grades, and lunch balance may be checked. These can all be accessedvia the <strong>USD</strong><strong>416</strong> web site @ www.usd<strong>416</strong>.org. For further information, please contact the RESoffice at (913)837-1970.INCLEMENT WEATHERIn the event of a school closing, due to ice or snow, all Kansas City TV Stations are notifiedof the school closing. Please watch these channels for that information. <strong>USD</strong> <strong>416</strong> will also send outalerts via Alert Now notifying of school closings.FIRE DRILL EVACUATION FOR OCCUPANTS WITH DISABILITIESThe teacher in each classroom is responsible for the proper building evacuation of everystudent in their classroom, including handicapped students, whether the handicap be one ofmobility, vision, hearing, impaired cognitive functioning, or any other impairment.Teachers will be responsible for assisting with any evacuation to the area designated in thestudent handbook and posted in every classroom.TORNADOPlease read the following procedure carefully and discuss it with your child. When thesignal occurs, students are to move quickly and orderly to their respective shelter area. Allteachers are to assist in maintaining order to the area and also in arranging them in the shelter.Students should sit on the floor and complete silence must be maintained in order for them to heardirections.In the event a tornado should strike our school, and students and staff are unable to get tothe shelter area, seek an area such as restrooms or storage rooms. Do not seek shelter in the gym orcommons area. Avoid areas that have glass and stay away from doors. Sit with your back to a wallor under furniture if possible. Cover your face and head with your arms.As soon as students are in their shelter area, teachers must account for each studentassigned to them. Teachers should take a class list with them to the shelter.Our school is equipped with an emergency lighting system, but it would be wise to bringyour own flashlight. Students and teachers who are outside and unable to reach the shelter of thebuilding should take cover in a ditch or low lying area. Lie face down covering your head with yourarms.Students are not to be released from the shelter area unless parents come to the shelter areato pick them up, and only then, if you personally see the parent. Everyone must remain in theshelter area until the all clear is sounded. The principal or his/her assistant will dismiss you fromthe shelter when it is safe.Please read and re-read the above instructions. Be sure your students understand them.You probably need to visit with the younger children about tornado drills several times.In the event of a serious storm, our responsibility is an awesome one. As the tornado seasonapproaches, please be aware of that responsibility.CRISIS MANAGEMENT AND RESPONSEYour child will be given information in what to do in a crisis situation. These crises includetornado, fire, building intruder, and bomb threats. Our first priority is to protect the safety andsecurity of your children. As parents, we ask that you remain calm and be assured that the detailsof these plans have been planned with our first priority in mind.LIBRARYPage 5


Students are scheduled for routine weekly as well as extra “as needed” visits to the wellstocked, automated library media center. The library coordinates the Accelerated Readercomputerized reading motivation and comprehension program.SCHEDULESThe front doors at <strong>Rockville</strong> are opened at 7:40 AM daily. The school day begins at 8:10 AMwith dismissal at 3:20 PM. Individual class schedules can be obtained from the classroom teacher.MORNING DROP OFFAt <strong>Rockville</strong>, we ask that students who do not ride a bus and are being brought to school usethe valet drop off line in the morning. School personnel will open the passenger’s side door andhelp students out of the vehicle. Adults are stationed throughout the building to help directstudents to the correct locations.DISMISSAL PROCEDURESFor the <strong>2013</strong>-20<strong>14</strong> school year students who do not ride the bus and will be picked up afterschool will meet parents outside the building. To help pull traffic off of <strong>Rockville</strong>, and the numberof students we are responsible for there will be 2 pick-up locations.If your child’s last name begins with the letter A-L :They will be dismissed out the front doors with adult supervision.Parents should wait outside near the circle planter located to the right of the front doors.Please park in the front parking lot and walk up to get your child.We will not send any child unsupervised to the parking lot.Parking will not be permitted in the circle drive located in front of the school.If your child’s last name begins with the letter M-Z : They will be dismissed out the doors that open to the Court Yard located by the playgroundwith adult supervision. Parents should wait outside near the picnic tables. Please park in the back parking lot and walk up to get your child. We will not send any child unsupervised to the parking lot. Parking in this area will be permitted after 3:05 when all students are back in the buildingfrom recess.Students who walk or ride their bike to school will meet an adult near the office and be escortedacross 10 th and <strong>Rockville</strong> at the cross walk.TARDIESStudents not in class at this time are considered tardy and need to report to the office for apermit to class. Students who leave early before dismissal are also counted as tardy.ABSENTEEISMPage 6


Parents and/or guardians are requested to inform the school of their child’s pendingabsence. Call the office at (913)837-1970. Without parent notification, the absence will beconsidered unexcused. Students with 3 or more consecutive absences will need to furnish adoctor’s note upon returning to school.VISITOR/ Volunteer POLICYAfter 8:10 AM, the front doors are the only doors unlocked at RES throughout the schoolday. To enter the building, visitors must report to the office, sign in and get a visitors badge. Allvisitors are asked to keep the badge on and visible while in the building. When a visitor is ready toleave they need to report back to the office sign out and return the visitors badge.ATTENDANCE POLICY – COMPULSORY ATTENDANCEThe compulsory attendance law makes it mandatory that any child who has reached the ageof six years and is under the age of eighteen years may be enrolled in school. The law makesexceptions for children who are physically or mentally incapacitated. Any child not satisfying therequirements of the compulsory attendance law, being absent from school three consecutive daysof 5 or more in any semester, is a “truant”.All students are expected to attend school regularly and to report to each class on time.Absences of students must be explained by parents or guardians when the student returns toschool. Before a student is admitted to class after being tardy or absent, he/she must get an admitslip from the office. In known cases of truancy, the Principal will notify the SRS office. Truancy isdefined as missing school three successive days or more without a legitimate excuse, or truancycharge may be brought against a student for five unexcused absences that are not consecutive.This may also be reported to the County Attorney’s office.ABSENCES AND EXCUSESThe building principal or their designated representative shall be responsible fordetermining if an absence is excused or unexcused. The following criteria shall be used in makingthe determination:I. Excused AbsencesA. Illness with a parents verification, verification by the school nurse, andmedical or dental appointments.B. School sponsored activities such as athletics, music, etc.C. Pre-arranged approved absences by parents for funerals, family business,take your child to work, etc. (Contact should be made with theadministration at least 24 hours prior to the event)D. Educational experience approved by the principal.E. Church activities.If a child leaves school for the above, it is counted as an absence and will affect perfect attendance.This is school board policy.PERFECT ATTENDANCEA student must be neither absent nor tardy from any class for the entire school year. Theonly exception being when the student is required by law to appear in court as a witness to testifywhen he/she is not involved in a violation of the law.EXCEPTIONAL ATTENDANCEA student who misses not more than one day of school has exceptional attendance.FERPA INFORMATION TO PARENTSPage 7


The Family Educational Rights and Privacy Act is the federal law which limits disclosure ofstudent records to third parties and guarantees that parents of students under the age of 18, andstudents over the age of 18 have access to, the ability to challenge the accuracy of their educationalrecords. The Family Educational Rights and Privacy Act is frequently referred to as it acronym,FERPA, and is also called the Buckley Amendment.FERPA gives parents of students the right to: (1) receive notice of rights under FERPA; (2)inspect and review educational records; (3) request amendment of and to challenge the accuracy ofeducational records; (4) prevent disclosure of educational records; and (5) file a complaint with theFERPA office of the U.S. Department of Education.SUSPENSION AND EXPULSIONThe principal has the authority to suspend from school any pupil who has become a seriousdetrimental influence on the conduct of other pupils and on the morale of the school. Suspensionis usually administered as a last resort when the students problem has not been solved by the useof other means such as guidance and discipline. Cases of suspension will be reported immediatelyin writing to the parents and the Superintendant of Schools. All suspensions shall not extendbeyond 5 days.Expulsion from school may be used as a means of pupil control if necessary and approvedby the Superintendant of Schools.Most suspensions in our school will be in-school suspension; however, in extreme cases itmay be necessary to suspend a student from school.KANSAS SCHOOL SAFETY AND SECURITY ACT72-89b01. Citation of act. This act shall be known and may be cited as the Kansasschool safety and security act.72-89b02. Definitions. As used in this act:(a) "Board of education" means the board of education of a unified school district or thegoverning authority of an accredited nonpublic school.(b) "School" means a public school or an accredited nonpublic school.(c) "Public school" means a school operated by a unified school district organized under thelaws of this state.(d) "Accredited nonpublic school" means a nonpublic school participating in the qualityperformance accreditation system.(e) "School employee" means any administrative, professional or paraprofessional employee ofa school.(f) "Superintendent of schools" means the superintendent of schools appointed by the board ofeducation of a unified school district or the chief administrative officer of an accredited nonpublicschool appointed by the board of education of the school.72-89b03. Information regarding identity of specified pupils, disclosurerequirements; criminal acts, reports to law enforcement agencies and state board ofeducation; school safety and security policies, availability; civil liability, immunity.(a) If a school employee has information that a pupil is a pupil to whom the provisions of thissubsection apply, the school employee shall report such information and identify the pupil to thesuperintendent of schools. The superintendent of schools shall investigate the matter and, upondetermining that the identified pupil is a pupil to whom the provisions of this subsection apply,Page 8


shall provide the reported information and identify the pupil to all school employees who aredirectly involved or likely to be directly involved in teaching or providing other school relatedservices to the pupil. The provisions of this subsection apply to:(1) Any pupil who has been expelled for the reason provided by subsection (c) of K.S.A. 72-8901, and amendments thereto, for conduct which endangers the safety of others;(2) any pupil who has been expelled for the reason provided by subsection (d) of K.S.A. 72-8901, and amendments thereto;(3) any pupil who has been expelled under a policy adopted pursuant to K.S.A. 72-89a02, andamendments thereto;(4) any pupil who has been adjudged to be a juvenile offender and whose offense, if committedby an adult, would constitute a felony under the laws of Kansas or the state where the offense wascommitted, except any pupil adjudicated as a juvenile offender for a felony theft offense involvingno direct threat to human life; and(5) any pupil who has been tried and convicted as an adult of any felony, except any pupilconvicted of a felony theft crime involving no direct threat to human life.A school employee and the superintendent of schools shall not be required to reportinformation concerning a pupil specified in this subsection if the expulsion, adjudication as ajuvenile offender or conviction of a felony occurred more than 365 days prior to the schoolemployee's report to the superintendent of schools.(b) Each board of education shall adopt a policy that includes:(1) A requirement that an immediate report be made to the appropriate state or local lawenforcement agency by or on behalf of any school employee who knows or has reason to believethat an act has been committed at school, on school property, or at a school supervised activity andthat the act involved conduct which constitutes the commission of a felony or misdemeanor orwhich involves the possession, use or disposal of explosives, firearms or other weapons; and(2) The procedures for making such a report.(c) School employees shall not be subject to the provisions of subsection (b) of K.S.A. 72-89b04 and amendments thereto if:(1) They follow the procedures from a policy adopted pursuant to the provisions of subsection(b); or(2) Their board of education fails to adopt such policy.(d) Each board of education shall annually compile and report to the state board of educationat least the following information relating to school safety and security: The types and frequency ofcriminal acts that are required to be reported pursuant to the provisions of subsection (b),disaggregated by occurrences at school, on school property and at school supervised activities. Thereport shall be incorporated into and become part of the current report required under the qualityperformance accreditation system.(e) Each board of education shall make available to pupils and their parents, to schoolemployees and, upon request, to others, district policies and reports concerning school safety andPage 9


security, except that the provisions of this subsection shall not apply to reports made by asuperintendent of schools and school employees pursuant to subsection (a).(f) Nothing in this section shall be construed or operate in any manner so as to prevent anyschool employee from reporting criminal acts to school officials and to appropriate state and locallaw enforcement agencies.(g) The state board of education shall extract the information relating to school safety andsecurity from the quality performance accreditation report and transmit the information to thegovernor, the legislature, the attorney general, the secretary of health and environment, thesecretary of social and rehabilitation services and the commissioner of juvenile justice.(h) No board of education, member of any such board, superintendent of schools or schoolemployee shall be liable for damages in a civil action resulting from a person's good faith acts oromissions in complying with the requirements or provisions of the Kansas school safety andsecurity act.72-89b04. Penalties for failure to make reports, preventing or interferingwith reports; sanctions for making reports prohibited; immunity from liability. (a)Willful and knowing failure of a school employee to make a report required by subsection (b)(1) ofK.S.A. 72-89b03, and amendments thereto, is a class B nonperson misdemeanor. Preventing orinterfering with, with the intent to prevent, the making of a report required by subsection (b)(1) ofK.S.A. 72-89b03, and amendments thereto, is a class B nonperson misdemeanor.(b) Willful and knowing failure of any employee designated by a board of education totransmit reports made by school employees to the appropriate state or local law enforcementagency as required by subsection (b)(1) of K.S.A. 72-89b03, and amendments thereto, is a class Bnonperson misdemeanor. Preventing or interfering with, with the intent to prevent, thetransmission of reports required by subsection (b)(1) of K.S.A. 72-89b03, and amendmentsthereto, is a class B nonperson misdemeanor.(c) No board of education shall terminate the employment of, or prevent or impair theprofession of, or impose any other sanction on any school employee because the employee made anoral or written report to, or cooperated with an investigation by, a law enforcement agency relatingto any criminal act that the employee knows has been committed or reasonably believes will becommitted at school, on school property, or at a school supervised activity.(d) Any board of education, and any member or employee thereof, participating withoutmalice in the making of an oral or written report to a law enforcement agency relating to anycriminal act that is known to have been committed or reasonably is believed will be committed atschool, on school property, or at a school supervised activity shall have immunity from any civilliability that might otherwise be incurred or imposed. Any such participant shall have the sameimmunity with respect to participation in any judicial proceedings resulting from the report.STUDENT RIGHTS AND RESPONSIBILITIESAll students who attend <strong>Rockville</strong> <strong>Elementary</strong> School have the right:1. To attend school so long as they assume the responsibility not to infringe uponthe rights of others.2. To receive this handbook setting forth the major rules and regulations to whichstudents are subject.Page 10


3. To have in the classroom an atmosphere conductive to a good learning climateand to participate in school curriculum.4. To participate with teachers and administrators in recommending school policiesand curriculum.5. To safety and security to person and property.6. To protection when being questioned on school property by a law enforcementofficer.7. To a conference in matters of discipline and behavior during a short termsuspension or to a fair hearing before final action is taken on extended suspensionor expulsion.GAMES AND TOYSStudents are reminded that everything has its place, and school is not the place for games,electronic games and devices, cards, cameras, water guns, etc. Any exceptions to this rule must becleared through the Principal’s office. Skateboards are not allowed at school and skateboarding isnot permitted on school grounds. The school is not responsible for lost, damaged, or stolenpersonal items.SCHOOL DISCIPLINEStudents attending <strong>Rockville</strong> <strong>Elementary</strong> School are expected to obey school laws, and therules and regulations of the Board of Education. Teachers are required to maintain discipline andcomply with the laws and regulations relating to the operation of the school.The school is an institution of learning. Any activity which distracts from the learningatmosphere or destroys the learning opportunities of a pupil is an infringement on the right of thatindividual to learn. This right will be protected. Students who participate in disruptive activitiesmay be removed from school through due process until such time that it is reasonably certain theycan be relied upon not to repeat such activity.This position is not intended to deny students the right to disagree or even dissent. Everyopportunity for allowing and encouraging the expression of ideas from students concerning theimprovement of their school will be given.DRESS CODEStudents dress in <strong>Louisburg</strong> Schools is part of the educational process meant to prepareyoung people for their advancement into adult responsibilities. Our dress code emphasizesneatness and respectful good taste, but is not intended to cause a financial hardship upon anystudent or family. Decency and good taste are required and clothing should meet acceptedstandards of modesty.GENERAL GUIDELINES:1. Appearance must be neat and clean. Clothing must not be ripped, torn, sagging, orextremely soiled.2. Clothing with profane, obscene or suggestive writing/markings or pictures will not betolerated.3. Advertising of tobacco, alcohol or drug related items on any article of clothing isinappropriate.4. Students must be clothed at all times from the shoulders to mid-thigh. (NO bare midriffs)5. Any hair style or color that causes disruptions or distractions will not be allowed.6. No hats or caps are worn in the building during the school day. Head gear shall not be wornexcept in instances for school spirit with administration approval.7. Feet must be covered by wearing shoes or sandals.Page 11


8. Any style of clothing that causes disruptions or distractions will not be allowed. Specificexamples, but not limited to these, are such things as halter tops, see through clothing orloose fitting/revealing tank tops.9. Any accessories to clothing that cause disruptions or distractions will not be allowed.Specific examples, but not limited to these, are such things as sunglasses, beepers, chains,mp3/CD players with or without headphones, cell phones, portable communication devices.10. Any student wearing clothing that presents a safety hazard in extracurricular activitiesneeds to dress according to the instructor/sponsor requirements.CONSEQUENCES:If a student’s appearance does not meet the above guidelines or attracts undue attention tothe extent that it becomes a disruptive factor in the educational environment, the principal or theirdesignee will make the determination to correct the infraction which may include not to wear thegarment/items again, send the student home to change, or take other appropriate disciplinaryaction such as suspension/expulsion.GROUND RULES1. Students are to stay on the school grounds at all times.2. Students are not to take bicycles from the bicycle racks except to go home. Do not rideanyone else’s bike.3. Students are not to sit in cars or on motorcycles during school hours. Students are not tosit or lean on automobiles or motorcycles parked near the school.4. The school crossing at 10 th and <strong>Rockville</strong> is for your protection. Cross <strong>Rockville</strong> only atthe school crossing.5. No gum is allowed in the halls or classrooms.6. No rock or mulch throwing at any time.7. During the snow season, there will be no snowballing at school. Students are not tothrow snow at the school or any person.8. Students are not to run in the halls at any time.LUNCHROOM RULES1. Eating in the lunchroom is a privilege.2. Respect the rights of others. Be considerate.3. Pick up napkins, straws, eating utensils, and milk cartons.4. Food brought from home may NOT be traded or given away.5. Do not throw food, milk cartons, or any other objects.6. Voice levels should be low. Conversation or whisper levels are appropriate.7. Appropriate table manners are to be used.CODE OF BEHAVIOR1. Pets are not to be brought to school unless the teacher and principal have givenapproval.2. Students may not bring visitors to school without permission.3. Hats will not be worn in the building without administrative approval.4. Students will not use or possess dangerous instruments such as a knife, gun, etc.5. Students will not use or possess illegal objects such as drugs and stolen goods whichmight be dangerous to themselves and to others.6. Students will not physically or verbally assault another student, teacher, or any employeeof the district.7. Students will not take or use the property of others without permission.8. Students are not permitted to engage in any conduct or behavior which disrupts theharmony of the school.Page 12


9. Students will not bring matches or lighters to school.10. Specific act of behavior which are considered to be grounds for suspension or expulsionare:a. Breaking of school rules repeatedlyb. Extortionc. Intimidationd. Obscenitye. Fightingf. Open defianceg. Possession, consumption, or sale of alcoholic beveragesh. Failure to comply with reasonable requests (willful disobedience)i. Routes will be established by the Board of Education.2. Students who live less than 2.5 miles from school will be subject to a transportation fee.3. The bus driver is responsible for the safety of the students on the bus:a. Students shall be seated at all times when the bus is moving.b. The driver is in charge of the students and the bus. Students must obey the driverpromptly and cheerfully.c. Pupils must be on time. The bus cannot wait beyond its regular schedule forthose who are tardy.d. Students should not stand in the roadway while waiting for the bus.e. No smoking on the bus at any time.f. Unnecessary conversation with the driver is prohibited.g. Classroom conduct is to be observed by students while riding the bus, except forordinary conversation. NO horseplay permitted!h. Students must not extend arms or heads out of the bus window.Page 13


i. Students must not try to get on the bus or move within the bus while it is inmotion.j. Students must observe instructions from the driver when leaving the bus.k. Students board and leave the bus only at their home and the school. Any exceptions tothis must be requested in writing or telephone by the parent to the bus driver. Studentsdo not ride a bus other than the one to which they have been assigned. Any exceptionsto this must be requested in writing or telephone by the parent to the supervisor, driver,or principal involved.5. All cases of unacceptable behavior are to be reported by the bus driver to theTransportation Supervisor. The Supervisor will report such behavior to the principalinvolved and also report the same in writing to the Superintendent of schools.6. A student may be suspended from riding the bus for continued violation of the buspolicy, by the building principal or Superintendant in case of emergency.7. If a student rides the bus to school in the morning, he must be furnished transportationhome, unless a written or telephone notice is received by the school from the parent.Field TripsClasses and/or teachers may request to take field trips. Regular rules of schooldiscipline will apply for all students while on the trip. The teacher in charge of the studentson the trip will be responsible for their proper conduct. Written permission will be requiredfrom parents or guardians for students going on any school sponsored field trip.Bus Evacuation DrillsBus evacuation drills will be conducted at least twice a year. Building administrativestaff or appointed staff members will conduct the drill.Bus Loading Regulations1. Students are to remain on the sidewalk until their bus comes to a complete stop.2. Students are not to run in the bus loading area, as a student might be knockedinto the path of an oncoming bus.3. Horseplay of any kind which could endanger the safety of a student will not bepermitted.4. Students are not to touch the bus while in the loading area except when loading.HEALTH OFFICE AND NURSEStudents who are ill should report to the nurse’s office after receiving permission from theclassroom teacher. In no case should a sick student leave the school building until the nurseand/or office personnel have contacted the parent or guardian, and have made provisions for thestudents care.ImmunizationsAll students entering Kansas schools for the first time must present an immunization formcompleted by the physician’s office or the health department. All new out of state students to our district are requested to have a physical examination bya physician.Birth CertificatesBirth Certificate: All students new to <strong>USD</strong> <strong>416</strong> such as Pre-School, Kindergarten, or studentstransferring from another state are required to provide a certified state copy of your child's birthcertificate as per Kansas statute 72-53,106(b). We cannot accept hospital certificates.If Your Child is IllPlease keep your child home from school. Sending a sick child to school exposes studentsand staff to illness and most importantly causes illness to spread throughout the school. We askthat they are temperature free for 24 hours prior to returning to school.Please inform the school if your child is ill and staying home.If Your Child Becomes Ill at SchoolWe will notify you if there is an illness or injury that requires treatment, or if we feel yourchild should go home.Students With Infectious DiseasesStudents with infectious diseases which include head lice, pink eye, etc. will be sent homeand parents in the class will be notified by notes being sent home.Medication PolicyThere are many reasons why student may require medication at school. Many children areable to attend school because of the effectiveness of their medication. The school, parents andphysician will work together to ensure that students receive the correct medication and dosage atthe proper time. Medication should be given at home whenever possible. Medications requiringthree doses a day can generally be given at home (before school, after school and at bedtime.)When medication needs to be given at school, the nurse will require the following:Prescription medication must be sent in a current labeled prescription bottle andaccompanied by a written doctor’s order. Doctor’s orders may be sent by fax. Physician’s order formedication must be updated at the beginning of the school year. All changes in dosage require anew written order, and correctly labeled medication bottle. Controlled substances such asmedication used to treat ADD, ADHD and behavioral disorders, should be delivered to the schoolnurse by the parent/guardian. Unused medication must be obtained from the nurse by theparent/guardian. They will not be sent home with students.Over the counter medications from home must be sent in the original packaging,with specific written instructions from the parent/guardian. Do not send medication toschool in a ziplock bag. We cannot give it.Over the counter medications that may be stocked in the nurse’s office such as Tylenoland or Advil (or the generic equivalent) will be given only at the school nurse’s discretion or bysomeone who gives the medication under the supervision of the school nurse with written parentpermission.SEXUAL HARRASSMENTIt is the policy of <strong>USD</strong> #<strong>416</strong> to maintain a learning and working environment that is freePage 16


from sexual harassment. The school district prohibits any form of sexual harassment.It shall be a violation of this policy for any student or employee of <strong>USD</strong> #<strong>416</strong> to harass astudent or an employee through conduct or communication of a sexual nature as defined by thispolicy.The school district will act to investigate all complaints, formal or informal, verbal orwritten, of sexual harassment and to discipline any student or employee who sexually harasses astudent or employee of the school district.Sexual harassment consists of unwelcome sexual advances, requests for sexual favors,sexually motivated physical conduct or other verbal or physical conduct or communication of asexual nature when: (1) submission to that conduct or communication is made a term or condition,either explicitly or implicitly, of obtaining or retaining employment or obtaining an education; or(2) submission to or rejection of that conduct or communication by an individual is used as afactor in decisions affecting that individual’s employment or education; or (3) that conduct orcommunication has the purpose or effect of substantially or unreasonably interfering with anindividual’s employment or education, or creating an intimidating, hostile or offensiveemployment or education environment. The filing of a complaint or otherwise reporting sexual harassmentwill not reflect upon the individual’s status nor will it affect grades, future employment, orassignments.
