Restless lawmakers pounded outa Fiscal Year <strong>2009</strong> budget in the final hours <strong>of</strong> the fourth longest sessionon record. House and Senate members closed a significant budgetshortfall with a number <strong>of</strong> accounting tools, fund sweeps and agencyreductions, including:$1 billion in borrowing for new school construction$360 million in agency cuts$330 million from the K-12 rollover$150 million Highway User Fund sweeps to the Department <strong>of</strong>Public Safety$85 million from Budget Stabilization Fund or “Rainy Day” fund$1 billion bonding for university building & maintenance<strong>The</strong> university-bonding package will support a campus construction plan to repair old buildings, construct new ones andcomplete a medical campus being built in downtown Phoenix. <strong>The</strong> stimulus plan, which was supported by the <strong>Chamber</strong>, willspecifically help ASU fund deferred maintenance and building renewal needs as well as fund the Del Webb School <strong>of</strong> ConstructionPackage.With an empty “Rainy Day” fund, more than $2.3 billion in bonding and significant fund sweeps, budget critics claim thegovernor and legislature only exacerbated the State’s budget woes. Proponents claim the budget does not contain any taxincreases yet retains most government services.Issues <strong>of</strong> significance to the business community that were supported by the <strong>Chamber</strong> and signed into law by GovernorNapolitano are:Initiative and Referendum Amendments. Makes several changes to statutes regarding initiatives and referendums, includingmaking it a class 1 (highest) misdemeanor for a circulator <strong>of</strong> a initiative or referendum to induce a person in his/her presence tosign a petition by knowingly falsely describing or failing to describe the general subject matter <strong>of</strong> the measure. It also changesvarious time period requirements.Employer Sanctions. Makes various changes to the Legal Arizona Workers Act.<strong>The</strong> bill clarifies when an employer hires an independent contractor; it is the contractor that is liable under the employersanctions law and not the person or entity that hires the contractor. However, an employer violates the law if the employer hiresa contractor or subcontractor who is an alien and whom the employer knows to be an illegal alien. A complaint alleging violation<strong>of</strong> the law does not need to carry the complainant’s social security number or be notarized. Complaints submitted on a prescribedform must be investigated. Complaints not submitted on the prescribed form may be investigated. Complaints must be submittedin the county in which the alleged violation occurred. Continued on Page 3.<strong>Chamber</strong> Announces Primary EndorsementsJohn McComishAndy Swann<strong>The</strong> <strong>Tempe</strong> <strong>Chamber</strong> <strong>of</strong> <strong>Commerce</strong> announced itsendorsement <strong>of</strong> Representative John McComish and AndySwann in the contested Republican primary election for theHouse <strong>of</strong> Representative’s District 20.“We are pleased to endorse these two highly-qualifiedcandidates,” said <strong>Tempe</strong> <strong>Chamber</strong> President/CEO MaryAnn Miller. “We are confident that they will be strongrepresentatives <strong>of</strong> the business community and that theirtalents and abilities will be valuable assets in fulfilling the<strong>Chamber</strong>’s objective <strong>of</strong> promoting the best interests <strong>of</strong> business.”A native <strong>of</strong> Ohio, Representative McComish is serving his second term in the legislature as Majority Whip. He is a member<strong>of</strong> the Financial Institutions and Insurance Committee and the Rules Committee, has served on the City <strong>of</strong> Phoenix PlanningCommission, and has been Chair <strong>of</strong> the Ahwatukee Foothills Village Planning Committee.Andy Swann has lived in Arizona for more than two decades and is a 22-year veteran <strong>of</strong> the Department <strong>of</strong> Public Safetywhere he played a vital role in enacting several pieces <strong>of</strong> important legislation. He has served as president <strong>of</strong> the Arizona PoliceAssociation and currently serves on the legislative School Safety Oversight Committee. He also has served on the DowntownUrban Community Kids board to assist at risk children.<strong>The</strong> District 20 primary election will be held on September 2 . Early voting began on July 31. <strong>The</strong> <strong>Tempe</strong> <strong>Chamber</strong> will beinterviewing candidates in all the races during the upcoming months and will announce endorsements in October for thegeneral election.

A person receiving workers’ comp benefits for partial disability and for whomemployment would have been available but for the person’s “misconduct” (defined) will have the amount<strong>of</strong> benefits reduced. Similarly, if the person is found to be unable to return to or continue to work after theinjury due to misconduct, the person’s benefits may be reduced. Misconduct is defined to include repeatedabsence from work without good cause, intoxication, failure to take or failure to pass a drug or alcohol test,dishonesty or material falsification.One issue that didn’t clear the legislature in the waning hours <strong>of</strong> the session was a permanent repeal <strong>of</strong>the state equalization property tax. Several lawmakers attempted to place a repeal <strong>of</strong> the property tax on theballot since it was vetoed twice this year by Governor Napolitano but the initiative didn’t receive the requirednumber <strong>of</strong> signatures to get on the ballot. It could have been a negotiating part <strong>of</strong> the budget but for somereason it was not included.Another issue that failed was an effort to create an Arizona Temporary Worker Program.
