Complaints: Employees have every right to notify <strong>OSHA</strong> if there are unsafe conditions on yourproject. Employers should encourage open communication about safety hazards <strong>an</strong>d giveemployees the opportunity to communicate their concerns to their supervisor. An <strong>an</strong>onymoussafety suggestion box should also be placed strategically on the project <strong>for</strong> those employeesthat still do not feel com<strong>for</strong>table expressing their concerns. When <strong>an</strong> employee expresses safetyconcerns, it is import<strong>an</strong>t to take it seriously <strong>an</strong>d address it quickly. Once the item has been fixed,talk to the employee <strong>an</strong>d make sure they are com<strong>for</strong>table with the solution.The <strong>Inspection</strong>Adv<strong>an</strong>ced noticed will not be given to <strong>an</strong> employer be<strong>for</strong>e <strong>an</strong> inspection. The representative at the frontdesk should know who to contact when <strong>an</strong> <strong>OSHA</strong> Compli<strong>an</strong>ce Office comes to your site. Once them<strong>an</strong>agement team arrives, verify the credentials of the Compli<strong>an</strong>ce Officer <strong>an</strong>d try to determine whythey are at your project. Be<strong>for</strong>e the opening conference, the employer should assign individuals specificassignments that include a note taker <strong>an</strong>d photographer. It is also import<strong>an</strong>t to remind everyoneinvolved to be professional <strong>an</strong>d treat the compli<strong>an</strong>ce officer with respect.Once the Compli<strong>an</strong>ce Officer completes the opening conference <strong>an</strong>d has been given consent to inspectthe site, the walk around will begin. It is likely pictures will be taken by the compli<strong>an</strong>ce officer. Thephotographer should take the same picture <strong>an</strong>d possibly additional pictures from different <strong>an</strong>gles. Thenote taker should take detailed notes.During the exit conference it is import<strong>an</strong>t to determine whether citations will be issued. In m<strong>an</strong>y casesthe Compli<strong>an</strong>ce Officer may not know <strong>an</strong>d might request additional documents using a DocumentRequest Form (Cal/<strong>OSHA</strong> 1AY).Follow-upIf you are told that no citations will be issued, contact the compli<strong>an</strong>ce officer <strong>an</strong>d obtain a Notice of NoViolation after <strong>Inspection</strong> (Cal/<strong>OSHA</strong> 1AX). If you receive a citation it is import<strong>an</strong>t to take immediateaction because a comp<strong>an</strong>y only has 15 working days to notify the Appeals Board they are appealing thecitation. The consultation service c<strong>an</strong> also per<strong>for</strong>m onsite visits to help with <strong>OSHA</strong> compli<strong>an</strong>ce <strong>an</strong>dhas partnership programs <strong>for</strong> construction including SHARP <strong>an</strong>d the prestigious VPP-ConstructionProgram.
