<strong>Preparing</strong> <strong>for</strong> <strong>an</strong> <strong>OSHA</strong> <strong>Inspection</strong><strong>Jerry</strong> <strong>Shupe</strong>, <strong>CSP</strong><strong>Hensel</strong> <strong>Phelps</strong> Construction Co.OverviewMost comp<strong>an</strong>ies probably agree that they don’t w<strong>an</strong>t to have <strong>OSHA</strong> at their workplace; however, beingprepared <strong>for</strong> <strong>an</strong> <strong>OSHA</strong> <strong>Inspection</strong> c<strong>an</strong> help save your comp<strong>an</strong>y time <strong>an</strong>d money in the event you have <strong>an</strong>inspection. It is import<strong>an</strong>t to remember that employers <strong>an</strong>d <strong>OSHA</strong> should have the same goal –preventing accidents <strong>an</strong>d injuries.Reasons <strong>for</strong> <strong>an</strong> <strong>Inspection</strong><strong>OSHA</strong> will show up to your project <strong>for</strong> a number of reasons including: complaints, accidents, sweeps /programmed inspections, follow-ups, referrals, or drive by observations. Determine why <strong>an</strong> <strong>OSHA</strong>Inspector is at your project <strong>an</strong>d what the scope of the inspection will be. If <strong>an</strong> inspector is there becauseof a complaint, they may only w<strong>an</strong>t to see one particular area or process. If they are there <strong>for</strong> aprogrammed inspection it may be a “wall-to-wall” inspection. Remember that <strong>an</strong> inspector c<strong>an</strong> exp<strong>an</strong>dthe scope of their inspection at <strong>an</strong>y time. The inspection may also include multiple employers.PreparationFormal Procedure: Every comp<strong>an</strong>y should have a <strong>for</strong>mal procedure detailing what should bedone be<strong>for</strong>e, during <strong>an</strong>d after <strong>an</strong> <strong>OSHA</strong> <strong>Inspection</strong>. This procedure should be available to allsupervisors <strong>an</strong>d made site specific. Site specific in<strong>for</strong>mation could include contacts <strong>for</strong> theproject if <strong>OSHA</strong> arrives, location of documents like <strong>OSHA</strong> 300 logs <strong>an</strong>d the Injury IllnessPrevention Program (IIPP).Audits: Thorough <strong>an</strong>d complete safety inspections should be done to ensure a safe workplace<strong>an</strong>d to verify <strong>OSHA</strong> compli<strong>an</strong>ce. Utilize resources that <strong>OSHA</strong> publishes such as the “Cal/<strong>OSHA</strong>1A” <strong>for</strong>m. This <strong>for</strong>m is utilized by compli<strong>an</strong>ce officers during <strong>an</strong> inspection <strong>an</strong>d c<strong>an</strong> be used tohelp ensure your comp<strong>an</strong>y has all the required documents that may be asked <strong>for</strong> during <strong>an</strong>inspection.<strong>OSHA</strong> <strong>Inspection</strong> Kit: An <strong>OSHA</strong> <strong>Inspection</strong> Kit should be developed <strong>an</strong>d available at each project.Items to include in this kit are: written program <strong>for</strong> <strong>OSHA</strong> <strong>Inspection</strong>s, comp<strong>an</strong>y contact list,cameras, tape measure, caution / d<strong>an</strong>ger tape, paper, <strong>an</strong>d pens.Training: <strong>OSHA</strong> <strong>Inspection</strong> Training should be conducted on each project at least <strong>an</strong>nually. It isimport<strong>an</strong>t that all supervisors know what to do in the event <strong>OSHA</strong> comes to a project becauseinspections c<strong>an</strong> happen on weekends, when employees are on vacation, or when team leadersare away <strong>for</strong> meetings. The training should include where all documents are located,assignments to be made during <strong>an</strong> inspection in accord<strong>an</strong>ce with your written program, <strong>an</strong>dwho to contact. Another good resource that c<strong>an</strong> be used during training is Cal/<strong>OSHA</strong>’s Policy <strong>an</strong>dProcedures M<strong>an</strong>ual pertaining to “<strong>Inspection</strong> Procedures”. This is available on Cal/<strong>OSHA</strong>’swebsite.


Complaints: Employees have every right to notify <strong>OSHA</strong> if there are unsafe conditions on yourproject. Employers should encourage open communication about safety hazards <strong>an</strong>d giveemployees the opportunity to communicate their concerns to their supervisor. An <strong>an</strong>onymoussafety suggestion box should also be placed strategically on the project <strong>for</strong> those employeesthat still do not feel com<strong>for</strong>table expressing their concerns. When <strong>an</strong> employee expresses safetyconcerns, it is import<strong>an</strong>t to take it seriously <strong>an</strong>d address it quickly. Once the item has been fixed,talk to the employee <strong>an</strong>d make sure they are com<strong>for</strong>table with the solution.The <strong>Inspection</strong>Adv<strong>an</strong>ced noticed will not be given to <strong>an</strong> employer be<strong>for</strong>e <strong>an</strong> inspection. The representative at the frontdesk should know who to contact when <strong>an</strong> <strong>OSHA</strong> Compli<strong>an</strong>ce Office comes to your site. Once them<strong>an</strong>agement team arrives, verify the credentials of the Compli<strong>an</strong>ce Officer <strong>an</strong>d try to determine whythey are at your project. Be<strong>for</strong>e the opening conference, the employer should assign individuals specificassignments that include a note taker <strong>an</strong>d photographer. It is also import<strong>an</strong>t to remind everyoneinvolved to be professional <strong>an</strong>d treat the compli<strong>an</strong>ce officer with respect.Once the Compli<strong>an</strong>ce Officer completes the opening conference <strong>an</strong>d has been given consent to inspectthe site, the walk around will begin. It is likely pictures will be taken by the compli<strong>an</strong>ce officer. Thephotographer should take the same picture <strong>an</strong>d possibly additional pictures from different <strong>an</strong>gles. Thenote taker should take detailed notes.During the exit conference it is import<strong>an</strong>t to determine whether citations will be issued. In m<strong>an</strong>y casesthe Compli<strong>an</strong>ce Officer may not know <strong>an</strong>d might request additional documents using a DocumentRequest Form (Cal/<strong>OSHA</strong> 1AY).Follow-upIf you are told that no citations will be issued, contact the compli<strong>an</strong>ce officer <strong>an</strong>d obtain a Notice of NoViolation after <strong>Inspection</strong> (Cal/<strong>OSHA</strong> 1AX). If you receive a citation it is import<strong>an</strong>t to take immediateaction because a comp<strong>an</strong>y only has 15 working days to notify the Appeals Board they are appealing thecitation. A citation c<strong>an</strong> be issued up to six months after the inspection so it is import<strong>an</strong>t to watch yourmail closely.Resources <strong>an</strong>d Partnership ProgramsThe Cal/<strong>OSHA</strong> Consultation service has a lot of great in<strong>for</strong>mation on their website that c<strong>an</strong> helpemployers. The consultation service c<strong>an</strong> also per<strong>for</strong>m onsite visits to help with <strong>OSHA</strong> compli<strong>an</strong>ce <strong>an</strong>dhas partnership programs <strong>for</strong> construction including SHARP <strong>an</strong>d the prestigious VPP-ConstructionProgram.
