<strong>Cooperative</strong> will analyze the Customers usage to determine if the<br />
Customer is on the most favorable applicable rate.<br />
E. Right-of-Way<br />
1. The <strong>Cooperative</strong> shall determine the route, placement, <strong>and</strong> type of<br />
construction of electric distribution facilities based on the least cost<br />
method <strong>and</strong> accepted utility practices. The Applicant shall locate<br />
<strong>and</strong> physically mark all private underground facilities located in the<br />
<strong>Cooperative</strong> determined route, <strong>and</strong> will release the <strong>Cooperative</strong><br />
from any liabilities therewith.<br />
2. The Applicant, at no cost to the <strong>Cooperative</strong>, shall provide the<br />
<strong>Cooperative</strong> a valid written right-of-way easement covering<br />
<strong>Cooperative</strong> facilities on the property of the Applicant in a form<br />
acceptable to the <strong>Cooperative</strong>. Should it be necessary for said<br />
easement to be approved by a government agency or recorded on<br />
permanent record at the respective county clerk’s office, the<br />
Applicant shall pay the <strong>Cooperative</strong> prior to construction for all<br />
costs associated with preparation, approval, <strong>and</strong> recordation of<br />
easement documents. The Applicant shall give the <strong>Cooperative</strong> or<br />
its agents access to its equipment <strong>and</strong> facilities, <strong>and</strong> the right to<br />
construct, operate, upgrade, relocate, <strong>and</strong> maintain its facilities on<br />
the Applicant’s property.<br />
3. Prior to construction of <strong>Cooperative</strong> facilities all right-of-way<br />
easements <strong>and</strong> permits required for the <strong>Cooperative</strong>’s <strong>and</strong><br />
Applicant’s facilities must have been secured. The <strong>Cooperative</strong><br />
may solicit right-of-way easements from property owners whose<br />
l<strong>and</strong>s will be affected by the extension of the <strong>Cooperative</strong>’s facilities<br />
to the Applicant. If l<strong>and</strong>owners require compensation for granting<br />
easements necessary to provide electric distribution service to the<br />
Applicant, then the <strong>Cooperative</strong> shall notify the Applicant of the<br />
l<strong>and</strong>owners’ dem<strong>and</strong>s <strong>and</strong> request the Applicant to satisfy such<br />
dem<strong>and</strong>s. If the <strong>Cooperative</strong>’s st<strong>and</strong>ard procedures for obtaining<br />
the easement are not successful, the Applicant may be required to<br />
either secure, or assist in securing, a satisfactory easement from<br />
others <strong>and</strong>/or pay the <strong>Cooperative</strong>’s additional costs, including<br />
those resulting from condemnation.<br />
4. Subdivision Developers shall grant the <strong>Cooperative</strong> a free <strong>and</strong><br />
continuous easement <strong>and</strong> cleared right-of-way adjacent to all<br />
streets <strong>and</strong> lot boundaries within the property of the development,<br />
<strong>and</strong> the authority to design construct, maintain, upgrade, relocate,<br />
<strong>and</strong> operate an electrical distribution system as proposed by the<br />
<strong>Cooperative</strong>.<br />
5. The <strong>Cooperative</strong> shall have the right to keep easements clear of<br />
trees, shrubbery, undergrowth <strong>and</strong> other obstructions.<br />
