Publication Scheme 

Introduction 

The Trust adopted the Information Commissioner’s Office’s (ICO’s) revised model 

publication scheme 1 as of January 2009 and this document is an outline of what the 

Trust has a duty to do. The publication scheme commits the Trust to making 

information available to the public as part of its normal business activities. The 

information covered is included in the classes of information as listed below and 

Appendix A details a Guide to Information for the public. Published information does 

not only relate to printed material, but includes electronic material available on the 

Trust’s Internet site and some audio and video material. 

The scheme commits an authority: 

 

 

 

 

 

 

 

to proactively publish or otherwise make available as a matter of routine, 

information, including environmental information, which is held by the 

authority and falls within the classifications below, 

to specify the information, which is held by the authority and falls within the 

classifications below, 

to proactively publish or otherwise make available as a matter of routine, 

information in line with the statements contained within this scheme, 

to produce and publish the methods by which the specific information is made 

routinely available so that it can be easily identified and accessed by 

members of the public, 

to review and update on a regular basis the information the authority makes 

available under this scheme, 

to produce a schedule of any fees charged for access to information which is 

made proactively available, and 

to make this publication scheme available to the public. 

Classes 

Information is grouped into the following classes: 

 

 

 

who we are and what we do: organisational information, locations and 

contacts, constitutional and legal governance, 

what we spend and how we spend it: financial information relating to 

projected and actual income and expenditure, tendering, procurement and 

contracts, 

what our priorities are and how we are doing: strategy and performance 

information, plans, assessments, inspections and reviews,

how we make decisions: policy proposals and decisions, decision-making 

processes, internal criteria and procedures and consultations, 

our policies and procedures: current written protocols for delivering our 

functions and responsibilities, 

lists and registers: information held in registers required by law and other 

lists and registers relating to the functions of the authority, and 

the services we offer: advice and guidance, booklets and leaflets, 

transactions and media releases and descriptions of the services offered. 

The classes of information will not generally include: 

 

 

 

information the disclosure of which is prevented by law, or exempt under the 

Freedom of Information Act, or is otherwise properly considered to be 

protected from disclosure, 

information in draft form, and 

information that is no longer readily available as it is contained in files that 

have been placed in archive storage, or is difficult to access for similar 

reasons. 

Publication Methods 

Wherever possible and practicable, information will be provided on or via the Trust’s 

website 2 . Where this is impracticable, or when an individual does not wish or is not 

able to access the information on the website, then Appendix A (Guide to 

Information) will indicate how information can be obtained by other means. 

In exceptional circumstances some information may be available only by viewing in 

person. Where this manner is specified, contact details will be provided as part of 

the Trust’s response. An appointment to view the information will be arranged within 

a reasonable timescale. 

Information will be provided in the language in which it is held or in such other 

language that is legally required. Obligations under disability and discrimination 

legislation and any other legislation to provide information in other forms and formats 

will be adhered to when providing information in accordance with this scheme. 

Responses to previous FOI requests will also be published on the Trust’s Internet 

site as part of a disclosure log. 

Charges 

The purpose of the scheme is to make the maximum amount of information readily 

available at minimum inconvenience and cost to the public. Any charges made by 

the Trust will be justified and transparent and kept to a minimum. Material on the

providing information in hard copy format (eg photocopying and postage and 

packaging), and/or 

the costs directly incurred as a result of viewing information. 

If a charge is to be made, confirmation of the amount will be given as quickly as 

possible after the request is received. Payment must be made before the 

information is provided. See the Trust’s Charging Process 3 for further details. 

Requesting Information 

When requesting information not available via the Internet site the following details 

are required to facilitate its provision:

the information required, and 

the format in which the information should be sent. 

Requests must be made in writing and can be submitted to the Trust via:

a letter (a template letter is available on the Trust’s website) sent to the 

address below,

Information Not Available 

Information that is personal and private to individuals will not be made available 

under the Freedom of Information Act 2000. People who wish to access their own 

information held by the Trust can do so by making application under the Data 

Protection Act 1998 in writing to:

Applications must contain enough information to accurately identify the requestor’s 

file (eg full name, date of birth, address [including any previous addresses if 

applicable], NHS and/or hospital number [if known], etc). 

Any questions relating to Access to Records requests should be directed to the 

Claims Management Team on 01925 664004 in the first instance. 

Oversight and Review 

The Director of Nursing & Quality has overall responsibility for Freedom of 

Information, whilst the Trust’s Information Governance & Clinical Coding Manager 

leads on the day-to-day maintenance and review of Freedom of Information and its 

publication scheme. 

If an applicant is unhappy with the Trust’s response, they can request an internal 

review. See the Trust’s Internal Review Process 6 for further details. 

It is the Trust’s intention to review this scheme on a quarterly basis and/or in line with 

guidance as it is produced by the Information Commissioner. The next review is due 

in February 2014.
