(3) In addition to the fee prescribed in sub-regulation (2) of this regulation, the agent,<br />
importer, exporter or owner as the case may be, shall pay to the Comptroller an additional fee of<br />
$12.00 per entry, if entries are not claimed and collected within 10 working days after<br />
lodgement.<br />
(4) Where before the Comptroller has processed entry documents, the agent,<br />
importer, exporter or owner notifies in writing, within 10 days from the date of lodgment, to the<br />
Comptroller that the documents are no longer required due to goods being over-carried, short<br />
landed etc, the Comptroller may at the Comptroller's discretion, refund or remit in whole or in part the fee<br />
paid or payable pursuant to this Regulation.<br />

Place of embarkation<br />
83.—(1) No person shall embark on any aircraft or ship, except at a place appointed under section 4 of<br />
the Act, nor, in the case of a passenger, until permission to embark has been granted by the proper<br />
officer.<br />
(2) The baggage of passengers of an aircraft or ship proceeding to a place outside the <strong>Fiji</strong><br />
Islands shall be loaded at such place as the proper officer may direct, and unless the proper officer<br />
otherwise allows, shall not be loaded until it has been examined and passed by him or her for<br />
shipment.<br />
(3) A person who contravenes any of the provisions of this regulation commits an offence.<br />
Loading before entry<br />
84.—(1) Where, under the provisions of the Act, the proper officer permits the loading, prior to entry,<br />
of goods, whether liable to or free of export duty, application shall be made by the exporter on the approved<br />
form (C.47) and in the case of goods liable to export duty such security as the proper officer requires shall<br />
be provided.<br />
(2) Applications referred to in sub-regulation (1) of this regulation shall be accompanied by the fee<br />
prescribed in sub-regulation (3) of this regulation.<br />
(3) A fee of $25.00 shall be payable to the Comptroller in respect of each application per bill of<br />
lading or airway bill, referred to in sub-regulation (1) of this regulation.<br />

Cargo landed in error<br />
85. Where goods have been unloaded in error, the master or agent of the air craft or ship shall<br />
arrange for such goods to be reloaded or immediately added to the inward report of such aircraft or<br />
ship.<br />
Transfer of stores<br />
86.—(1) The master of an aircraft or ship who desires to transfer stores from one aircraft or ship to<br />
another shall make application to the proper officer on the approved form (C.33).<br />
(2) The application to transfer stores shall be accompanied with the fee prescribed in subregulation<br />
(3) of this regulation.<br />
(3) A fee of $12.00 shall be payable to the Comptroller in respect, of each application<br />
under sub-regulation (1) of this regulation.<br />
(4) Stores subject to import duty shall not be transferred from one aircraft or ship to<br />
another until a bond has been given on the approved form (C.34).<br />
(5) A person who contravenes any of the provisions of this regulation commits an<br />
offence.<br />

Conditions of loading or transfer of stores<br />
87. The loading or transfer of stores shall be subject to the observance by the applicant of any<br />
conditions imposed by the proper officer and shall not commence until the appropriate entry has been passed<br />
or approval has been granted.<br />
