plaatsgevonden.
4.3. De veterinaire bevindingen kunnen
voorafgaande aan de Veiling op verzoek
van de potentiële koper worden ingezien
en toegelicht door veilingdierenarts Alfons
Geerts, of zijn plaatsvervanger.
4.4. Auction4Good heeft aldus getracht
te waarborgen dat er enkel gezonde
sportpaarden worden aangeboden op de
Veiling, die qua gezondheid ook volledig
geschikt zijn voor de sport. Ondanks deze
voorzorgsmaatregelen kan Auction4Good
er niet voor instaan dat de geveilde
paarden ook bij aflevering zowel klinisch als
röntgenologisch gezond zijn. Auction4Good
kan dan ook niet aansprakelijk worden
gesteld door Kopers voor vorderingen uit
hoofde van non-conformiteit (of andere
rechtsvorderingen die gebaseerd zijn op deze
feitelijke grondslag) met betrekking tot de
gezondheidstoestand, de prestaties en/of
gebruiksdoeleinden van de te veilen paarden.
4.5. Auction4Good is niet aansprakelijk voor
schade aan personen of zaken, ontstaan
voorafgaand aan, ten tijde van en/of na de
Veiling, behoudens indien deze schade het
gevolg is van opzet of bewuste roekeloosheid
van Auction4Good en daaronder begrepen
personen die met leiding van dit bedrijf zijn
belast.
5. Afgifte, risico- en eigendomsoverdracht
5.1. Direct na de gunning van een paard
gaat het risico met betrekking tot
het gekochte paard over op de koper
en zijn alle verantwoordelijkheden
en aansprakelijkheden, alsmede alle
risicofactoren, overgedragen aan de
betreffende koper. De koper zal Auction4Good
en verkoper vrijwaren voor alle aanspraken
van derden ter zake.
5.2. De eigendom van het gekochte paard gaat op
de koper over op het moment van afname als
months prior to the Auction. A standard
clinical examination (for sport horses) has
been completed at the latest one week
prior to the Auction.
4.3. Veterinary findings can be provided upon
the request of potential buyers prior to the
Auction and a more detailed explanation
can be provided by Alfons Geerts, the
Auction veterinarian, or his substitute.
4.4. Auction4Good has tried to only select
healthy sport horses for the Auction.
Despite the precautions, Auction4Good
cannot ensure all horses to be auctioned
are clinical and radio graphically healthy
at the time of delivery. Auction4Good
cannot be held liable by sellers for claims
based on non-conformity of the horse to
be auctioned (or any other claim based on
this factual background), when it comes to
the health of the horse, the performances
of the horse and/or the use of the horse.
4.5. Auction4Good cannot be held liable for
damages to persons or goods, which arise
before, during or after the Auction, except
for damages that result from intent or
conscious recklessness of Auction4Good
and the persons in charge of the company.
5. Release and transfer of risk and
ownership
5.1. Immediately after a bid on a horse has
been accepted, any risks related to the
purchased horse shall be transferred to the
buyer and any responsibility and liability,
as well as all risk factors are transferred
to the respective buyer. The buyer shall
indemnify Auction4Good and seller from
any claims brought by third parties.
5.2. Ownership of the purchased horse passes
to the buyer at the time of release as
defined in Article 5.3 of these terms and
conditions, but not before the buyer has
settled the full purchase amount and
any other amounts due to Auction4Good
