wash. The German (1992) agreement, to pay up to $190 million, which covered 100 percent of pr<strong>in</strong>cipal<br />

and approximately 50 percent of <strong>in</strong>terest, was pert<strong>in</strong>ent <strong>in</strong> two respects. First, U.S. negotiators<br />

accepted less than the full 6 percent <strong>in</strong>terest, as the German negotiators balked at add<strong>in</strong>g <strong>in</strong>terest<br />

charges to compensation, just as the German government had refused to do <strong>in</strong> resolv<strong>in</strong>g property<br />

claims <strong>in</strong> East Germany follow<strong>in</strong>g reunification. In the words of an official of the German government,<br />

“we avoided the ‘fictional calculations’ of what properties might have earned, had there been<br />

no World War II, no German Democratic Republic.” 57 Also of note, <strong>in</strong> determ<strong>in</strong><strong>in</strong>g its <strong>in</strong>terest awards<br />

on German claims, the FCSC made explicit that <strong>in</strong>terest was to be simple, not compound <strong>in</strong>terest,<br />

<strong>in</strong> accordance with previous Commission decisions. 58<br />

A common criticism of lump sum settlements negotiated by the State Department is that they give<br />

too much weight to diplomatic <strong>in</strong>terests, result<strong>in</strong>g <strong>in</strong> the claimants receiv<strong>in</strong>g considerably less than<br />

the values of their lost properties. 59 However, from the claimant perspective, the recent settlements<br />

with Vietnam and Germany and with the oil exporters are more hearten<strong>in</strong>g. These more favorable<br />

settlements reflect the debtor nation’s capacities to pay (<strong>in</strong> the Vietnam case, the existence of frozen<br />

assets), and certa<strong>in</strong>ly <strong>in</strong> the Vietnam and German cases, favorable diplomatic contexts.<br />

<strong>Claims</strong> of U.S. Nationals: Solutions<br />

For reasons stated at the outset of this paper, physical restoration of properties will be exceptional;<br />

with the passage of so much time, many properties will have been transformed beyond recognition<br />

and the potential for conflicts with current occupants would be too great. As long as the <strong>Cuba</strong>n Communist<br />

Party rema<strong>in</strong>s <strong>in</strong> power, their core political <strong>in</strong>terests militate aga<strong>in</strong>st a visible restoration of<br />

the old order. Rather, let us consider two potential solutions: 1) A simple lump-sum settlement for all<br />

claimants; and 2) a two-tiered solution, whereby corporate claimants can choose either to seek creative<br />

barga<strong>in</strong>s, or jo<strong>in</strong> <strong>in</strong>dividual claimants <strong>in</strong> a lump-sum settlement. A variant of this option would<br />

be to place an “equity” cap on payments on <strong>in</strong>dividual claims, for example at $1 million per claim.<br />
