from 2011 to 2014 <strong>in</strong> which prosecutors requested punitive measures for offences aga<strong>in</strong>st sexual<br />

<strong>in</strong>tegrity. Implementation of the new laws will need to be monitored closely so that their<br />

implementation does not rema<strong>in</strong> an ongo<strong>in</strong>g challenge for <strong>Kosovo</strong> <strong>in</strong> implement<strong>in</strong>g human rights<br />

standards <strong>in</strong> protect<strong>in</strong>g human dignity and equal opportunities guaranteed by the Constitution.<br />

Another law that provides protection from discrim<strong>in</strong>ation is the <strong>Kosovo</strong> Law on Civil Service.<br />

This Law provides basic pr<strong>in</strong>ciples for entry <strong>in</strong>to the civil service, protection from discrim<strong>in</strong>ation at<br />

work, and <strong>in</strong> occupational advancement. This is <strong>in</strong> accordance with the wider pr<strong>in</strong>ciple of nondiscrim<strong>in</strong>ation,<br />

which forbids discrim<strong>in</strong>ation on the basis of gender or sexual orientation with<strong>in</strong> the civil<br />

service. Additionally, equal opportunities are encouraged for ensur<strong>in</strong>g equal gender participation <strong>in</strong> the<br />

civil service. 29 However, this provision is of a general nature, merely establish<strong>in</strong>g the basis for what<br />

constitutes discrim<strong>in</strong>ation. No sanctions are mentioned with regard to violations, though the Law on<br />

the Protection from Discrim<strong>in</strong>ation arguably could be applied.<br />

Provisions of the Law on the Protection from Discrim<strong>in</strong>ation also are applicable <strong>in</strong> relation to<br />

employers and employee relationships <strong>in</strong> the private and public sphere <strong>in</strong> accordance with the <strong>Kosovo</strong><br />

Labour Law. 30 The Labour Law forbids all k<strong>in</strong>ds of discrim<strong>in</strong>ation <strong>in</strong> relation to employment and<br />

occupation when it comes to recruitment, tra<strong>in</strong><strong>in</strong>g, promotion, terms and conditions of employment<br />

<strong>in</strong>clud<strong>in</strong>g discipl<strong>in</strong>ary measures, contract relations, and other employment relations. Under the Labour<br />

Law, a general clause details f<strong>in</strong>es <strong>in</strong> cases of violations of these protections by a person or a legal<br />

entity, <strong>in</strong> a legal proceed<strong>in</strong>g, with the f<strong>in</strong>e rang<strong>in</strong>g from €100 to €10,000. 31<br />

Crim<strong>in</strong>al Provisions Related to <strong>Harassment</strong><br />

The Crim<strong>in</strong>al Code does not def<strong>in</strong>e sexual harassment per se, but offers arguably relevant<br />

def<strong>in</strong>itions under several articles. For example, Article 186 def<strong>in</strong>es harassment as:<br />

[A] pattern of repeated and unwanted attention or communication with the <strong>in</strong>tent to harass,<br />

<strong>in</strong>timidate, <strong>in</strong>jure, damage property or kill another person or his or her children, family, relatives<br />

or pets or whoever places another under surveillance with the <strong>in</strong>tent to harass, <strong>in</strong>timidate,<br />

<strong>in</strong>jure, damage property or kill another person or his or her children, family, relatives or pets;<br />

and <strong>in</strong> the course thereof, places that person <strong>in</strong> reasonable fear of death, grievous bodily <strong>in</strong>jury,<br />

serious damage to property or substantial emotional distress.<br />

The Crim<strong>in</strong>al Code also expla<strong>in</strong>s that attention or communication under the def<strong>in</strong>ition of harassment<br />

<strong>in</strong>cludes “follow<strong>in</strong>g or lay<strong>in</strong>g <strong>in</strong> wait; repeatedly appear<strong>in</strong>g at the home, school, work or recreation<br />

place; mak<strong>in</strong>g repeated phone calls; send<strong>in</strong>g or leav<strong>in</strong>g messages; send<strong>in</strong>g text messages, mail or emails;<br />

or, leav<strong>in</strong>g or send<strong>in</strong>g unwanted gifts or other items.” 32 For harassment, persons can be sentenced with<br />

up to three years imprisonment or a f<strong>in</strong>e. If such an offence is conducted aga<strong>in</strong>st a former or current<br />

domestic partner, the perpetrator shall be punished by imprisonment of six months to five years. 33<br />

The Crim<strong>in</strong>al Code also provides for further protections if acts occur aga<strong>in</strong>st vulnerable victims,<br />

foresee<strong>in</strong>g higher sentences for several crimes. The Code def<strong>in</strong>es a “vulnerable victim” as a “child, a<br />

physically or mentally handicapped person, a person suffer<strong>in</strong>g from dim<strong>in</strong>ished capacity, a pregnant<br />

woman, or a domestic partner.” 34 Even though sexual harassment is not mentioned explicitly,<br />

vulnerable victims of crimes <strong>in</strong>volv<strong>in</strong>g harassment, sexual abuse, or violations of sexual <strong>in</strong>tegrity should<br />

be subject to further protections.<br />
