perpetrator knows that the person is exceptionally vulnerable because of age, dim<strong>in</strong>ished mental<br />

or physical capacity, physical or mental disorder, disability, or pregnancy. 38<br />

In such cases, the foreseen imprisonment ranges from one to seven years. In cases when the<br />

perpetrator is a teacher, a religious leader, a healthcare professional, a person entrusted with a<br />

person’s upbr<strong>in</strong>g<strong>in</strong>g or care, or has a position of authority over the person, imprisonment is foreseen<br />

for at least ten years to life. 39 <strong>Sexual</strong> assault also <strong>in</strong>cludes circumstances of touch<strong>in</strong>g another person <strong>in</strong> a<br />

sexual way and for a sexual purpose. 40<br />

Other relevant crim<strong>in</strong>al provisions are us<strong>in</strong>g or <strong>in</strong>volv<strong>in</strong>g a child <strong>in</strong> mak<strong>in</strong>g or produc<strong>in</strong>g live<br />

performances 41 of a sexual nature or production of child pornography, with perpetrators sentenced<br />

from one to five years imprisonment. Additionally, sell<strong>in</strong>g, distribut<strong>in</strong>g, promot<strong>in</strong>g, display<strong>in</strong>g, and<br />

offer<strong>in</strong>g child pornography also is considered a crim<strong>in</strong>al offence with imprisonment rang<strong>in</strong>g from six<br />

months to five years. 42<br />

Further, sexual harassment may <strong>in</strong>volve or lead to acts aga<strong>in</strong>st the sexual <strong>in</strong>tegrity of a person.<br />

The Crim<strong>in</strong>al Code of <strong>Kosovo</strong> also recognises the exploitation of a situation <strong>in</strong> which a person is<br />

vulnerable or his or her security is <strong>in</strong> danger <strong>in</strong>clud<strong>in</strong>g when the perpetrator is <strong>in</strong> a position of authority<br />

over the person or is a caretaker, teacher, religious leader, or healthcare professional. 43 In these<br />

circumstances, crim<strong>in</strong>al offences such as rape, 44 sexual assault, and degrad<strong>in</strong>g a person’s sexual <strong>in</strong>tegrity<br />

are sanctioned and have imprisonment sentences rang<strong>in</strong>g from two to fifteen years. 45<br />

<strong>Sexual</strong> acts without the consent of a person are def<strong>in</strong>ed as “penetration however slight of any<br />

part of the body of a person with a sexual organ, or the penetration however slight of the anal or<br />

genital open<strong>in</strong>g of a person with any object or any other part of the body.” 46 Under Article 239 of the<br />

Crim<strong>in</strong>al Code sexual abuse by a person abus<strong>in</strong>g her or his position, authority, or profession aga<strong>in</strong>st a<br />

person by subject<strong>in</strong>g a person to a sexual act, touch<strong>in</strong>g a person for a sexual purpose, or <strong>in</strong>duc<strong>in</strong>g<br />

another person to expose a person’s body parts and denigrat<strong>in</strong>g a person’s sexual <strong>in</strong>tegrity is a<br />

circumstance of abus<strong>in</strong>g his or her control. Abuse of position can be carried out <strong>in</strong> relation to the<br />

f<strong>in</strong>ancial, family, social, health, employment, educational, religious, or other circumstances of a person.<br />

In such cases, the perpetrator shall be punished by imprisonment of one to five years.<br />

Failure to report any knowledge or <strong>in</strong>formation about the preparation or execution of a crim<strong>in</strong>al<br />

offence also is punishable with a f<strong>in</strong>e and up to three years imprisonment. 47 This means that officials<br />

and ord<strong>in</strong>ary citizens alike have a legal responsibility to report any <strong>in</strong>formation that they have about<br />

crim<strong>in</strong>al offences when they occur.<br />

In conclusion, crim<strong>in</strong>al provisions provide advanced protections aga<strong>in</strong>st vulnerable victims,<br />

<strong>in</strong>clud<strong>in</strong>g victims of sexual abuse. However, they fail to offer a specific def<strong>in</strong>ition of sexual harassment<br />

per se. This affects the implementation of the Crim<strong>in</strong>al Code and the protection of victims from sexual<br />
