The THEATRE CO-ORDINATOR or designate, has absolute discretion <strong>and</strong> reserves the<br />

right to forbid or restrict the access of any individual or organization to the THEATRE.<br />

Without limiting the generality of the foregoing, the decision may be based on the sole<br />

<strong>and</strong> absolute determination that damage to property might result from permitting such<br />

companies or individuals access, or if such individual or organizations have previously<br />

demonstrated an unwillingness or inability to abide by the policies <strong>and</strong> procedures of the<br />

<strong>Theatre</strong>.<br />

Outside contractors working on behalf of the LICENSEE MUST provide written proof of<br />

insurance liability coverage as outlined above, in addition to proof of paid up Workers<br />

Safety Insurance Board premiums.<br />

7.21 EXCLUSIVE USE OF FACILITY<br />

Although the LICENSEE has a contract with the THEATRE, it does not provide sole<br />

<strong>and</strong> exclusive use of the facility by the LICENSEE.<br />

In the lobby, the THEATRE has the right to contract for the hanging of artwork or to<br />

display other items from other organizations not related to the LICENSEE’S event.<br />

The THEATRE may use the stage area, backstage areas <strong>and</strong> auditorium at times when the<br />

LICENSEE is not utilizing the facility. The THEATRE agrees to assume responsibility<br />

for any damage or loss of property of the LICENSEE associated with the THEATRE’S<br />

use of the facility.<br />

The movement of or the covering up or obstructing of the THEATRE’S property,<br />

including furniture <strong>and</strong> equipment or any items contracted by another group during the<br />

LICENSEE’S contract term, shall be subject to written approval from the <strong>Theatre</strong> Coordinator<br />

or designate.<br />

8. PARKING LOT AND GROUNDS USE<br />

8.1 The parking lot <strong>and</strong> the grounds surrounding the THEATRE remain the property of<br />

the CORPORATION OF THE TOWN OF NEWMARKET AND YORK REGION<br />

DISTRICT SCHOOL BOARD <strong>and</strong> may be used only for purposes sanctioned by the<br />

THEATRE.<br />

Parking areas assigned as THEATRE PARKING will be made available to the<br />

LICENSEE <strong>and</strong> its patrons. Parking spaces in adjoining parking lots (<strong>Newmarket</strong> High<br />

School) may be used only when prior permission is sought. The THEATRE will make<br />

these arrangements if requested by the LICENSEE. The THEATRE makes no guarantee<br />

of the number of spaces available at any given time for use by the LICENSEE.<br />

Off site street parking is permitted on the east side of Pickering Crescent.<br />

Illegally parked cars in the THEATRE/school parking lots may be tagged <strong>and</strong>/or towed at<br />

the owner’s expense.<br />

If deemed necessary by the LICENSEE or the THEATRE CO-ORDINATOR or<br />

designate, parking attendants may be employed to monitor the parking for a particular<br />

event. These costs will be borne by the LICENSEE for that event.<br />

The THEATRE is not responsible for any loss or damage to persons or property, however<br />

caused, in the THEATRE’S parking lot.<br />
