Presidents Message<br />

Hope you are still enjoying<br />

the summer…<br />

sizzling hot days and<br />

all!! I am sure everyone<br />

is busy with their<br />

real estate business<br />

or taking some much<br />

needed time off for a<br />

vacation. Either way,<br />

we are in the throes<br />

of summer. But before we know it, it will<br />

be all over and back to school time again!<br />

July was a pretty light month for VPAR as<br />

it relates to events. We had a great Lunch<br />

& Learn by the Property Management<br />

Committee. That was very well attended. I<br />

would like to thank the committee, Governmental<br />

Affairs Director Susan Gaston<br />

for assisting them in getting the Hampton<br />

and Newport News city inspectors<br />

to VPAR. We held our social at the Crab<br />

Shack. Thank you Johnson Mortgage for<br />

their generous sponsorship! Congratulations<br />

to all of the door prize winners and<br />

50/50 Raffle winner!! Most of all in July…<br />

the roof installation has been completed.<br />

No more leaky roof when it rains, and we<br />

have happy tenants!<br />

I am so excited and looking forward to<br />

what is about to happen at VPAR in <strong>August</strong>!!<br />

We have another New Members<br />

Indoctrination Course scheduled on the<br />

7th with 25 newbies registered!! Again,<br />

we will do things in a roundtable style to<br />

change it up a bit. Sounds like VPAR is<br />

still growing!!!! The Technology Committee<br />

will be having a Lunch & Learn<br />

on the 16th regarding social media…<br />

“Digital Media on a Dime”! This class<br />

if for everyone no matter the skill set.<br />

There is always something new for<br />

everyone to learn! Plus, this class is a<br />

member benefit to you!! So make sure<br />

you RSVP for a head count, because lunch<br />

Second Quarter <strong>2017</strong> Home Sales Report<br />

According to the Second Quarter Home Sales Report released by the Virginia REAL-<br />

TORS®, the residential real estate market continued its rise over prior year benchmarks.<br />

The second quarter of <strong>2017</strong> saw 37,201 residential transactions closed, a 5.3<br />

percent increase over the 35,317 units sold in the second quarter of 2016. The value of<br />

those transactions was magnified by a rising median price, and totaled $13.091 billion,<br />

an increase of 9.2 percent from 2016’s second quarter volume of $11.986 billion. Relative<br />

to the second quarter of 2015, volume rose 20.2 percent (from $10.970 billion).<br />

The average number of days on the market dropped from prior year benchmarks to an<br />

average of 54 for the <strong>2017</strong> second quarter, 14.3 percent lower than last year’s second<br />

quarter average (63 days). Each month of the year so far has outperformed its 2016<br />

benchmark.<br />

Local Issues<br />

Britta Ayers, Manager of Comprehensive<br />

Planning for the City of Newport News, along<br />

with Planning Department staff, met with<br />

the Public Policy Committee at its June 11th<br />

meeting to review details of the current draft<br />

of the Comprehensive Plan for the City of<br />

Newport News. Of particular interest was the<br />

City undertaking a housing needs study to<br />

better guide planning for their future housing<br />

stock. The Plan continues to be reviewed<br />

and refined, and soon will be released to the<br />

public via a series of community town halls<br />

that will be held in late July. The Plan can be<br />

Comprehensive-Plan<br />

Mrs. Ayers also provided information regarding<br />

the Ft. Eustis Joint Land Use Study (JLUS).<br />

Both the Legislative Consultant and the CEO<br />

have been interviewed by the strategic planning<br />

firm that is leading this initiative. The<br />

JLUS process just has started. VPAR’s Legislative<br />

Consultant will represent the Association<br />

on the JLUS stakeholders’ group. More<br />

The Hampton Housing Needs Study/Market<br />

Analysis Update continues to advance<br />

with Dr. Tom Hall, who is working with REIN<br />

to retrieve the most current data. We also are<br />

working with Dr. Hall to update the Newport<br />

News housing study now that it is in its second<br />

year.<br />

At its June 14th meeting, Hampton City Council<br />

voted to expand the Rental Inspection Program<br />

in response Phoebus residents requesting<br />

to be included in the program. The City of<br />

Hampton and the City of Newport News will<br />

co-present details on their respective rental<br />

programs at the July 18th Lunch ‘n Learn.<br />

The Legislative Consultant continues to offer<br />

guidance to the residents of Aberdeen Gardens<br />

on their quest to form an HOA based on<br />

protecting the historical integrity of the neighborhood.<br />

The Consultant has communicated<br />

the issue to Sen. Mamie Locke and to Common<br />

Interest Community Board (CICB) Ombudsman<br />

Heather Gillespie.<br />

Isle of Wight County has begun its Comprehensive<br />

Plan Review process by holding<br />

a town hall on the needs and purpose of<br />

the Comp Plan. VPAR has been presented to<br />

the Board of Supervisors as an important<br />

stakeholder in the process. We anticipate that<br />

either the Legislative Consultant or a REAL-<br />

TOR® member will be appointed to the work<br />

group.<br />

VPAR members were treated to a wonderful<br />

morning on the water in June for the annual<br />

“RESIDENTIAL <strong>REALTOR®</strong> DAY” in Poquo-<br />

<strong>Peninsula</strong> <strong>REALTOR®</strong> page 13<br />

son. The cruise along Poquoson creeks and<br />

the Chesapeake Bay were the highlight of<br />

the day, but the City provided such beneficial<br />

information. From Mayor Gene Hunt to City<br />

Manager Randy Wheeler to Economic Development<br />

Director Dave Callis and his team, to<br />

the Police Department and the School Division,<br />

REALTORS® heard details about the<br />

City’s housing opportunities and businesses.<br />

State Issues<br />

Two legislative position statements were<br />

submitted by VPAR to VR for inclusion into the<br />

state association’s 2018 Legislative Agenda<br />

for the next General Assembly Session.<br />

o Enhanced Tenant Cleanliness Responsibilities<br />

o Use of Translator/Interpreter and<br />

Agent Liability/Fair Housing Implications<br />

The CEO and the Legislative Consultant participated<br />

in a conference call with VR regarding<br />

the 2018 <strong>REALTOR®</strong> Day on the Hill.<br />

The event will not take place in its usual format<br />

next year given the razing of the General<br />

Assembly Building and the legislative offices<br />

being moved to the Pocahontas Building for<br />

perhaps the next five years. This will open<br />

more opportunities at the local level for connecting<br />

with the <strong>Peninsula</strong> Delegation, and we<br />

will look to host a legislative forum or other<br />

legislative event at the beginning of 2018.<br />

Heather Gillespie, the Virginia Common Interest<br />

Community Board (CICB) Ombudsman<br />

will be the guest speaker! You will not want<br />

to miss this opportunity to learn all that you<br />

can about Property Owners Associations, their<br />

regulatory framework and how it impacts you<br />

as REALTORS® and as homeowners.<br />

Federal Issues<br />

VPAR and WAAR leadership will host its annual<br />

joint lunch meeting with Congressman<br />

Wittman on September 19th in Williamsburg.<br />

Efforts are underway to secure summer meetings<br />

with our other Members of Congress as<br />

well!<br />

The Legislative Consultant met on May 17th<br />

with Drew Lumpkin, District Director for<br />

Sen. Mark Warner, to discuss a variety of<br />

housing-related issues, including preservation<br />

of the MID and reauthorization of the NFIP.<br />

The Consultant has connected Drew to NAR’s<br />

Ken Wingert so that they can be in touch and<br />

provide more resources to the Senator, particularly<br />

at his request to be better educated<br />

on the NFIP.<br />

CFPB FINAL RULE CLEAR ON ABILITY TO<br />

SHARE CLOSING DISCLOSURES<br />

On July 7, <strong>2017</strong>, the Consumer Financial Protection<br />

Bureau (CFPB) released the final rule<br />

amending the “Know Before You Owe” (KBYO<br />

or TRID) mortgage disclosure rule. The final<br />

rule, supported by NAR, clarifies the ability to<br />

share the Closing Disclosure (CD) with third<br />

parties -- a victory for real estate professionals<br />

nationwide.<br />

As outlined in the 2016 proposed rule, the<br />

final rule highlights an existing exception<br />

within the Gramm-Leach-Bliley Act (GLBA)<br />

and implementing Regulation P that allows<br />

lenders to share the CD with third parties<br />

(sections 502(e)(1) and 509(7)(A)). The<br />

CFPB recognizes the CD as a “record of the<br />

transaction,” which is “informative to real<br />

estate agents and others representing both<br />

the consumer credit and real estate portions<br />

of residential real estate sales transactions.”<br />

The CFPB notes that CD sharing is permissible<br />

to the extent it is consistent with GLBA and<br />

Regulation P and is not barred by applicable<br />

State law.<br />

The final rule will be effective 60 days from<br />

publication in the Federal Register. Stay tuned<br />

NAR Submits Statement on Housing Finance<br />

Reform<br />

On June 29, <strong>2017</strong>, the U.S. Senate Committee<br />

on Banking, Housing & Urban Affairs held its<br />

first of several hearings of the year on housing<br />

finance reform. The hearing, entitled “Prin-<br />

ciples of Housing Finance Reform” consisted<br />

of three witness panelists from the Mortgage<br />

Bankers Association, Housing Policy Counsel<br />

of the Financial Services Roundtable, and<br />

Center for Responsible Lending.<br />

NAR submitted a statement highlighting<br />

that any new housing finance system must<br />

ensure that in all markets mortgage capital<br />

will always remain available for creditworthy<br />

Americans. Second, NAR stated that taxpayer<br />

dollars should be protected.<br />

Furthermore, in order to shield taxpayers and<br />

ensure a steady flow of capital into the mortgage<br />

market in both good times and bad, NAR<br />

urged lawmakers to convert the Enterprises<br />

into government-chartered, non-shareholder<br />

owned authorities that are subject to tighter<br />

regulations on products, profitability, and<br />

minimal retained portfolio practices in a way<br />

that ensures the protection of taxpayer monies.<br />

FOCUS ON FLOODING:<br />

THE LATEST LEGISLATIVE NEWS ON<br />

FEDERAL ACTIONS<br />

The National Flood Insurance Program<br />

(NFIP) is set to expire on September 30th<br />

without Congressional action. During the<br />

past month, there has been a lot of activity<br />

on Capitol Hill surrounding the reauthorization<br />

of the NFIP.<br />

NAR has been actively engaged in trying<br />

to shape various pieces of legislation in<br />

accordance with its position and principles,<br />

Here is the current state of play with just<br />

30 legislative days on the Congressional<br />

Calendar before September 30th.<br />

The House of Representatives<br />

The House Financial Services Committee<br />

(HFSC) has passed SEVEN BILLS https://<br />

financialservices.house.gov/uploadedfiles/061417_fc_memo.pdf,<br />

each one<br />

addressing a different component of the<br />

NFIP. NAR supported six of the seven<br />

bills and opposed H.R. 2874, “The 21st<br />

Century Flood Reform Act” sponsored<br />

by Rep. Sean Duffy (R-WI). You can read<br />

The HFSC is expected to combine the<br />

seven bills that passed the committee into<br />

a complete package for possible consideration<br />

by the full House sometime in July.<br />

NAR is currently opposed to this potential<br />

House package.<br />

While the package includes a 5-year reauthorization<br />

and private market reforms<br />

supported by NAR, a new provision has<br />

been added to end grandfathering after<br />

four years.<br />

Various other policy changes, combined<br />

with increased fees and new fees, make<br />

assessing the overall cost impact to consumers<br />

difficult.<br />

There are also concerns that the flood<br />

mapping reforms are inadequate.<br />

Special Legislative Report By Susan Gaston Hampton, Virginia -- The Vir-<br />

Mike Crapo (R-ID) and Ranking Member<br />

Sherrod Brown (D-OH) are working<br />

together to draft bi-partisan flood legislation<br />

they hope to consider in committee<br />

in July.<br />

Two other bi-partisan bills have been<br />

introduced in the Senate. Sens. Menendez<br />

(D-NJ), Kennedy (R-LA), Van Hollen<br />

(D-MD), Rubio (R-FL.), Warren (D-MA),<br />

Cochran (R-MS), Booker (D-NJ), and<br />

Nelson (D-FL) introduced S. 1368, “The<br />

Sustainable, Affordable, Fair and Efficient<br />

National Flood Insurance Reauthorization<br />

Act of <strong>2017</strong>.”<br />

Sens. Cassidy (R-LA), Gillibrand (D-NY),<br />

and Capito (R-WV) introduced S. 1313,<br />

“The Flood Insurance Affordability and<br />

Sustainability Act of <strong>2017</strong>.”<br />

NAR has not taken an official position<br />

on either bill.<br />

NAR continues to work with the sponsors<br />

of both bills to provide feedback on various<br />

provisions. It is expected that the legislation<br />

being crafted by Chairman Crapo<br />

and Ranking Member Brown will contain<br />

various elements of these two bills.<br />

What’s Next?<br />

• NAR estimates that past lapses of<br />

the NFIP have delayed or cancelled 1,400<br />

transactions PER DAY.<br />

• NAR will continue to work with<br />

the House on proposed changes to their<br />

package that would earn <strong>REALTOR®</strong> support.<br />

• Should a Call for Action be necessary,<br />

NAR will inform states as quickly as<br />

possible.<br />

The Virginia <strong>Peninsula</strong> Association of REAL-<br />

TORS® (VPAR) is pleased to announce the<br />

award of a $2,000 Virginia REALTORS®<br />

Community Outreach Grant that has been<br />

presented to the City of Newport News. Accepting<br />

the check on behalf of the City was<br />

Mayor McKinley Price, who offered appreciation<br />

to the members of VPAR and to the Association’s<br />

leadership.<br />

In partnership with the Association, the City,<br />

through its Communications Department,<br />

intends to use the funds to develop a video<br />

highlighting the City’s diverse housing stock<br />

and its neighborhoods, its cultural and educational<br />

assets, and its economic and employment<br />

opportunities, showcasing Newport News as a<br />

great place to live, work and play.<br />

Although Property Managers prefer to provide<br />

full-service management services (which<br />

is paid by a percentage of the monthly rental<br />

amount), many Property Managers also welcome<br />

“one time” management agreements.<br />

Do you work in the NEW HOMES division?<br />

Are you a sales agent taking advantage of opportunities<br />

as a DUTY AGENT? I bet you’ve<br />

come across your share of potential buyers<br />

that aren’t quite yet qualified to buy and/<br />

or have a home to sell in order to qualify for<br />

their next home purchase… BUT cannot sell<br />

it for whatever reason. When you’re working<br />

that new homes site or taking calls at the duty<br />

desk, and you’re faced with one of these conundrums,<br />

remember that property management<br />

has an option for you!<br />

When your New Homes site is getting walk-in<br />

traffic, not all prospects will ultimately turn<br />

into buyers right away… same with the duty<br />

calls coming in to any sales office. Maybe your<br />

prospect LOVES a particular home or just<br />

wants to upgrade to another home, but can<br />

only qualify if their current property is sold….<br />

OR RENTED (the rental income helps to offset<br />

the mortgage expense). Ask a Property Manager<br />

to do a comparative market analysis to<br />

“One time” managements are a specific service<br />

of procuring a qualified tenant only, for a<br />

flat fee, and allows the homeowner to manage<br />

their property themselves. It costs less than<br />

the full-service option, and the homeowner<br />

still gets a thorough & great start to the first<br />

tenancy in their property (applicants qualified,<br />

lease executed, property inspection with<br />

pictures, etc). Perhaps you’ve taken a duty<br />

call from a potential buyer but they don’t<br />

quite qualify for the amount of house they<br />

wish to purchase. This is an ideal candidate<br />

for one of our rentals where they can rent for<br />

a year while they build their credit and save<br />

for a down payment… AND get first right to<br />

purchase the home at the end of their tenancy<br />

if they’ve grown to love where they live.<br />
