GRANBY HISTORY THIS MONTH IN GRANBY HISTORY BY KEN KUHL GRANBY January 1807 — On the first Monday of January, 1807 the following Persons Ware Chosen Pettee Juries for the year Ensewing Chauncy Pettibone, Asa Cossit, James Huggins and Ebenezer Gossard Jr. The right to jury trial in criminal cases was among the few guarantees of individual rights enumerated in the U.S. Constitution of 1789, and it was the only guarantee to appear in both the original document and the Bill of Rights. Even before the Declaration of Independence, the First Continental Congress's Declaration of Rights of 1774 had proclaimed the right to jury trial. The right to a trial by jury is deeply embedded in the American democratic system. Two types of juries serve different functions in U.S. trial courts: trial juries, also known as petit juries, and grand juries. A trial jury decides whether the defendant committed the crime as charged in a criminal case, or whether the defendant injured the plaintiff in a civil case. Trial juries consist of 6-12 people and the trials are generally public, but since jury deliberations are held in private, defendants have the right to appear, testify and call witnesses on their behalf. The final outcome is a verdict — in favor of the plaintiff or defendant in a civil case, or guilty/not guilty in a criminal case. A grand jury is presented with evidence from the U.S. attorney, the prosecutor in federal criminal cases. The grand jury determines whether there is “probable cause” to believe the accused individual has committed a crime and should be put on trial. If the grand jury determines there is enough evidence, an indictment is issued against the defendant. Grand juries consist of 16-23 people but proceedings are not open to the public. There is another difference: Defendants and their attorneys do not have the right to appear before the grand jury. The Fifth, Sixth and Seventh Amendments to the U.S. Constitution guarantee the right to a jury for all criminal cases and in all civil suits exceeding $20. In addition, the constitution of each state guarantees a trial by jury. In contrast, England, Scotland, Wales and Canada do not have such a standard, and those accused of less serious crimes (punishable by less than two years in prison) don’t have the right to trial by jury. These countries also use fewer civil juries; it is estimated that 80% of the world’s civil trials take place in the U.S. CONNECTICUT January 1807 — Abel Gridley, a descendant of Connecticut Gov.
