PARISH COUNCIL IMPLODES?<br />

Many people in the community will not be aware (or even care) that their Parish Council has essentially “imploded” to the<br />
point that it is no longer functioning on behalf of the community.<br />
How could this come about is the question that needs to be asked.<br />
It came about by the mass resignation of Parish Councillors in protest that the Council was not being allowed to run as it<br />
should.<br />
Since the “resignation “ of the long serving Parish Clerk Mary Barnett (watch this space) the then Chair Geoff Fielding has<br />
attempted to carry out the Clerk’s and his own duties pending the appointment of a new Clerk.<br />
Unfortunately some members within the council have made the work of the council much less unified than it would ideally<br />
be in working for the community as a whole.<br />
Some might say that is democracy whilst others might say ,self interest. That is for the community to decide at the ballot<br />
box.<br />
So, what is the position at the moment?<br />
The Parish Council essentially cannot function because they do not have enough councillors who have not resigned to meet<br />
the defined quorate numbers.<br />
What does this mean?<br />
It means that the remaining four councillors cannot hold meetings or make any decisions on behalf of the council.<br />
• They cannot hold PC meetings<br />
• They cannot comment on Planning applications<br />
• The cannot make payments<br />
• They cannot change anything<br />
• They cannot employ a Clerk or appoint a chair<br />
What is the solution?<br />
We are told that Herefordshire Council has the power to appoint a member(s) of the council so that they become quorate<br />
and can again function.<br />
Under the Local Government act 1972<br />
91 Temporary appointment of members of parish and community councils.<br />
(1)Where there are so many vacancies in the office of parish or community councillor that the parish or community<br />
council are unable to act, the district council [F1or Welsh principal council] may by order appoint persons to fill all<br />
or any of the vacancies until other councillors are elected and take up office.<br />
No time frame has yet been given so it could be some time before the PC is again working fully for the community.<br />

.Cradley Parish Council Update as at 16 th November 2017<br />
In view of recent events regarding the Parish Council, here are the facts as currently known:<br />
16th Nov 2017<br />
1. The Parish Clerk resigned on 23 rd August 2017.<br />
2. Since 1 st October 2017 eight parish councillors have resigned, including the Chair and Vice-Chair.<br />
3. These resignations resulted in the Council being inquorate and therefore unable to meet and make any decisions. The current establishment<br />
of the Council is fifteen, and, to be quorate, a third of the establishment must attend a meeting. There are only four remaining councillors.<br />
4. With no clerk and an inquorate Council, the Lengthsman, Jeremy Phillips, has not been able to have any direction to do any work since the end<br />
of October (as per his contract with the Council and connected insurance factors), so his activities for the Parish are necessarily suspended for<br />
the time being.<br />
5. The fact that the Council is inquorate has also resulted in a delay in the recruitment process for a new parish clerk. This can recommence<br />
after the next quorate meeting.<br />
6. The Council’s public liability insurance is in place and the insurance company is fully briefed on the current situation.<br />
7. In the current circumstances, Herefordshire Council has the power to make an order to appoint county councillors to the Parish Council to<br />
make it quorate – this process takes some time to put in place, but we can confirm that there are now county councillors allocated.<br />
Therefore, the next Parish Council meetings can be quorate by this means, and the arrangement will continue until new parish councillors can<br />
be elected to some or all of the vacancies…………………..<br />

8. The next Parish Council meeting is scheduled for:<br />
WEDNESDAY 29 NOVEMBER at 7pm in<br />
CRADLEY VILLAGE HALL<br />
[NB: Venue is not Storridge Village Hall as that is<br />
unavailable that evening]<br />
9. As already stated on the website, as a temporary measure, any written correspondence to the Parish Council may be sent to<br />
Councillor Wynne Harries, 6 Oaklands, Cradley WR13 5LA 01886 880 976. Any of the other three parish councillors would also<br />
be very happy indeed to take any queries that you may have: Councillor Simon Davies 01886 880 074, Councillor Alan Eldridge<br />
01886 880 381, and Councillor Bruce Herriot 01886 880 146.<br />
10. An election for the vacancies is likely to be held in January 2018, but please check public announcements on this in due course<br />
to confirm that. There will be public notices in Cradley and Storridge, and you can also check the Herefordshire Council website for<br />
information on parish councillor vacancies.<br />

PLANNING PLEA 16th Nov 2017<br />
Whilst the ins and outs and rights and wrongs of recent resignations within the Parish Council (YOUR Parish Council) are<br />
discussed and resolutions sought it is not until something disappears or doesn’t do its job that the majority of people<br />
suddenly notice something, they may have taken for granted and expected, isn’t delivering the goods any more.<br />
“What no bus service!” I hear the cry “where has it gone and why”?<br />
So it is with the PC, which to the most part gets on with the job in hand, in the background, working on behalf of the<br />
community, labour provided by volunteers from that community.<br />
What are the implications of a non-working PC?<br />
Many and varied and a good indication of the unsung work carried out by the PC for this community.<br />
If the PC cannot operate, decisions cannot be made on behalf of the community,<br />
One thing that can be and should be taken on by the members of the community is<br />
PLANNING APPLICATIONS IN CRADLEY AND STORRIDGE<br />
It is the right of every member of the community to pass comment (for or against) on applications made to<br />
Herefordshire Planning department .<br />
It isn’t difficult to do. You can go to the Parish Council web site at www.cradleyparishcouncil.org.uk and go to the<br />
planning page where you can follow the instructions and see all of the planning applications made and examine drawings<br />
and comments. You can comment online or send a letter or email with your opinion.<br />
If you are really keen you can sign up to receive notice of planning applications and decisions by email.<br />
Don’t let applications slip through whilst the Parish Council is unable to comment. Until, and after the PC is returned to<br />
normal working it’s up to YOU<br />

PLANNING UPDATE<br />
The Parish Council have just published their agenda for the meeting on 29th<br />
November and it confirms that they WILL now be discussing outstanding planning<br />

the whole thing that presented by the Parish Council.<br />
As the PC is at the moment not quorate and unable to function we will have to await the next<br />

Did she resign, of her own choice? Is there a connection between hers and the mass resignations<br />

It has been brought to my notice that reference is being<br />
made in several places to my resignation from the Parish<br />
Council.<br />
It was not a “resignation” but an “enforced resignation”<br />
that took place.<br />
Matters regarding this situation are ongoing.<br />

APPLICATIONS FOR NEW CLERK<br />
It has been brought to the Enquirers attention that a Parishioner contacted the HALC offices to<br />
apply for the Clerk vacancy on the Parish Council. When making contact as instructed on the PC<br />
website they were told by Lynda Wilcox (HALC) that as from yesterday applications were not being<br />
received and therefore could not send out any forms to the person in question.<br />
TWO QUESTIONS ARISE:<br />
1) Why was the advert on the website not changed to show a closing date to inform potential<br />
applicants ?<br />
2) Who specified the closing date and when was it specified ?<br />
COME ON PC<br />
Communicate with the community. It’s not that difficult is it to be open, truthful and transparent<br />

WHAT A SURPRISE!<br />
Within hours of the above posting being sent to the Parish Council for their comments (of course there<br />
were none) magically again, the notice inviting applicants for the vacancy for Parish Clerk disappears<br />
from the PC website.<br />
Astounding that the Parish Council will not communicate with the Enquirer despite having our contact<br />
details but they appear to be taking note of the points raised here on this website by the Enquirer on<br />
behalf of the community. Well there is of course more than one way to get the message across<br />
It is a shame that they have become a somewhat “secret society” not communicating with anyone<br />
rather than being open, transparent and honest with the people of this Parish.<br />
Worse still they seem to feel that they are above answering questions from those that they are here<br />

Councillor’s Resignations?<br />
It appears that 8 members of the Parish Council tendered their resignations to the PC after the<br />
aborted Extra Ordinary meeting called on the 23rd October 2017<br />
As no minutes have been published and no information has been forthcoming from the council there is,<br />
we feel an urgent need for the community (whom the PC serves) to have the facts<br />
Perhaps enlightenment from those who resigned would let people know why they felt that they had to<br />
take such an action.<br />
For one councillor who has served this Parish faithfully for over 50 years, through thick and thin, to feel<br />
his resignation was necessary surely proves that there is more to this than simple resignations<br />
The enquirer will happily reproduce any resignation letter that is forwarded to us if it sheds light on what<br />
has gone on within OUR Parish Council<br />

Following my resignation as Vice chair 0n the 24 th October I have had a few sleepless<br />
nights wondering how we had got to the position we are now in. I joined the council to<br />
work for the good of the community and to help bring Cradley and Storridge more closely<br />
together, I had no hidden agenda. However a minority of the CPC do not appear to share<br />
the same values and with the resignation of the Chairman and the unhelpfulness of HALC<br />
over the past few weeks I feel the situation will only escalate. Therefore it is with regret<br />
that I feel I have no alternative but to resign. Please accept this letter as my official<br />
resignation as of the above date.<br />

Dear colleagues 02 /11 / 2017<br />
Having now had time to reflect on the past few weeks of the CPC and to check the facts that were<br />
presented to an EO meeting of the CPC on 23 rd Oct, I would like to set the records straight, hence this<br />
letter to you all.<br />
Firstly the background to the calling of the EO.<br />
The above meeting was called because at the last CPC meeting on the 10 th October 2017 the correct<br />
procedures for the appointing of a new Parish Clerk had not been followed, due to advice from Linda<br />
Wilcox (LW). This took place at 2230hrs so was not challenged then as councillors were still reeling from<br />
the shock announcement by the Chairman (GF) regarding the background to the recent resignation of the<br />
Council’s Clerk.<br />
Following a complaint to GF by myself, he decided to call an EO on the 23rd October and all the Councilors<br />
were informed of the meeting on the 14 th October.<br />
At 1635hrs on the day of the meeting the Chairman received a copy of an email sent to Councilor Eldridge<br />
(AE) in reply to his conversation and email that day to LW concerning the legality of the EO. The email<br />
indicated that as the meeting had not been advertised on the CPC web site and notices had not been<br />
placed on notice boards that any decisions made would be null and void. It was too late to cancel the<br />
meeting so GF agreed to meet everyone and explain the reasons for the cancellation. The contents of the<br />
email were confirmed by AE<br />
It astounds me that AE waited until the day of the meeting before he contacted LW you can read into that<br />
what you will, I could understand if he had contacted LW after first being notified of the meeting and only<br />
receiving a reply on the day. But to leave it to the very day seems a little mischievous to me. He did<br />
however admit at the meeting that “they get on well together” [i.e. AE & LW] as he had contacted her on<br />
numerous occasions<br />
Secondly:<br />
LW was asked to take the minutes for the September Meeting of CPC, which she did .<br />
6At that meeting, Council decided to reject the recruitment of a new Clerk by the Employment Working
Group of CPC, in favour of AE’s advice to use the recruitment services of LW at HALC. A vote was taken<br />
and LW accepted the brief and told council that it would cost £200.<br />
LW continued to act as Minute taker at the Council’s October meeting.<br />
The September Minutes took nearly three weeks to produce and those for October have still not been<br />
received as of yesterday 31 st October.<br />
GF had been chasing LW for nearly seven weeks for information regarding the recruitment of a New Clerk<br />
but didn’t receive replies to phone calls or emails.<br />
Surprisingly, AE informed Councillors at the EO that LW had told him that there were three applicants and<br />
that the interviews were set for 27th October.<br />
Firstly it is bizarre that AE should know about the applicants before GF and secondly that he should have<br />
his conversation /email replied to by LW on the same day whereas GF had waited three to seven weeks for<br />
replies and not received any .<br />
AE had the opportunity to ask GF if EO Notices had been placed but chose not to. I have checked the web<br />
page and seen documented evidence that the notice was on the CPC web site in the allotted time and that<br />
notices were displayed on the notice boards.<br />
Fellow Councillors are aware of the outcome following the intervention by AE and his email. What we don’t<br />
know is that if the truth had been known and the meeting had proceeded, just what the outcome then would<br />
have been.<br />
Perhaps the Council wouldn’t have collapsed and we would still have a Chairman and not a mass<br />
resignation for various reasons and the lengthsman would still be in place, Now we will never know.<br />
It saddens me to see the CPC collapse; I joined the council with no hidden agenda to work for the good of<br />
the community both in Cradley and Storridge and to help bring the two communities together. I am sure this<br />
is what the majority of councillors wanted but unfortunately there is a minority there with either a hidden<br />
agenda or who can’t be bothered to attend and have no role on any of the working groups, but are quick to<br />
criticise and obstruct whenever possible.<br />

In the light of recent events, I tender my resignation from the Parish Council effective immediately.<br />
The departure of the Chair is another negative event that has affected our PC as a result of the<br />
actions of individuals who have for the past 3 years executed a campaign to sabotage and<br />
undermine the leadership of the PC and any other members of the PC that they consider do not<br />
support their single <strong>issue</strong> obsession. With this most recent action, my remaining on the PC is<br />
untenable.<br />

Setting the record straight 6 th November 2017<br />
Dear Alan, (Eldridge: Ed)<br />
Thank you for the reply to my email, which I have read, digested and totally disagree with for the following<br />
reasons.<br />
1 - You state - The appointment of Clerk is one of the most important decisions the Council can make. I and<br />
others were concerned that (Fielding: Ed) might have been too keen to employ his preferred candidate as Clerk.<br />
This statement questions not only my integrity and that of Fred Beard (50years a Councillor) as we were both<br />
elected onto the Employment Working Group but suggests that we would have voted in favour of Geoff’s<br />
preferred candidate. I can assure you that I am more than capable of deciding outcomes for myself, as I am sure<br />
Fred is.<br />
2 - You say that - It was a good thing that the Council made the decision to appoint Wynne (Harries) and Anne<br />
(Scarsbrook)to the interview panel alongside Geoff because both Wynne and Anne have served as senior<br />
managers in local authorities for many years and are therefore highly experienced in appointments in this context.<br />
There are two <strong>issue</strong>s here, firstly the Council did not appoint Wynne and Anne as I recall but you did.<br />
Secondly, I also held a senior position in the NHS and was trained in selection and recruitment procedures<br />
annually and successfully appointed senior personnel over many years.<br />
3 - You say - The decision to appoint the interview panel was properly made by the Council and therefore,<br />
according to our standing orders, should not be revisited for six months. Tabling a motion to overturn the decision<br />
was plainly wrong. This statement is completely wrong, as mentioned above you selected Wynne and Anne<br />
and at some stage Geoff was asked if he would like to sit on the interview panel. No vote was taken in Council.<br />
The decision at the October meeting was not valid and the outcome was therefore null and void. The Employment<br />
Group was appointed at the Annual Meeting on the 9 th May and this cannot be Revisited, as set out in our<br />
Standing Orders, before 6 months have lapsed [i.e. 9 th November].<br />
Any changes [to the Employment Group] must be the subject of a resolution which has been itemised as an<br />
Agenda Item for a Full Council Meeting. No such agenda item was on the October Agenda prepared by HALC<br />
.The Employment Group is responsible for all employment matters including the selection of the Parish Clerk .<br />
Any recommendation would then be presented to full Council, by the Employment Group, for approval and a vote<br />
taken and minuted.<br />
4 - You say - Tabling a motion to overturn the decision was plainly wrong. As soon as I saw it, I thought I should<br />
seek advice and so I contacted Lynda. (Wilcox) The day following the meeting on the 10 th I complained to Geoff<br />
that the correct procedure had not been followed and explained my reasons why, hence the EO being called on<br />
the 20 th . The agenda went out on the 14 th yet you say you contacted HALC as soon as you saw it. In truth you<br />
contacted her the day of the meeting which was six days later, clearly a little twist on the truth I would say.<br />
5 - You say - If your claim is correct - that ‘notices were displayed on the notice boards, then someone removed<br />
them very quickly, without removing any others – unlikely but possible; and why was nothing said by Geoff or<br />
anyone else after the 4.30 email was received, that they actually had been placed on the notice boards and the<br />
website? That is puzzling in itself. With this statement I assume you had checked all notice boards prior to the<br />
meeting to disprove my statement, you also said that Lynda or you had checked the web page and the notice<br />
wasn’t on , however I have documented evidence to show it was. The Storridge one was in place for sure which<br />
is the farthest away. The reason Geoff didn’t pick up on this was because when he received the email and had<br />
digested it, he called me and asked me to meet him at the hall. When I arrived he showed me the email and said,<br />
“That’s it I have had enough, I am going to resign” I convinced him to stay for the meeting and agreed to read the<br />
email out, you know the rest, it is in his resignation letter.<br />

6 - You say - I actually didn’t think the advertising of the meeting was such a big <strong>issue</strong>, and the email pointing<br />
out that the meeting would not be lawful did not come from me. This must have been a big <strong>issue</strong> for you as<br />
you instigated the email which prevented a legitimate meeting taking place.<br />
7 - You state- I am heavily involved in The Heart of the Village project which takes a great deal of my time.<br />
This is a project for the Village not supported by many of you I know, but please remember that it is supported<br />
by hundreds and hundreds of people in this parish. I resigned from the other working groups because of the<br />
time taken up with HOV.<br />
We agree on the first sentence; however HOV is not council business. I recall that you attended a Seminar in<br />
Hereford with Geoff and myself and used the opportunity at the end of the seminar to speak with Claire Ward<br />
regarding HOV and informed Geoff and myself about your discussions on the return journey<br />
Your last sentence says it all. This put a lot of pressure on other councillors as they had to pick up on the work<br />
which you decline to help with. This along with councillors who hardly bother to regularly attend doesn’t bode<br />
well for the future.<br />
Finally - If as you say you are that busy with your business and the HOV with little time for the Council then<br />
perhaps you should consider giving something up. I trust this now clarifies the <strong>issue</strong>s you have raised...<br />

Cradley Parish Council A Time to Take Stock<br />
Regular readers of our Parishes Newsletter will no doubt recall previous <strong>issue</strong>s in which I wrote under the<br />
title Cradley Combings. The gist of my articles was simply to express my absolute belief in the value of<br />
village life, for the care of our community and our villagescape and to express my enduring appreciation<br />
of the extensive wildlife of the parish.<br />
Those of you who take an interest in the work of Cradley Parish Council will also be cognisant with<br />
several of the major <strong>issue</strong>s with which the council and its Councillors have engaged in recent years. In<br />
planning terms, the most significant <strong>issue</strong>s surrounded the Neighbourhood Development Plan, the Heart<br />
of the Village Project, the Pixiefield Development and the Church Stile Development project.<br />
First as a Councillor and latterly as Chairman of the Council I served the community for five years before<br />
resigning in October. My work for the community is well known, especially the three years which I have<br />
devoted to caring for our parish Infrastructure, its public footpaths, highways and byways and so on.<br />
As a child of the post-war era, I was brought up by parents who held the firm view that democracy<br />
should be the foundation stone of community life and national cohesion. I truly believe in the principles<br />
of democratic governance. This includes the governance of a parish council or any other community body<br />
which purports to represent a community.<br />
Alas, democracy is not a perfect concept. For democracy to work there is a fundamental necessity for<br />
give and take and for compromise. Only in this way can democratic institutions deliver their mandates.<br />
In the case of local authorities and local parish councils the democratic principles are enshrined within<br />
the seven Nolan Principles to which every Councillor in the kingdom has signed up to adhere to . Those of<br />
Selflessness, Integrity, Openness, Accountability, Honesty, Leadership and Objectivity.<br />

When individuals with community responsibilities transgress those golden principles and place personal<br />
interests before those of the community, then compromise can be subsumed, consensus evaporates,<br />
democracy fails, and the nett result can be unhappiness at all levels and obfuscation of the important<br />
work of a council. A whole community may have its expectations failed.<br />
It was from this standpoint that an enthusiastic and engaged parish chairman resigned.<br />
Following my resignation an en-masse resignation of Cradley councillors occurred. I for one can only hope<br />
that the future direction of the Council is one with adherence to the principles of a democratic mandate, executed<br />
in a collegiate manner and in a spirit of consensus and compromise.<br />

SEEN THE SIGN?<br />
23rd Nov 2017<br />
A rumour appears to be spreading in Cradley regarding a pantom sign which is reported to have<br />
appeared on the new notice board opposite the Cradley Stores and Butchers on Bosbury Road.<br />
Nothing unusual about that, a notice on a notice board, but the fact that it has been rumoured that it<br />
was encouragging people to boycott the Stores opposite does in the Enquirers opinion exceeds what<br />
acceptable in a civilised community.<br />
So can anyone who actually saw this “posting” before it was removed (or even put it up) let us know<br />
what it said or verify its contents.<br />

From The PC (apparently)<br />
The Enquirer has asked the PC the questions posed by it’s contributers. They were sent to Mr Harries as<br />
the apparent contact point for the PC which is at this date still ineffectual due to not being quorate.<br />
The questions were asked as they were sent to us but names witheld on the request of those asking.<br />
This is the reply received by the Enquirer:<br />
The Parish Council has long had the practice of not responding to anonymous correspondents, and<br />
therefore I would suggest that you encourage your correspondents to contact us directly with any<br />
query. This equally applies to the editorial team of the Enquirer of course.<br />

Now this seems very strange in that the Enquirer was fully identified in the request and Simon, our stand<br />
in editor (until our team is complete) used his mailbox rather than the editors mailbox to contact Mr<br />
Harries.<br />
None the less we requested that Mr Harries furnish us with what criteria they use for branding<br />
correspondence as “anonymous” and therefore not responded to? No surprises that no guidance has<br />
been forthcoming.<br />
Now to the description in Mr Harries email of PC practice. Our investigations show that whilst this on the<br />
surface may seem to be correct it is in fact very misleading.<br />
True in the past the PC have had instances of anonymous letters sent to them it is not true that they are<br />
not responded to They may not be replied to (lack of contact details) but they are all read to councillors<br />
and if relevant, responded to.<br />
As the questions were able to be responded to why are the PC (according to Mr Harries) refusing to<br />
answer questions posed by members of the community?<br />
Are the Parish Council not there to work on behalf of the community that elected them. Are they not<br />
obliged to answer questions from that community?<br />
Seems that despite refusing to respond and answer the questions posed by members<br />
of the community the Parish Council have seen the validity of two of those questions<br />
and in fact changed the PC meeting to what it should be<br />

Well they are half way there. All they now have to master is the art of responding<br />
openly to those who they are supposed to represent and be as they are supposed to<br />

Seems like the Malvern Gazette reads the Enquirer these days and is prepared to<br />
respond to questions asked by the community which is more than Cradley’s own<br />

The Long awaited minutes of the Parish Council meeting held on 10th October have at long last been<br />
published on 24th November.<br />
EDITOR<br />
Now bearing in mind that on advice from HALC (the guiding body for Parish Councils in Herefordshire Fee paid<br />
of course) Minutes of PC meetings should be published in draft form within a few days of the meeting to which<br />
they refer.<br />
The strange thing is that the person that is being paid to take and produce the minutes for Cradley Parish<br />
Council whilst they have no Clerk is not only the same person as stated that draft minutes should be published<br />
as soon as… but also the same person who took several weeks to produce the September minutes referred to in the ex<br />
chair’ submission here.<br />
Now that is rather strange and not too efficient to be acceptable.<br />
NOW, within PC procedures for meetings the minutes of the last meeting are checked by Councillors and the chair and<br />
when agreed or amended, signed off as a true record of the meeting held.<br />
NOW THE QUESTION: If only two members of the new PC were present at the previous meeting (and possibly the new<br />
chair wasn’t) can the minutes be signed off?<br />
We have already received notification (also sent to Mr Harries of the PC) pointing out a serious error in those minutes by<br />
someone who WAS present.<br />
We await the Parish Council’s action<br />
as they will not apparently answer any questions from the Enquirer<br />
October minutes<br />
Review of Standing Orders<br />
It was RESOLVED that HALC be requested to double check the content of the draft Standing Order, in<br />
readiness for adoption at the next meeting.<br />
This is untrue, AE said he had not read all the documents that had been circulated and<br />
forwarded a motion to leave the draft standing orders until the new Parish Clerk was<br />
appointed. This was voted on and agreed.<br />
13.3 New clerk … It was RESOLVED to hold interviews for the new Clerk/RFO (Responsible Financial Officer)<br />
on 27th October, subject to hall availability. The interview Panel would be:<br />

PC ignore the facts presented<br />

UPDATE 28/11/17<br />
At the EO meeting held on 29th November the above evidence presented by an ex Parish Councillor<br />
was totally ignored and the minutes were signed by the new chair on the vote of only two<br />
councillors who were actually at the meeting. As stated one was the maker of the mistake who<br />
chose to ignore his mistake and the other was the one informed of the mistake<br />
Arrogantly the minutes were falsely signed and should never have been accepted<br />
Shameful on the part of those involved and on the stand in “Clerk” who never challenged the<br />
signing<br />
Is this the standard of professionalism that the community has to put up with?<br />
