Meza Delivers Message of Oversight of Industry<br />

and Cooperation by CDI at April SCA<br />

The Sacramento Claims Association<br />

was pleased to present Mr. Peter<br />

Meza, of the California Department<br />

of Insurance, as our special guest<br />

speaker for the April 12, 2018 educational<br />

luncheon meeting.<br />

Mr. Meza, who came up through<br />

the industry, with extensive stints as<br />

both a claims adjuster and an agent,<br />

is now an Associate Insurance Compliance<br />

Officer with the CDI. He focused<br />

a good part of the first segment<br />

of his presentation on the inner workings<br />

of the DOI, providing some new<br />

good information for all involved, adjusters<br />

and vendors, regarding claims,<br />

and some of the department’s priorities<br />

in oversight of regulations. He<br />

explained the importance and necessity<br />

of claims personnel setting reserves<br />

for their losses.<br />

Mr. Meza also spent some time<br />

discussing a new diversity initiative<br />

program. The CDI’s web site<br />

explains that “The Insurance Diversity<br />

Initiative (IDI) was established<br />

by Insurance Commissioner<br />

Dave Jones in 2011 in an effort to<br />

focus on diversity issues within<br />

California’s $310 billion insurance<br />

industry.” Meza showed stats outlining<br />

some of the results of surveys<br />

they’ve done of registered<br />

carriers in the state.<br />

“Setting reserves is a big deal for<br />

claims adjusters,” he said. Each<br />

claim must have established parameters<br />

that binds the carrier to the value<br />

of their collective losses. From a<br />

vendor standpoint, that means that estimates<br />

on repairs must be as accurate And, in his conclusion, he touched<br />

as possible for the adjuster to properly on “Proximate Cause Law”, statdo<br />

Commissioner sponsored bills addressing underinsurance for disaster survivors clear Committee<br />

SACRAMENTO, Calif. — Insurance Commissioner Dave Jones announced<br />

that two bills he sponsored which are designed to help prevent homeowners<br />

from being underinsured when disaster strikes passed the Assembly Insurance<br />

Committee today with a unanimous, bipartisan vote. Assembly Bill 1797<br />

(Levine) and Assembly Bill 1875 (Wood) will help homeowners avoid being<br />

underinsured-a terrible problem faced by many survivors of the 2017 fires.<br />

“These bills are designed to help fire and mudslide survivors avoid the huge<br />

financial burden of being underinsured and unable to afford to rebuild by tens<br />

of thousands or hundreds of thousands of dollars,” said Commissioner Jones.<br />

“They offer California consumers more peace of mind knowing that if disaster<br />

strikes their insurance coverage should be sufficient to cover the costs of rebuilding<br />

and they will be able to move forward with certainty. I am pleased the<br />

Assembly Insurance Committee recognized the need for this legislation and<br />

am hopeful the full Legislature will agree and pass these important consumer<br />

protection bills.”<br />

Underinsurance is one of the most significant problems facing fire and mudslide<br />

survivors in the aftermath of the 2017 firestorms. According to a survey conducted<br />

by United Policyholders following the 2017 North Bay fires, 66 percent<br />

of survivors were underinsured on the dwelling portion of their claim and 47<br />

percent were underinsured on the contents portion of their claim.<br />

AB 1797 is aimed at making sure that homeowners are given an updated replacement<br />

cost estimate for their home. Current regulations require a complete<br />

and comprehensive estimate of the cost to replace a home when a replacement<br />

estimate is provided by the insurer, but state law does not mandate that insurers<br />

produce or regularly update a replacement cost calculation.<br />

AB 1797 would require insurers to either provide a policyholder with a full<br />

replacement cost estimate every other year or apply an inflation factor to the<br />

dwelling limit at each renewal and clearly offer the consumer the option to<br />

obtain a full replacement cost estimate.<br />

AB 1875 addresses confusion surrounding extended replacement cost coverage<br />

(ERC). Almost all insurance companies offer ERC, which allows property<br />

owners to purchase limits above the replacement cost policy limits, which are<br />

typically based upon the insurance company’s estimated cost of replacement.<br />

However, those ERC limits can vary dramatically from the low of a 20 percent<br />

option to higher options of 50, 75, or 100 percent. Many consumers are never<br />

provided these options by insurers nor are they told how the coverage options,<br />

if available, would impact their premiums. AB 1875 would require an insurer<br />

who does not provide at least 50 percent ERC to help direct the consumer<br />

to an insurer that does. This will give consumers reasonable options against<br />

underinsurance.<br />

Commissioner approves first coverage to protect property owners leasing to cannabis industry<br />

SACRAMENTO, Calif. — Insurance Commissioner Dave Jones announced<br />

May 1, 2018 that he has approved the first insurance coverage for commercial<br />

landlords that addresses risks specific to renting to cannabis businesses.<br />

California Mutual Insurance Company is the first insurer in the state approved<br />

to add Lessor's Risk coverage for property owners who are exposed to specific<br />

risks resulting from cannabis related business activities of their commercial<br />

tenants.<br />

"As Insurance Commissioner, my goal is to make sure all Californians have<br />

insurance protection-including the legalized cannabis businesses in California,"<br />

said Commissioner Jones. "I want to make sure that when consumers shop in<br />

cannabis businesses, when investors and owners invest in cannabis businesses,<br />

when vendors sell to cannabis businesses, and when landlords rent to cannabis<br />

businesses, there is insurance coverage available to cover everyone from losses.<br />

I encourage more insurance companies to follow California Mutual Insurance<br />

Company's lead and file insurance programs to fill the gaps in coverage for<br />

the cannabis industry."<br />

Lessor's Risk coverage provides liability and property insurance for commercial<br />

property owners who lease building space to commercial tenants. Specific<br />

commercial activities and businesses addressed by this coverage include<br />

cannabis labs, product manufacturing, cultivation, and dispensary operations.<br />

Commissioner Jones launched an initiative last year to encourage commercial<br />

insurance companies to write insurance to fill coverage gaps for the cannabis<br />

industry. As a result of Jones' initiative, the first filing and approval of commercial<br />

insurance for the cannabis industry was announced in November of last<br />

year and the first surety bond program for the industry was announced in February.<br />

Today's announcement is another first - the first insurance for commercial<br />

landlords renting to cannabis businesses. The availability of this insurance<br />

will reduce barriers to obtaining leased space faced by the cannabis industry.<br />

Last week, Commissioner Jones renewed his call for insurers to offer insurance<br />

products for California's legalized cannabis industry in the wake of published<br />

reports that President Trump has abandoned Attorney General Jeff Sessions'<br />

policy on federal law enforcement of cannabis. Jones sent a formal letter to<br />

California insurers encouraging them to fill insurance gaps for California's<br />

cannabis businesses. Jones has convened meetings between commercial<br />

insurance executives and cannabis business owners to educate the insurance<br />

industry about the sophistication, professionalism and risk management of the<br />

cannabis industry. Jones has also organized tours for insurance executives at<br />

cannabis businesses.<br />

In October of last year, Jones held a first-in-the-nation public hearing to<br />

identify insurance gaps faced by the cannabis industry. Cannabis businesses<br />

and insurance industry representatives testified about the limited availability<br />

of insurance for cannabis businesses. The hearing revealed that while there is<br />

insurance available from surplus lines insurers, coverage is limited in scope<br />

and, until the approval announced last November, commercial carriers were<br />

not yet writing insurance. Jones also announced that department staff would<br />

be allocated to expedite cannabis insurance filings.

Take in the morning air, so fine...<br />

“May Flowers”. I wrote a song by that name back<br />

when my dad was passing, in 2005. An insurance<br />

claims adjuster from way back, he had what I<br />

perceived as a somewhat rare opportunity to<br />

prepare for his end. Whether that meant reviewing<br />

his own case, or simply making the most of<br />

every last breath, I hoped he would embrace the<br />

opportunity, just as I would hope I could find within myself to do<br />

when my time comes. The task did not come easy for him.<br />

“Open your window one last time, take in the morning<br />

air so fine, go out on a high... May flowers bloom in bold,<br />

bright colors from red to gold, cast off your fears, let ‘em go.”<br />

I remember that song every year about this time, and perform it as a tribute<br />

to him whenever I get the chance. Best I can say is, make the most of your<br />

days. We all strive to be better people and, for those in this industry arguably<br />

more than many others, helping others in their time of need is what you do.<br />

Take time to enjoy, and experience all you can.<br />

The Sacramento Claims Association Membership Committee would like<br />

association. Member dues provide a significant financial support to the<br />
