The name of any person nominated in this manner shall be placed upon the ballot by the<br />

board as a regular candidate. Names of other eligible candidates may, at any election for a retirant<br />

member of the board, be substituted for the regular candidates by writing the names of such<br />

persons upon the ballot. The candidate who receives the highest number of votes for any term as a<br />

retirant member of the board shall be elected to office on certification of the election results in<br />

accordance with rules adopted under section 145.058 of the Revised Code.<br />

Sec. 145.051 Board member inability to assume office<br />

If a person elected to serve on the public employees retirement board is unable to assume<br />

office at the January meeting of the board following the person's election, a special election shall<br />

be held in accordance with the provisions of section 145.05 of the Revised Code within three<br />

months of the January meeting. On certification of the elections results, the newly elected person<br />

shall assume office at the meeting of the board immediately following the special election.<br />

Sec. 145.052 Election exception<br />

Notwithstanding sections 145.04 and 145.05 of the Revised Code, the Public Employees<br />

Retirement Board is not required to hold an election, including a special election under section<br />

145.06 of the Revised Code, for a position on the board as an employee member or retirant<br />

member if only one candidate has been nominated for the position by petition in accordance with<br />

section 145.05 of the Revised Code. The candidate shall take office as if elected. The term of<br />

office shall be four years beginning on the first day of January following the date the candidate was<br />

nominated.<br />

Sec. 145.053 Board election campaign finance disclosures<br />

(A) As used in this section:<br />

(1) “Campaign committee” means a candidate or a combination of two or more persons<br />

authorized by a candidate to receive contributions and in-kind contributions and make<br />

expenditures on behalf of the candidate.<br />

(2) “Candidate” means an individual who has been nominated pursuant to division (C) or<br />

(D) of section 145.05 of the Revised Code for election to the public employees retirement board or<br />

who is seeking to be elected to fill a vacancy on the board pursuant to section 145.06 of the<br />

Revised Code.<br />

(3) “Contribution” means a loan, gift, deposit, forgiveness of indebtedness, donation,<br />

advance, payment, transfer of funds or transfer of anything of value including a transfer of funds<br />

from an inter vivos or testamentary trust or decedent's estate, and the payment by any person other<br />

than the person to whom the services are rendered for the personal services of another person,<br />

which contribution is made, received, or used for the purpose of influencing the results of an<br />

election to the public employees retirement board under section 145.05 of the Revised Code,<br />

including a special election provided for by section 145.051 of the Revised Code, or the results of<br />
