Because of ris<strong>in</strong>g cost of liv<strong>in</strong>g and sav<strong>in</strong>g concerns, many people look for the best deal they can<br />

get. They often opt for cheaper and sometimes poor quality goods or counterfeits.<br />

It is also important to mention that Ch<strong>in</strong>ese counterfeiters and pirates do harm their<br />

country by hold<strong>in</strong>g back Ch<strong>in</strong>a’s own <strong>in</strong>novators and entrepreneurs. They also do harm to Ch<strong>in</strong>a<br />

by discourag<strong>in</strong>g foreign <strong>in</strong>vestments and technology transfers.<br />

Recent events like the export of contam<strong>in</strong>ated foods, fake drugs, toxic toothpastes and<br />

poor quality products that have motivated two recalls with<strong>in</strong> a month by the American toy<br />

company, MATTEL, will create additional mistrust of Ch<strong>in</strong>a’s regulatory regime 27 . However,<br />

the Ch<strong>in</strong>ese government has not hesitated <strong>in</strong> some occasions to demonstrate that corruption will<br />

not be tolerated <strong>in</strong> some regulatory agencies like the Ch<strong>in</strong>ese State Food and Drug<br />

Adm<strong>in</strong>istration (FDA). In fact, <strong>in</strong> July 2007, the former head of the Ch<strong>in</strong>ese FDA was executed<br />

for tak<strong>in</strong>g bribes but mostly for licens<strong>in</strong>g sub-standard drugs and <strong>in</strong>fant formula, which led to<br />

some fatalities 28 .<br />

Despite the challenges fac<strong>in</strong>g Ch<strong>in</strong>a on IPR issues, the government has made great<br />

improvements on IPR s<strong>in</strong>ce its accession <strong>in</strong> 2001 to the World Trade Organization. Ch<strong>in</strong>a has<br />

also shown that it can enforce national laws it has developed without any external pressure as<br />

illustrated by the one child, illicit drug and anti-government propaganda laws.<br />

Ch<strong>in</strong>a will need def<strong>in</strong>itely to improve IPR protection by reduc<strong>in</strong>g local protectionism, by<br />

better coord<strong>in</strong>ation of IPR development and enforcement among various government levels, by<br />

work<strong>in</strong>g with foreign and local companies that have <strong>in</strong>vested <strong>in</strong> the country to enforce IPR laws<br />

and by revis<strong>in</strong>g its legal and regulatory systems to ensure quality products.<br />
