<strong>Intellectual</strong> <strong>Property</strong> <strong>Rights</strong> <strong>Protection</strong> <strong>in</strong> Ch<strong>in</strong>a<br />
Accord<strong>in</strong>g to Mertha 2 , “<strong>Intellectual</strong> property refers to the protection of <strong>in</strong>tangible assets<br />
for a specified period of time <strong>in</strong> order to <strong>in</strong>duce and reward <strong>in</strong>novation and creativity while at the<br />
same time allow<strong>in</strong>g the public to enjoy the benefits of this <strong>in</strong>novative and creative behavior.<br />
Convention and <strong>in</strong>ternational agreements have been developed to protect <strong>in</strong>tellectual<br />
property. The Berne convention for the protection of literary and artistic works was first adopted<br />
<strong>in</strong> Switzerland <strong>in</strong> 1886. This led to the creation of the United International Bureau for the<br />
<strong>Protection</strong> of <strong>Intellectual</strong> <strong>Property</strong>, which became <strong>in</strong> 1967 the World <strong>Intellectual</strong> <strong>Property</strong><br />
Organization (WIPO). As of April 2007, 163 countries are parties to the Berne Convention. All<br />
members of the World Trade Organization are required to accept almost all of the conditions of<br />
the Berne Convention because of the Trade related <strong>in</strong>tellectual Properties agreement (TRIPS).<br />
The People’s Republic of Ch<strong>in</strong>a (PRC) became a member of WIPO <strong>in</strong> 1980. It modeled<br />
its <strong>in</strong>tellectual property rights (IPR) on the Berne convention for the protection of literary and<br />
artistic works and the agreement on TRIPS 3 - 4 . In 1984, it acceded to the Paris convention for the<br />
protection of <strong>in</strong>dustrial property and <strong>in</strong> 1989 to the Madrid agreement for the <strong>in</strong>ternational<br />
registration of trademarks.<br />
Despite its accession to the major <strong>in</strong>ternational conventions on protection of IPRs,<br />
violation is common and it has attracted criticism from foreign <strong>in</strong>vestors and their governments,<br />
particularly the United States of America. To better understand the current situation on IPR<br />
protection <strong>in</strong> Ch<strong>in</strong>a, there is a need to study the development process of <strong>in</strong>tellectual property<br />
laws and its enforcement <strong>in</strong> Ch<strong>in</strong>a.<br />
II. Ch<strong>in</strong>a <strong>Intellectual</strong> <strong>Property</strong> legal framework<br />
1. Patent <strong>Protection</strong><br />
In November 1973, the Ch<strong>in</strong>ese government decided the establishment of a patent system<br />
