Lawsuits: Closing Treasure Island Foods being sued by produce supplier, employee union<br />

Inc., the parent company<br />

of a Wilmette grocery<br />

store, is facing two new<br />

lawsuits as it prepares to<br />

cease operations Friday,<br />

Oct. 12.<br />

In the first lawsuit, Anthony<br />

Marano Company,<br />

a Chicago-based produce<br />

company, is suing Treasure<br />

Islands Foods, Inc. for<br />

$453,000 of unpaid produce<br />

according to a lawsuit<br />

filed Monday, Oct. 1,<br />

in Chicago’s U.S. District<br />

Court.<br />

In documents obtained<br />

by The Beacon, Treasure<br />

Foods, Inc., the parent<br />

company of the Wilmette<br />

grocery store at 911 Ridge<br />

Road, is named as the defendant<br />

along with owners<br />

Maria A. Kamberos and<br />

Christ N. Kamberos, Jr.<br />

Magazi, an Illinois corporation<br />

listed as having its<br />

principal places of business<br />

in Wilmette, is also<br />

listed.<br />

It was announced last<br />

week that all Treasure Island<br />

Foods locations will<br />

be closing Friday, Oct. 12.<br />

In the lawsuit, it is alleged<br />

that the Anthony<br />

Marano Company had delivered<br />

wholesale quantities<br />

of produce to Treasure<br />

Island’s seven locations<br />

between July 1 and Oct. 1.<br />

According to the lawsuit,<br />

$33,517.51 in produce was<br />

delivered to the Wilmette<br />

location. Each of the seven<br />

stores accepted the delivered<br />

produce.<br />

out of Lyons.<br />

In the second lawsuit,<br />

filed in federal court on<br />

Thursday, Oct. 4, the United<br />

Food and Commercial<br />

Workers International<br />

Union is suing Treasure<br />

Island Foods for allegedly<br />

violating a law that states<br />

employees must be given<br />

written notice of pending<br />

layoffs at least 60 days prior<br />

to the employer closing<br />

down, also known as the<br />

Worker Adjustment and<br />

Retraining Notification<br />

Act of 1988.<br />

In the lawsuit, also obtained<br />

by The Beacon,<br />

Treasure Island Foods,<br />

Inc., Magazi and Patrick<br />

Cavanaugh are named as<br />

defendants. Cavanaugh<br />

is named as the trusteeassignee<br />

for the various<br />

Treasure Island Foods<br />

entities and states that he<br />

controls the day-to-day<br />

operations of the retail<br />

grocery stores.<br />

The United Food and<br />

Commercial Workers International<br />

Union filed the<br />

lawsuit on behalf of the<br />

union’s Local 1546.<br />

The lawsuit states that<br />

Treasure Island has employed<br />

more than 100 employees<br />

who in the aggregate<br />

work more than 4,000<br />

hours per week collectively<br />

at seven stores. It claims<br />

that “on or about Sept. 26,<br />

Treasure Island ordered<br />

the closing of all seven<br />

stores within the following<br />

two weeks, resulting in the<br />

termination of more than<br />

50 employees, excluding<br />

part-time employees, constituting<br />

a “plant closing.”<br />

According to the lawsuit,<br />

on or about Sept. 26,<br />

Treasure Island provided a<br />

hand-delivered letter to all<br />

employees stating it would<br />
