Lawsuits: Closing Treasure Island Foods being sued by produce supplier, employee union
Wilmette store
closing Oct. 12
Eric DeGrechie, Editor
Treasure Island Foods,
Inc., the parent company
of a Wilmette grocery
store, is facing two new
lawsuits as it prepares to
cease operations Friday,
Oct. 12.
In the first lawsuit, Anthony
Marano Company,
a Chicago-based produce
company, is suing Treasure
Islands Foods, Inc. for
$453,000 of unpaid produce
according to a lawsuit
filed Monday, Oct. 1,
in Chicago’s U.S. District
Court.
In documents obtained
by The Beacon, Treasure
Foods, Inc., the parent
company of the Wilmette
grocery store at 911 Ridge
Road, is named as the defendant
along with owners
Maria A. Kamberos and
Christ N. Kamberos, Jr.
Magazi, an Illinois corporation
listed as having its
principal places of business
in Wilmette, is also
listed.
It was announced last
week that all Treasure Island
Foods locations will
be closing Friday, Oct. 12.
In the lawsuit, it is alleged
that the Anthony
Marano Company had delivered
wholesale quantities
of produce to Treasure
Island’s seven locations
between July 1 and Oct. 1.
According to the lawsuit,
$33,517.51 in produce was
delivered to the Wilmette
location. Each of the seven
stores accepted the delivered
produce.
The Anthony Marano
Company is being represented
by Robert B. Marcus
of Maksimovich & Associates
out of Lyons.
In the second lawsuit,
filed in federal court on
Thursday, Oct. 4, the United
Food and Commercial
Workers International
Union is suing Treasure
Island Foods for allegedly
violating a law that states
employees must be given
written notice of pending
layoffs at least 60 days prior
to the employer closing
down, also known as the
Worker Adjustment and
Retraining Notification
Act of 1988.
In the lawsuit, also obtained
by The Beacon,
Treasure Island Foods,
Inc., Magazi and Patrick
Cavanaugh are named as
defendants. Cavanaugh
is named as the trusteeassignee
for the various
Treasure Island Foods
entities and states that he
controls the day-to-day
operations of the retail
grocery stores.
The United Food and
Commercial Workers International
Union filed the
lawsuit on behalf of the
union’s Local 1546.
The lawsuit states that
Treasure Island has employed
more than 100 employees
who in the aggregate
work more than 4,000
hours per week collectively
at seven stores. It claims
that “on or about Sept. 26,
Treasure Island ordered
the closing of all seven
stores within the following
two weeks, resulting in the
termination of more than
50 employees, excluding
part-time employees, constituting
a “plant closing.”
According to the lawsuit,
on or about Sept. 26,
Treasure Island provided a
hand-delivered letter to all
employees stating it would
close all of its stores dur-
