Bulo was attacked andkilled by two dogs in Kenton-on-Sea onApril 30.Agri Eastern Cape CEO BrentMcNamara was quoted in the Heraldsaying the attack was the tragicculmination of a long-standing problem.McNamara highlighted theenforcement of bylaws – specificallythose that deal with indiscriminate dogbreeding and unsecured dogs wanderingaround – as a key issue.He said feral dogs “are a danger notonly to human life, but also to farmswhere they cause havoc, especiallywhere there is small livestock”.Bulo’s situation highlighted the biggerproblem that Port Alfred has when itcomes to stray animals.Many families like Bulo’s have lostloved ones due to stray animals.Car accidents caused by stray cattleon the R67 to and from Bathurst speakvo l u m e s .Not long ago, the life of a valuableSAPS member was cut short in anaccident involving stray livestock on thatroad.TotT has previously reported onaccidents caused by stray animals onboth the R67 and R72.We note Ndlambe Municipality’smedia statement which said: “The Courtorder dated November 5 2021, relates tothe Public Nuisance and Keeping ofAnimals Bylaw, however, the specificfocus of that order relates to livestock andthe ongoing maintenance of theNdlambe pounds and commonages.”Nothing in that matter relates to dogbreeding and the enforcement of thebylaw against illegal dog breeding anddog fighting.Therefore, in this instance, theeffective control of dog breeding andcontrol of dogs in the Ndlambe area fallsoutside the scope of that court o r d e r.Not all pet owners are aware of theirresponsibilities in terms of the localby l aw s .We include relevant excerpts in thisedition for reference.When it comes to stray livestock, wenote the need for good policies andpractices when it comes to themanagement of communal grazing areas,and the TotT team plans to report on thisgoing forward.This week’s editorial waswritten by TK MTIKIHAVE YOUR SAY Letters to PO Box 2871, Port Alfred — or e-mail to h o u ze t j @ ta l kof t h e tow n .co. zaDog owners, beware!The Supreme Court of Appeal hasrepeatedly shown its support forvictims of vicious dog attacks.In 2017, a Mr Cloete, who collectedrefuse to make a living, was walkingdown a street to the shops pulling hisrefuse trolley behind him.For no reason, and without anywarning, he was attacked by threecross-bred bull terriers owned by a Mrvan Meyeren. They savaged Mr Cloeteso badly that his left arm had to beamputated.When Mr Cloete’s claim fordamages was dismissed by a lowercourt, he appealed to the SupremeCourt of Appeal (SCA).All five judges hearing the matterdismissed the lower court’s ruling andgranted Cloete’s damages.The judges wrote: “Many people inSouth Africa choose to own animals forcompanionship and protection. That istheir choice, but responsibilities followin its wake . . . (A)nimals can causeharm to people and property in variousways. When they do so and the victimof their actions is innocent of fault forMACAVITY WAS THERE!the harm they have caused, theinterests of justice require that asbetween the owner and the injuredparty it is the owner who should beheld liable for that harm.”In giving this ruling, the SCAfollowed a line of judgments handeddown for nearly 100 years since thecase of O’Callaghan NO v Chaplin in1927.The judges held that nothing hadhappened “to change their view of theinterests of justice taken in that case”.Especially with the increase in thenumber of pet animals, “especiallydogs, in our towns and cities and theopportunities for harm that they pose,that view of where the interests ofjustice lie has been strengthened”.“People are entitled to walk ourstreets without having to fear beingattacked by dogs and, where suchattacks occur, they should in mostcircumstances be able to look to theowner of the dog for recompense.”But what if a dog, or otherdomesticated animal such as a horse ora cat, causes the death of the victim?Who will claim? His [victim’s]dependants have the right to claim.In April 2011 a man was standingnext to his bakkie at the gate of asmallholding when the owner openedthe gate. The owner’s boerboel rushedout and jumped against the man’sbakkie.When the man tried to shoo the dogaway, it bit his hand and legs severaltimes.
