Once again a record number of industry professionals 

contributed to our Who’s Who issue of Trends 

Magazine. Our goal with this special edition is to 

showcase the leaders of our industry in a fun and 

interesting way. Please enjoy this month’s issue of Trends 

Magazine which includes over 50 profiles of the top decision 

makers in Metro Denver. These are the individuals who are 

leading and shaping our industry. 

The first six months as AAMD President have been both 

exciting and rewarding. I’d like to recap and highlight several 

key accomplishments for the Association in 2010. But before 

I do, I’d like to thank all of our members for supporting the 

organization and our mission! This year we had record 

membership renewals and we greatly appreciate everyone’s 

commitment to AAMD. 

First of all- what an amazing effort our team put into the 

recent Fall Elections. Between AAMD and CAA our Associations 

contributed significant resources and contributions to both 

Republican and Democrat candidates who support the rental 

housing industry and whose positions on issues are aligned 

with our association. I’m pleased to announce our investments 

paid off! We were successful in 86% of the elections where we 

contributed! 

In addition to our electoral efforts our Government Affairs 

team had many victories throughout the State Legislative 

session. We were able to defeat or successfully amend nearly 

all of the significant bills we were actively following. Great job 

to our staff and lobbyist teams. 

Beyond government affairs, we had several important 

Educational achievements. With new EPA regulations it was 

critical for AAMD to update our members on new renovation 

standards. In 2010 we trained and certified over 350 people 

through the EPA Renovators Course! Also, recently we

Highlights from 2010 includes Rental 

Rates topping $900 for first time ever 

launched our first Certified Apartment Portfolio Supervisor 

(CAPS) course (in decades) —and sold out with 26 students 

registering. Watch for more great things from our Education 

Department as we launch 40 new online courses in 2011! 

In 2010 AAMD continued to establish itself as THE place to 

be seen, meet, learn and network with industry professionals. 

Several AAMD events broke attendance records or near records, 

including: Maintenance Olympics; Chili Cook Off; Power Lunch 

program; and we had a record year for Exhibitors at our Trade 

Show this year! One of our local Maintenance Olympics 

champions went all the way to Nationals and won the Race Car 

event- congratulations Lannon Quintana! 

2010 also marked a 20 year partnership with Family 

Homestead! By raising important funds for this Charity, AAMD 

has helped thousands of homeless children by enabling their 

parents to take control of their lives. Beyond the critical dollars 

we have together donated nearly Ten Thousand man hours to 

Family Homestead cleaning and upgrading their apartments 

over the years. Thank you to everyone who has contributed 

money and time to this outstanding cause – we all should feel 

very proud! 

Not only has the Association been setting some records, but 

our industry has too. For the first time ever, average monthly 

rent exceeded $900 ($912). This occurred in the 3rd Quarter, 

where at the same time vacancies dipped to 5.3%, which is the 

lowest mark since Q1 of 2001. Economic vacancy unfortunately 

increased in Q3 to nearly 19%. I’ll let you figure that one out…

Acquisitions & Management Changes 

AMLI Arista On September 16th, AMLI 

acquired AMLI Arista (formerly Alexan 

Arista) from TCR. AMLI Arista is a 358 

unit Class A community located in the 

new Arista 200 acre mixed use development in Broomfield. Built 

in 2008, the community offers first class amenities as well as 

excellent proximity to the Broomfield Park-N-Ride and 1st Bank 

Center. Many thanks to AMLI’s Sr. Vice President Dan Gladden for 

the update. 

General Investment and 

Development Companies 

(We know the property 

management company as “Windsor) has acquired 12,000 

additional apartments units. The acquisitions are in multiple 

states, California, Washington and Utah to name a few. Many 

of the new regions are scheduled to report to Windsor Property 

Management’s Denver office. Congratulations to the Windsor 

team. I know that they are both excited and possibly a little 

crazy these days! 

Echelon Property Group assumed 

management of Fenton Place at the 

end of September. The owners of 

Fenton Place are anticipating a $2.5M 

renovation. Echelon will manage the property improvements, 

clubhouse renovation, new pools, roofs, elevators and unit 

improvements. Target date for completion of these upgrades is 

early Spring 2011. The community will then be renamed! 

Echelon has also acquired management of Courtyard 

Apartments at 5100 Leetsdale Drive. The 197 unit community 

will receive a makeover that includes new signage, wi-fi, 

landscaping, leasing office and common area improvements. 

The long time owner/manager group said they recognized 

the value that could be created for their asset by hiring a 

professional management company who demonstrated a 

positive track record for maximizing rents and saving expenses. 

They also feel that Echelon’s local presence is a great fit for them. 

Movers & Shakers 

RedPeak Properties COO , Mark Windhager 

has announced that Garrett Faillaci and Brian 

Owen have joined the company to broaden 

the scope of training and marketing. The duo 

will complement RedPeak’s focus on customer 

service and the steady growth of the company 

as a whole. 

Ms. Faillaci has a celebrated background in 

Marketing and Training and was a finalist 

for AAMD’s prestigious Tribute Award in 

2008. Garrett said that she believes in not 

only training associates, but training them 

to be leaders who in turn train those around 

them. She is also excited about expanding the 

company’s recruiting initiatives as Training and 

Recruiting Director. 

Brian Owen, Marketing Director, brings many 

years of marketing experience in the multifamily industry. 

Brian is known for his effective use of social media outlets for 

generating traffic and leases. Many of us will remember Brian 

for auctioning an apartment on eBay while at Village Green 

Companies – The auction drew national media attention.

Welcome to the 2011 Edition of Who’s Who. It has always been our goal to 

look at the overall Denver apartment industry by learning about the people 

who shape it. We do this by showcasing these individuals in a fun and 

interesting way. How else would we know that prior to joining the industry, 

Stephanie Brock bagged groceries? Or that Mike Colton has five kids? Or that 

Parke Pettegrew compares himself to William Wallace? 

Obviously, this is just skimming the surface. As you delve deeper into these 

profiles, you’ll see that our industry is being shaped by talented and 

dedicated professionals who love Denver. When asked where they’d 

retire if money were not an issue, many responded that they 

wouldn’t leave Colorado.

If a reality show were made about your life, what would it be 

called? A Day in the Life of Carmel 

What is the most valuable contribution you bring to your 

company? Being able to bring many different people together as 

a team. 

How has the approach to your budget changed in the past 3 

years? I hate to say it but I never really focus on the budget 

I would just order what was needed and was able to almost 

always be under budget 

What is the hardest business decision you’ve ever had to make? 

Letting someone go. 

What percentage up or down is your NOI? I would guess 5% up, 

but it is property specific. 

What is your approval rating of President Obama? Every 

President starts out strong the first year of their term and then 

the media and fellow Americans turn on them, so I would say 

right now 5. 

What is one task/role/responsibility at work that you wish you 

didn’t have? Our M.P.M.S. 

If money were not a factor, where would you retire? St. Croix. 

If entertaining important guests, what would you prepare/serve 

for dinner? BBQ, you cannot go wrong with BBQ unless your 

guests are vegetarians.

how did it happen? The assistant manager at the first property 

I ever worked at in the apartment industry. I had applied for a 

leasing consultant position and I had no prior experience. The 

manager asked the assistant to interview me and the assistant 

felt I should be hired, but the manager did not, so they kept 

looking. Six weeks later I heard back and was offered the job. I 

found out later that the assistant manager was my saving grace 

and had she not been so influential in convincing her manager, I 

would not be where I am today. 


Reputation in the industry and references from colleagues is my 

first step to compile a short list. From there, bids on a specific 

scope, experience, customer service and the ability of the vendor 

to supervise their team and ensure quality control. At times we 

spend too much time calling vendors back out or inspecting 

their work defeating the convenience of a vendor, thus any extra 

steps I hear a vendor takes regarding managing quality control is 

a buzz phrase for me. 


Achieving my CPM designation through IREM. I learned many 

valuable skills that were above my pay grade at the time and it 

accentuated my education to allow for advancement. 

What high school stereotype were you (jock, band, nerd, etc)? 

Nerd, outcast, party animal, in that order.

below 5%? I’ll go bullish and say Q2 2011.

our numbers. In the past, we created budgets based on past 

trends and were fairly accurate. Some new trends have been 

seen that have not followed the norm creating a curve ball. 


Without being too specific, a few times where I have to make 

the decision to part ways with an associate. At times, these 

decisions are not as black and white as we’d like them to be, but 

it is a necessary evil. I never for a second forget that while this 

is a business decision for the company, it is very personal for an 

associate and I never make these decisions lightly. 


What is the fastest growing amenity in the industry today? I 

have seen very few unique property amenities as of recently that 

appear to be catching on so I’d have to say interior amenities. For 

the longest time, apartments were pretty basic – beige carpet, 

white or tan walls, laminate counters, Hollywood vanity lights, 

etc, but the trend to more plush interiors and customization 

is wide spread. Granite counters, plank flooring, cherry-look 

cabinets, etc. is the new norm. Not just in new builds but in 

renovations in older properties as well. 

What percentage up or down is your NOI? Down 2.6% through 

Q3 2010 over the same period in 2009.

how did it happen? Generally it was DU’s Masters in Real Estate 

and Construction Management Program, but I’d credit Dr. 

Mike Crean with first helping me break into the industry. I was 

deciding between CU-Boulder’s MBA Program and DU’s Real 

Estate Program and sat in on one of Mike’s classes and was sold 

on DU. 


We primarily use smaller vendors to avoid the overhead costs 

associated with larger companies, but not so small that they 

cannot perform within 24 hours or so. We require $1M/$2M 

aggregate in insurance and prefer local, Denver-based 

companies. In general, we deal with owner/operators as well for 

accountability reasons. 

What is the best career-related decision you ever made? After 

graduating from the University of Illinois, I was in strategic, IT, 

and supply chain consulting for about 8 years, which really 

helped to learn all major aspects of business and to provide a 

strong foundation for starting my own company. 


Ummm....I liken myself to one of the Glee cast members, but 

mixed with an NFL player’s athleticism without really the ability 

to sing, dance, or have any athletic ability. 

What movie title best describes your management style? This 

is tapping out my creative abilities...how about Cool Hand Luke - 

my business partner Judy Nguyen says I’m a servant leader that 

leads by example with my “Upside-down Pyramid” management 

approach where our management team if to support their team 

more and more as you get closer to the customer to make sure 

the customer has wonderful customer service....I think she just 

thinks I can eat a lot of hard-boiled eggs.

Leadership skills to drive process improvement and efficiencies that

provide free hi-speed wireless, but we’re seeing our on-line bill

is 3.4%, but the 4 months including June to September is 18%

We did make quite a few investments earlier this year that we

was earning extra money doing “flips” before it was cool. In the 

70’s she and my father would do all the work to rehab a house 

and flip it or make it a rental to provide income (or at least pay

the night and on weekends I learned everything from painting, 

drywall, pluming, electric, roofing, make ready and renting. It 

was not fun but certainly taught me the trade.

think terminating employees is always (usually) a hard decision, 

especially if you know that the decision will have a very negative 

impact on that persons family (children).

extraordinary. Things that are over the top. For example, not just 

a clubhouse, but a huge clubhouse with outdoor TVs. Not just

long-term relationships with many of our suppliers. However, we 

are not opposed to trying a new supplier if we feel it could be a

started in the apartment industry! Before starting in this industry 

my plan was to go into restaurant management.

Who is responsible for helping you break into the industry and how did it happen? Karolyn 

Smith, marketing and training manager for Lincoln Property Company in Las Vegas. I went 

through an employment agency when I moved to Vegas, and interviewed with Karolyn. 

I was so impressed with her enthusiasm, professionalism and was excited by how fun 

the leasing job seemed to be. I quickly became the worst leasing agent at LPC, so they 

promoted me to assistant manager since I was a better “numbers person”. 

What is the decision process on how you choose your suppliers? There are so many 

terrific suppliers to choose from in this market area, that it is always tough. The first step 

is competitive bidding and pricing-related screening. Then talking to my team to find 

out their experiences with each, why they would prefer one over another; looking at 

their ease of ordering and delivery, web-based programs; and, how well the company 

and its local representatives have delivered on their promises. I am very loyal to my good 

vendors and suppliers. 

What is the best career-related decision you ever made? Achieving my Certified Property 

Manager, (CPM) designation. This allowed me to move up faster than I otherwise would 

have in the Las Vegas market and gave me the opportunity to travel and meet a lot of 

different property managers from other states and countries, grow as an officer in the 

organization and learn to present, give speeches, organize large groups… it was my 

Masters Degree in property management. 

What high school stereotype were you? Cowgirl. I had new Tony Lama’s every year, rode 

with people who sported gun racks in the back window of their truck, went to all the 

rodeos and knew how to two-step at an early age! 


Toy Story. I like to think I am “Buzz Lightyear” – encouraging, helping people try new skills, 

cognizant of my own faults and fallibility and stepping beyond this to form teams and 

create better results than I/they would have alone. I also optimistically form alliances with 

people who might think I am a little “off” and want to push me out a window who usually 

end up as an ally.

determination, tempered by humor.

have changed, the approach has remained the same – collect your information, look at 

past trends, predict future increases, write what you think is realistic and then forward 

it to someone to take to a realm that doesn’t resemble the realism that you and your 

team worked so hard to achieve. Listen to some budget review comments concerning 

“sandbagging” and “pessimism”, consult the Crazy 8 ball and move forward. 

What is the hardest business decision you’ve ever had to make? All decisions that I 

needed to make were appropriate at the time and so didn’t seem difficult. 

What is the fastest growing amenity in the industry today? Customer service. This may 

not be listed on your brochure as interior - or exterior - amenities, and is the one “extra” 

that will make people choose to make their home at your community and stay there.

at the property? 2nd can they work well with the on site management team? 3rd are they 

members of the apartment association? 4th do they have competitive pricing? 

What is the best career-related decision you ever made? I decided to do what I enjoy and focus 

on apartment management. I have worked as a contractor and as a commercial property 

manager and realized that I get the most satisfaction from apartment management. 

What high school stereotype were you? I was an athlete in high school but my hair was 

pretty long by the time I graduated. 

What movie title best describes your management style? Mary Poppins, a spoon full of 

sugar helps the medicine go down. 

If a reality show were made about your life, what would it be called? The Amazing Race, 

facing new challenges and visiting exciting places with my race partner and wife Linda.

How has the approach to your budget changed in the past 3 years? I went from a philosophy 

of it takes money to make money to we can name the tune in less than four (C) notes. 

What is the hardest business decision you’ve ever had to make? During times of change 

what is the best company to work for? It seems there is still plenty of luck and timing 

involved in the decision. 

What is the fastest growing amenity in the industry today? An interactive property 

web site. One where residents can go to write work orders, pay rent on line, and gather 

valuable time saving information at their leisure. 

What percentage up or down is your NOI? We are actually up around 13% YTD. Expense 

control has been critical to our success. 

What is your approval rating of President Obama? (scale from 1-10 with 10 being a 

high approval rating). In general I don’t support the liberal policies of President Obama 

however I do support the President of the United States. He has been able to pass 

legislation and remove the combat troupes from Iraq. 

What is one task/role/responsibility at work that you wish you didn’t have? I wish I didn’t 

have to call emotional angry residents. 

If money were not a factor, where would you retire? I would retire on a large working 

ranch (with a trout pond) right here in Colorado near family and friends. 

If entertaining important guests, what would you prepare/serve for dinner? It all 

depends on the preference of the guest. We have a vegan friend that challenges our 

culinary skills. We focus on a complimentary multiple course meal that includes a 

great wine. This year we had plenty of cucumbers from the garden so our friends had 

cucumber soup, cucumber salad, baked cucumbers… Always end with a seasonal 

desert that will be remembered like cucumber ice cream!

mutual acquaintance. I was in the restaurant/hospitality industry 

at the time and Peter owned a couple of restaurants in addition 

to a boutique fee management company. I interviewed for the 

restaurant job, decided the hours were too brutal and asked 

about property management. Peter made me spend 3 months 

reading books and interviewing with leaders in the industry. 

He then proceeded to put me on a lovely, quaint 450 unit 

receivership property in Montbello where I learned REAL property 

management and how to be held up without getting shot. 


Eenie meenie minie moe, catch a supplier by the toe, if he 

hollers make him pay, a Compliance Depot fee today. Price is 

vital, but service rules. Just like golf, price for show, service for 

dough. Even in the penny pinching world today, world class, 

genuflecting service gets more contracts and saves more money 

than loss leader pricing schemes ever dreamed of. 


What is the best career-related decision you ever made? Staying 

in Denver and not grabbing the brass ring of a big time SVP job. 

That job no longer exists and the Denver apartment market, 

while maybe not 2000 like, is at least the tallest of the 7 drawfs.

out with the “Weed Heads” (did not inhale of course), performed 

perfect keg stands weekly and worked 20+ hours per week.

of a pulling right guard for the site staffs – I am very good at 

blocking and running interference for the ball carriers that are 

the great staffs of the properties. There is so much red tape, 

politics, regulation, self inflicted brain damage, and other 

obsticals in the world today that its easy to forget our job is to 

serve residents maximize cash flow and NOI for owners. I help 

cut down the noise and focus the staffs on those two customers.

over 2009, but a blind monkey could get those results. The 

true test will be whether growth in revenue can offset certain 

expense increases in a meaningful way in 2011 while we 

continue to struggle to obtain job growth and household 

formation, the Mothers Milk of multifamily profitability. 

What is your approval rating of President Obama? Reagan once 

asked, “are you better off now than 4 years ago?” My question 

to Mr. Obama is, “are my kids going to be the first generation 

in American history to be worse off than their parents?” Unless 

things change quickly and dramatically, my answer will be yes.

my husband was a student at the nearby school. The current 

manager had a small child and her husband was about to 

graduate from another nearby school. She asked me what I was 

going to do when the baby was born. She said she would be 

leaving soon and they liked to have moms with small children 

and student husbands manager their properties. They thought 

the small children would make the mom want to stay at home 

to work and that the student husbands would provide lots of 

referrals. Not sure anyone could hire based on that criteria now!

the minority, but when I consider what he inherited as far as the 

mess we were in, I think he’s doing very well. I think we tend 

to be shortsighted and Obama gets blamed for the current 

conditions. While recovery may not be as quick as we all wanted, 

the downward spiral started by the previous administration had 

not hit bottom by the time they exited. Climbing out of the deep 

hole is a slow and arduous process that requires more working 

together than we are seeing.

I find a real job. Well here it is 26 years later – and I still haven’t 

found a “real job”! 


First of all we like to use Apartment Association Members. We 

also choose suppliers based on service and price. Many times, 

we choose several different suppliers and then allow our onsite 

teams to choose depending on the type of supplier.

the fact that I was born in Colorado Springs and truly liked the 

supervisor for Colorado. I have never regretted my decision.

going to sound strange but I feel that it is a sense of community. 

I realize sense of community is not an amenity but residents love 

to feel like they belong. Additionally residents love convenience 

so we have been successful at getting local businesses to come

National Apartment Association 

Apartment industry weighs in on bed 

bugs during congressional forum 

leading industry, scientific and federal 

experts gathered yesterday as part 

of a Congressional forum convened 

to expand awareness of bed bugs, 

assess their impacts and discuss ways the 

federal government can support efforts to 

combat them. 

Representing NAA/NMHC was Brian 

Hendy, senior vice president of Wallick- 

Hendy Development in Columbus, Ohio. 

Hendy made it clear that the bed bug 

problem is a top issue for the apartment 

industry. Bed bugs “create unique 

challenges to the apartment industry” 

because of the density of multifamily units 

and the rapidity with which infestations 

spread among units, he said. Hendy 

described the many impacts on multifamily 

housing, including the significant costs 

associated with bed bug eradication 

which can run into thousands of dollars 

for treating a single unit. Such costs can 

be very difficult to absorb, especially for 

affordable multifamily properties. 

Hendy described three critical 

elements in dealing with bed bugs 

– establishing an “Integrated Pest 

Management Plan,” creating a shared 

responsibility between landlords and 

residents and, ultimately, using effective 

treatments for eradication. He also 

emphasized that property managers 

must establish an inspection regime, 

train maintenance staff and educate 

residents. Residents must do their part by 

understanding how bed bug infestations 

occur, how to prevent them and the 

importance of cooperating with treatment 

protocols. Treatments, whether with 

chemicals or heat, are costly and should 

be undertaken only by experienced pest 

control companies, he said. 

Hendy recommended that federal 

government expedite the re-labeling 

of existing pesticides, support research 

and development into new treatments, 

and educate the public on identifying 

bed bugs, protecting themselves when 

traveling, and the importance of reporting 

any suspected sighting of bed bugs. 

Hendy noted that inspection protocols 

of federally-assisted properties should 

acknowledge the unique nature of bed 

bug infestations. He praised the approach 

taken by the U.S. Department of Housing 

and Urban Development for inspections 

through its Real Estate Assessment Center 

(REAC) that requires inspectors to report 

the presence of bed bugs but does not 

penalize owners. He hoped that federal 

oversight of other affordable housing 

programs, such as the Low Income 

Housing Tax Credit, would take a similar 

form. “Our concern is that owners and 

managers of these properties are not 

penalized for something that is largely out 

of their control,” Hendy said. 

The “Don’t Let the Bed Bugs Bite 

Forum” was convened by U.S. Reps. 

G.K. Butterfield (D-NC) and Don Young 

(R-Alaska), who have co-sponsored 

legislation to, among other things, 

establish a grant program to assist states 

in inspecting hotel rooms for bed bugs. 

Additionally, the bill would add bed 

bug prevention and management to 

public housing agency plan reporting 

requirements by amending the US 

Housing Act of 1937. 

lame-Duck Session: little Time, 

long wish list 

The resurgence of the Republicans after 

the midterm elections has meaningful 

implications for the apartment industry’s 

legislative agenda. 

A test of the new political landscape will 

come in the next six weeks during the lameduck 

session. Democrats are unsure if they 

should use the short work period to advance 

a long list of items, or, as Republicans will 

argue, limit that activity to a few “must-pass” 

bills. These include a short-term continuing 

resolution or omnibus funding bill to 

continue funding the government, possibly 

an extension of unemployment benefits and 

an extension of the so-called Bush tax cuts 

for all income brackets. 

While the prognosis for much of the 

tax agenda is cautiously positive over the 

next six weeks, lawmakers are very likely to 

pass an Alternative Minimum Tax relief bill. 

Additionally, they will renew efforts to move 

forward on the long-stalled “tax extenders” 

measure for expiring tax provisions. The 

current thinking is that the tax extenders are 

unlikely to be paid for, which reduces the 

immediate threat of a carried interest tax 

increase to cover those costs. 

Federal estate taxes revert to pre- 

2001 levels ($1 million estate exemption 

and 55% tax rate) in January. Attempts 

to extend the 2009 law ($3.5 million 

exemption, 45% tax rate) have to this 

point been unsuccessful and Republicans 

continue to press for a higher exemption 

level and a lower tax rate. If a compromise 

can’t be reached, the issue will carry over 

to the new Congress and the pre-2001 

levels will be in effect until the issue is 

resolved. Our goal on this issue is to retain 

“stepped-up” basis in any reform. 

NAA/NMhC Testify on 

Challenges in Financing 

Commercial Real Estate 

On Wednesday, NAA/NMHC testified 

before the U.S. Senate Committee on 

Small Business and Entrepreneurship on 

the capital market challenges facing the 

commercial real estate sector. 

Jim Arbury, NAA/NMHC Senior Vice 

President of Government Affairs, reviewed 

the overall status of the recovery in the 

apartment sector and our industry’s 

unique liquidity issues. Given the 

increasing demand for rental housing, he 

stressed the importance of ensuring that 

policymakers not restrict the supply of 

multifamily capital as they work to reform 

the GSEs, Fannie Mae and Freddie Mac. He 

also detailed the strong performance of 

the GSEs’ multifamily activities compared 

to the well-documented problems in their 

single-family business. 


Finally, Arbury discussed the current 

financial regulatory environment, 

which has gone from little oversight to 

a “risk-averse” approach that threatens 

to prolong the financial crisis and 

interrupt the flow of capital to apartment 

companies. Particularly onerous is 

regulators’ demand that property 

valuations be based on marketplace 

appraisals--which are artificially low 

because of distressed property salesinstead 

of being based on a property’s 

projected discounted cash flow. 

We will continue our efforts to ensure 

that the apartment sector has access to 

reliable and affordable credit markets. 


NAA/NMhC Address FhA 

Financing Delays 

NAA/NMHC and a coalition of other 

real estate organizations are working 

with HUD to address reports of significant 

delays in approving multifamily mortgage 

insurance applications. 

As FHA struggles to deal with an 

overwhelming increase in volume as 

a result of the credit crisis, they are 

taking several steps to manage their 

risk exposure. Earlier this year, they 

implemented new underwriting criteria. 

In addition, they have made policy and

procedure changes in how they process 

loans. 

Among other things, they have 

created a central loan committee and 

are re-negotiating transactions and 

exploring additional recourse provisions. 

These and other policy actions are 

creating bottlenecks that have resulted 

in significant and costly delays in getting 

financing approved.

The New Congress: New Balance of Power Complicates 

Industry’s legislative Agenda 

When the 112th Congress convenes on January 5, 

Republicans will control the House and will have eliminated the 

Democrats’ filibuster-proof majority in the Senate. The result will 

either be total gridlock or reluctant cooperation on a few issues 

in advance of the 2012 elections. 

The most obvious impact on the apartment industry’s agenda 

will be in the House, where the Republican takeover means 

they will control the flow of legislation and will appoint new 

committee chairmen. 

GSE and Financial Regulatory Reform 

All eyes are on the Financial Services Committee, which 

will lead efforts to reform Fannie Mae and Freddie Mac and 

will oversee implementation of the comprehensive financial 

regulatory reform bill passed this year. Rep. Spencer Bachus (R- 

AL) and Rep. Ed Royce (R-CA) are both vying to replace current 

chairman Barney Frank (D-MA). Both Bachus and Royce have 

said they will repeal or revise elements of the financial regulatory 

reform bill. And both have vowed to “end the bailout” of the GSEs. 

Democrats are expected to continue to press for retaining 

some kind of government guarantee. They are weakened, 

however, not only by the Republican takeover, but also by 

the loss of Rep. Paul Kanjorski (D-PA), who chaired the Capital 

Markets and GSE Subcommittee; Kanjorski lost his seat in this 

month’s election. The Obama Administration is set to release 

its outline for Fannie Mae and Freddie Mac in January, but the 

divided Congress means that beyond numerous hearings, final 

action on reform is unlikely until after the 2012 elections. 

Taxes 

Any tax issues not addressed in the lame-duck session will 

carry over to the beginning of the next Congress. Beyond those 

items, tax legislation is expected to be targeted (on issues such 

as energy incentives) as opposed to sweeping changes over 

the next two years. Even without a significant tax bill, the threat 

of a tax increase on carried interest remains real given the new 

deficit-reduction mantra on Capitol Hill and the fact that there 

are few other revenue raisers left. 

Environmental Policy and Energy Incentives 

Republican control of the House effectively kills comprehensive 

climate change (cap-and-trade) legislation in the 112th Congress. 

There is bipartisan interest among members from coal states to 

constrain the ability of the Environmental Protection Agency (EPA) 

to regulate greenhouse gasses through regulation as well, an issue 

likely to come up as early as the lame-duck session. Piecemeal 

energy bills may advance, and NAA/NMHC will continue to 

press for an array of grants, rebates and tax incentives for energy 

retrofits in apartments. We anticipate that Republicans will also 

hold hearings on a number of regulatory issues of interest to NAA/ 

NMHC, including stormwater management and lead-based paint. 

Although a bill expanding the Clean Water Act was defeated in the 

last Congress, EPA retains considerable existing authority to carry 

out its stated objective to regulate post-development water runoff, 

among other things. 

Immigration Reform and “Card Check” 

Also considered dead in the next Congress are the NAA/ 

NMHC-opposed Employee Free Choice Act (EFCA), also known as 

“card check,” and other legislative priorities for unions. (See “NAA/ 

NMHC Weigh in on Union Elections” below.) Comprehensive 

immigration reform is also unlikely. 

With so many new members of Congress, one of our top 

priorities will be to continue our massive education drive to 

inform lawmakers about the importance of rental housing 

and the need for a more balanced housing policy as well as a 

continued federal role supporting capital liquidity.
