Euro Disney Vacances S.A.S. and Mondial Assistance offer the following insurance cover: Travel insurance 1 Cancellation insurance cover (policy n° 302881) Mondial Assistance will reimburse you the cancellation costs billed by Euro Disney Vacances S.A.S. when you are obliged to cancel your trip for the reasons and circumstances listed below: Sickness, accident (including relapses or sudden aggravations), death • of yourself, your lawful or common law spouse or the person accompanying you; • of your ascendants or descendants and/or those of your spouse or those of the person accompanying you; • of your brothers, sisters, brothers-in-law, sisters-in-law, sons-in-law, daughtersin-law; • of your professional replacement, provided that his/her name is mentioned at the time of signing up for the trip. Complications in connection with pregnancy (until 28 weeks of pregnancy incl.); vaccination contra-indication; dismissal on economic grounds of yourself, of your spouse; the change or modification of paid vacation dates made by the employer granted before signing-up for the trip, excluding the following social-professional categories: company managers, liberal professions, self-employed and entertainment extras. Destruction of professional and/or private premises; theft in professional or private premises provided that the magnitude of such theft requires your presence and that the theft has occurred within the 48 hours preceeding departure. Convocation before a court, only in the following cases, provided that the date of this convocation coincides with the period of travel: • Court juryman • Procedure of adoption of a child • Appointment of an expert What we exclude: • the cancellation provoked by a person hospitalised at the time the trip was booked or the contract was taken out; • illnesses and accidents having resulted in treatment during the month preceeding signing up for the trip or taking out the contract, except in the case of a relapse or a sudden aggravation of such illnesses or accidents duly recorded medically; • illnesses requiring psychic or psychotherapeutic treatment including nervous depressions not having required hospitalisation of at least 5 days at the time of the date of cancellation of the trip; • forgetting to be vaccinated; • the contra-indication of air travel; • accidents resulting from the practice of the following sports: bobsleigh, rock climbing, skeleton mountain climbing, competition sledding, all air sports as well as accidents resulting from participation in or training for matches or competitions; • the failure to present, for any reason whatsoever, documents indispensable for the trip such as passport, visa, travel tickets or vaccination certificates. RCS B582 075 438 Per person: £ 10 Travel insurance 2 Comprehensive insurance (policy n° 302946) Mondial Assistance offers its comprehensive packages including: Cancellation insurance (guarantees: see option 1); Luggage insurance: Up to 850 €; repatriation assistance; In the event of illness, injury or death: • Organisation and management of transport: repatriation with medical care; • Organisation and management of transport for one person travelling with the Insured; • Accompaniment of children under 15 travelling with the Insured; • Organisation and management of a return trip of a relative if the Insured cannot be transported in less than 10 days and management of the accommodation of that person on the spot up to 75 € if the Insured cannot be transported in less than 7 days. Reimbursement (advance payment if necessary) of medical costs up to 7625 € (only for persons not resident in metropolitan France) in addition to payments from the Social Security and other provident agencies. Assistance in the event of death: • Organisation and management of transport: repatriation of the body; • Organisation and management of transport for the person insured travelling with the deceased; Assistance in the event of the unexpected hospitalisation or death of a close relative • Organisation and management of the early return to the place of hospitalisation or funeral. Assistance in the event of legal proceedings following a traffic accident • Advance of the bond up to 7625 € and lawyer’s fees up to 1525 €. Unused overland services • Reimbursement for unused travel days for the person repatriated under medical care and for the person accompanying the Insured. Per person: £ 13 Important: this is only a summary of the guarantees and has no contractual value. In the event of a claim, please contact: 1. OUR CONTRACT When making a booking you will be entering into a legally binding contract with us, Euro Disney Vacances SAS for the provision of accommodation and/or transport and/or other services. These terms and conditions govern that contract and bind all members of your party, including children. It is your responsibility to ensure that you and all members of your party are aware of, and accept all of the obligations contained in these terms and conditions. Our contract is effective from the date it is formed and continues until the last member of your party has completed their stay. Your booking You must not advertise, use, give or resell your booking or offer to do so for profit or otherwise or use it in connection with a competition, promotion, incentive or reward programme, business, charitable or any other similar venture without our express advance written permission. PART I - BOOKINGS FOR HOLIDAY PACKAGES (PLUS, WHERE APPLICABLE, TRANSPORTATION) 1.1 For bookings made within 7 days of your arrival date (or your departure date if your booking includes transportation), our contract is formed once you have received confirmation of the booking by telephone or e-mail. In all other cases, our contract is formed 3 days after making your booking or when you have received our acknowledgement of your booking (which may be sent to you by post or e-mail or handed over by your travel agent) and we have received the required payment by authorisation of your credit or debit card payment or your payment has cleared through our bank or your travel agent’s bank. 1.2 Our contract does not include any insurance cover. Any contract for insurance, when purchased through us, is with the insurance provider notified to you. 2. MAKING YOUR RESERVATION 2.1 You may make a reservation with us in person at your travel agent, online at www. disneylandparis.com or by telephone on the number provided in the brochure. All reservations are subject to availability and may be made, unless otherwise specified: • up to 24 hours in advance of your arrival date, or • if you are booking via our website, up to midday (GMT) on the day before your arrival date, or • if transportation is included in your booking, - up to 4 working days in advance of your departure date if payment is made by credit card, or - up to 60 days before departure date if payment is made by personal cheque. 2.2 If you wish to make a booking for unsupervised minors under 18 please contact us prior to making your booking or speak to your travel agent. We will require a written authorisation from each minor’s parents or guardian before we can progress any booking request. PRICES AND PRICE GUARANTEE 3.1 Reductions for Children Please note that you may be asked for proof of date of birth of any children in your party upon check-in at your hotel or, at point of departure where your booking includes transportation in order that any discount offered for children can be confirmed. Price Guarantee 3.2 We reserve the right to amend prices at any time before you book and you will be advised of the total cost prior to booking. 3.2.1 Once you have made your booking, we will only increase or decrease the price of your booking (excluding insurance premiums and insurance premium tax) in line with any VAT and transportation cost increases (including the cost of fuel) or to account for any other dues or fees levied on your booking (including exchange rate fluctuations). We will absorb all such increases of less than 2% of the total cost of your booking. Any increase of 2% or above will be notified to you in writing. 3.2.2 We will not make any such increase in the price of your booking within sixty (60) days of your arrival date (or, where transportation is included in your booking, departure date). 3.3 The price of your package holiday includes: • Accommodation as detailed on the booking confirmation letter. • Breakfast as mentioned in the individual hotel description and/or in the price panels. • Entrance pass to the Disney Parks as detailed in the brochure • All obligatory service charges. • VAT on all holidays at the rate appropriate at the time of printing. • If applicable, transportation as detailed on the confirmation letter. The price of your package holiday does not include: • Holiday insurance and premium for such insurance. • Supplements for additional room facilities • A number of resort and sporting facilities, (e.g. golf, tennis) or use of listed facilities, (e.g. mini-bar, safety-deposit box, external telephone calls, etc) as identified in the brochure • Items of personal expenditure. • Delivery services detailed in clause 13 below. • Any items not otherwise mentioned in “The price of your booking includes” above; 3.4 All prices are per person and were calculated on 14 March 2007 on an exchange rate of 1.4674 Euro = £ 1.00 for the Winter 07/08 period and calculated on 20 June 2007 on an exchange rate of 1.4350 Euro = £ 1.00 for the Summer 2008 period. 3.5 All times herein refer to French time, unless otherwise stated. 3.6 We shall not be responsible for any costs you may incur on credit or debit card transactions due to currency exchange rate fluctuations or otherwise. 4. PAYMENT ARRANGEMENTS 4.1 For phone bookings: 4.1.1 Deposit A non-refundable deposit will be required for bookings made more than sixty (60) days before your arrival date (or, where transportation is included in your booking, your departure date) of ten per cent (10%) of the total cost of your booking. This deposit is payable at the time of booking. 4.1.2 Balance The remaining balance of the total cost of your booking must be paid in full no later than sixty (60) days before your arrival date (or, where transportation is included in your booking, your departure date). The same credit card will be used to debit balance at 60 days prior to departure unless you advise us otherwise at 65 days prior to departure. If you are paying by Maestro card, you are required to call back no later than sixty (60) days before your arrival date for us to debit the balance. 4.1.3 For bookings made sixty (60) days or less before your arrival date (or, where transportation is included in your booking, departure date) the total cost of your booking is due immediately on booking. 4.2 For internet bookings For all bookings made online via the internet we require an immediate payment of the total cost of your booking. 4.3 All payments must be made in pounds sterling and may be made by any of the following means: • credit card (Visa or Eurocard/MasterCard) • debit card for phone bookings made three (3) days or more before your arrival date (Delta, Maestro, Solo) • personal cheque made payable to Euro Disney Vacances SAS and sent together with the payment slip provided to Disneyland® Resort Paris, P.O. Box 327, Doncaster, DN4 5XA, United Kingdom. Please note that personal cheques will not be accepted for bookings made within sixty (60) days of your arrival date (or, where transportation is included in your booking, your departure date). We cannot accept post-dated cheques or responsibility for any payment lost in the post. 4.4 Credit and debit cards will normally be authorised and charged to your account the same day or next working day. No receipt will be sent. 4.5 Failure to pay any amounts stated above on time shall entitle us to treat your booking as cancelled (see “Cancellation by You” below). 4.6 Should you make a booking with us on behalf of a third party you will be held jointly and severely responsible to us for the total cost of the booking. 4.7 Please note that purchases made whilst in Disneyland® Resort Paris shall be in Euros. 85
