Major Maquila Victory <strong>in</strong> the Dom<strong>in</strong>ican Republic<br />

In the most important maquiladora<br />

worker victory <strong>in</strong> Lat<strong>in</strong> America <strong>in</strong> several<br />

years, workers at a Hanesbrand<br />

factory <strong>in</strong> the Dom<strong>in</strong>ican Republic<br />

w<strong>on</strong> a collective barga<strong>in</strong><strong>in</strong>g agreement<br />

<strong>in</strong> mid-August. But <strong>in</strong> Guatemala the<br />

last maquiladora with a uni<strong>on</strong> c<strong>on</strong>tract,<br />

Choish<strong>in</strong>, closed <strong>in</strong> mid-July and <strong>in</strong><br />

Mexico a violent group took unlawful<br />

c<strong>on</strong>trol of the uni<strong>on</strong> at Mexmode,<br />

formerly Kuk D<strong>on</strong>g, site of <strong>on</strong>e of the<br />

most important victories of the student<br />

anti-sweatshop movement.<br />

Last Uni<strong>on</strong>ized Maquila <strong>in</strong><br />

Guatemala Clos<strong>in</strong>g<br />

The mid-July clos<strong>in</strong>g of Choish<strong>in</strong><br />

leaves Guatemala without a s<strong>in</strong>gle<br />

uni<strong>on</strong>ized maquiladora with a c<strong>on</strong>tract,<br />

follow<strong>in</strong>g the clos<strong>in</strong>g of its sister plant,<br />

Cimatextile, <strong>in</strong> September 2007. The<br />

Choish<strong>in</strong> uni<strong>on</strong> is demand<strong>in</strong>g that the<br />

plant re-open, and has secured a court<br />

rul<strong>in</strong>g declar<strong>in</strong>g the clos<strong>in</strong>g illegal.<br />

Meanwhile, the company is offer<strong>in</strong>g<br />

workers as little as 29% of what they are<br />

legally entitled to for severance.<br />

<str<strong>on</strong>g>Workers</str<strong>on</strong>g> at both plants w<strong>on</strong> collective<br />

barga<strong>in</strong><strong>in</strong>g agreements <strong>in</strong> 2003 after<br />

a two-year struggle marred by violent<br />

attacks <strong>on</strong> uni<strong>on</strong> members. Support<strong>in</strong>g<br />

the two uni<strong>on</strong>s, which are affiliated to<br />

FESTRAS, was a key part of USLEAP’s<br />

agenda <strong>in</strong> the early years of this decade.<br />

At five years, the Choish<strong>in</strong> uni<strong>on</strong> has<br />

had a c<strong>on</strong>tract l<strong>on</strong>ger than any maquila<br />

uni<strong>on</strong> <strong>in</strong> Guatemala.<br />

While owner Choi & Sh<strong>in</strong> says it<br />

has shifted its work to a uni<strong>on</strong>ized facility<br />

<strong>in</strong> Nicaragua, the Sitrachoi uni<strong>on</strong><br />

says it has evidence that Choi & Sh<strong>in</strong> is<br />

start<strong>in</strong>g up a new, n<strong>on</strong>-uni<strong>on</strong> factory <strong>in</strong><br />

Guatemala, which would prompt an aggressive<br />

resp<strong>on</strong>se from the <strong>in</strong>ternati<strong>on</strong>al<br />

community if c<strong>on</strong>firmed.<br />

Liz Claiborne, a l<strong>on</strong>g-time client of<br />

Choi & Sh<strong>in</strong>, has over the years been<br />

extensively engaged <strong>in</strong> seek<strong>in</strong>g to address<br />

uni<strong>on</strong> c<strong>on</strong>cerns, first <strong>in</strong> resp<strong>on</strong>d<strong>in</strong>g<br />

to anti-uni<strong>on</strong> violence back <strong>in</strong> 2001<br />

and, more recently, to the company’s<br />

compla<strong>in</strong>ts about relatively high labor<br />

costs, agree<strong>in</strong>g last year to pay somewhat<br />

more for its work <strong>in</strong> order to ma<strong>in</strong>ta<strong>in</strong><br />

some producti<strong>on</strong> <strong>in</strong> Guatemala <strong>in</strong>stead<br />

of shift<strong>in</strong>g it all to Nicaragua.<br />

USLEAP has been <strong>in</strong> frequent communicati<strong>on</strong><br />

with Liz Claiborne about<br />

the clos<strong>in</strong>g, as well as with U.S and<br />

Guatemalan government officials. Other<br />

key customers Macy’s and Ralph Polo<br />

Lauren have yet to resp<strong>on</strong>d to requests<br />

In Mexican Labor Law<br />

A new report from the AFL-CIO’s<br />

Solidarity Center, “<str<strong>on</strong>g>Workers</str<strong>on</strong>g>’ Freedom of<br />

Associati<strong>on</strong> Under Attack <strong>in</strong> Mexico,”<br />

raises serious c<strong>on</strong>cerns about respect for<br />

the rights of Mexico’s workers.<br />

The August 2008 document highlights<br />

a number of issues, <strong>in</strong>clud<strong>in</strong>g government<br />

c<strong>on</strong>trol of <strong>in</strong>dependent uni<strong>on</strong>s,<br />

misuse or manipulati<strong>on</strong> of Mexican labor<br />

law, and employer-dom<strong>in</strong>ated electi<strong>on</strong>s.<br />

In part as a result of these violati<strong>on</strong>s, the<br />

report argues, wages <strong>in</strong> Mexico have<br />

rema<strong>in</strong>ed extremely low, and the wage<br />

gap between workers <strong>in</strong> the U.S. and<br />

those <strong>in</strong> Mexico is widen<strong>in</strong>g.<br />

“The repressi<strong>on</strong> of <strong>in</strong>dependent<br />

uni<strong>on</strong>s is a key comp<strong>on</strong>ent of Mexico’s<br />

fundamental ec<strong>on</strong>omic policy: to promote<br />

exports through a comb<strong>in</strong>ati<strong>on</strong> of<br />

low wages and macroec<strong>on</strong>omic stability,”<br />

says the report.<br />

The report highlights cases previously<br />

reported <strong>in</strong> the USLEAP newsletter,<br />

<strong>in</strong>clud<strong>in</strong>g the struggles at the<br />

Vaqueros Navarra jeans factory and the<br />

Mexmode factory (see above story), both<br />

<strong>in</strong> the state of Puebla.<br />

In both cases, the local government<br />

attempted to underm<strong>in</strong>e the activities of<br />

an <strong>in</strong>dependent uni<strong>on</strong>. In the case of Vaqueros<br />

Navarra, the <strong>in</strong>dependent uni<strong>on</strong><br />

prevailed until the jeans factory was<br />

the closure will mark a sad chapter <strong>in</strong> the<br />

rights of maquila worker organiz<strong>in</strong>g <strong>in</strong><br />

Mexico Uni<strong>on</strong> Taken Over by<br />

Violent Group<br />

The uni<strong>on</strong> at Mexmode, formerly<br />

known as Kuk D<strong>on</strong>g, has been taken<br />

over by a group known for its history<br />

of violence. On June 20, local labor officials<br />

c<strong>on</strong>vened an illegal assembly of<br />

the uni<strong>on</strong> <strong>in</strong> the midst of a campaign of<br />

<strong>in</strong>timidati<strong>on</strong> aga<strong>in</strong>st the elected leadership<br />

by the Antorcha Campes<strong>in</strong>a (Peasant<br />

Torch) organizati<strong>on</strong>, lead<strong>in</strong>g to the<br />

electi<strong>on</strong> of their own slate. On July 7,<br />

the Worker Rights C<strong>on</strong>sortium (WRC)<br />

released a report document<strong>in</strong>g acts of<br />

physical violence aga<strong>in</strong>st the Sitemex<br />

uni<strong>on</strong> and unlawful governmental <strong>in</strong>terference<br />

<strong>in</strong> the <strong>in</strong>ternal affairs of the<br />

uni<strong>on</strong>. The report found no wr<strong>on</strong>g-do<strong>in</strong>g<br />

by Mexmode management and noted<br />

that Nike had taken positive steps <strong>in</strong><br />

resp<strong>on</strong>se to the situati<strong>on</strong>.<br />

<str<strong>on</strong>g>Workers</str<strong>on</strong>g> at Mexmode, then known<br />

as Kuk D<strong>on</strong>g, w<strong>on</strong> a collective barga<strong>in</strong>-<br />

<strong>in</strong>g agreement <strong>in</strong> 2002 after <strong>in</strong>terventi<strong>on</strong><br />

c<strong>on</strong>t<strong>in</strong>ued <strong>on</strong> page 5<br />

closed suddenly <strong>in</strong> December 2007.<br />

Such repressive labor policies<br />

ultimately c<strong>on</strong>tribute to the massive<br />

migrati<strong>on</strong> from Mexico, the report argues,<br />

as 14% of all Mexican workers<br />

are currently work<strong>in</strong>g <strong>in</strong> the U.S. While<br />

the low wages are draw<strong>in</strong>g high-pay<strong>in</strong>g<br />

jobs away from the U.S., they are also<br />

driv<strong>in</strong>g Mexican workers north, a situati<strong>on</strong><br />

<strong>in</strong> which workers <strong>on</strong> both sides of<br />

the border lose.<br />
