took office <strong>in</strong> January 2008.<br />

Especially troubl<strong>in</strong>g for U.S. policy<br />

makers and worker rights supporters,<br />

the missi<strong>on</strong> found str<strong>on</strong>g evidence that<br />

U.S. policy and leverage for support<strong>in</strong>g<br />

worker rights <strong>in</strong> Guatemala has weakened<br />

significantly with the passage<br />

of the Central American Free Trade<br />

Agreement.<br />

Dur<strong>in</strong>g the c<strong>on</strong>tentious debate <strong>on</strong><br />

the Central America Free Trade Agreement<br />

(CAFTA), worker rights advocates<br />

expressed str<strong>on</strong>g c<strong>on</strong>cern that<br />

U.S. trade leverage to support worker<br />

rights <strong>in</strong> the regi<strong>on</strong> would be weakened<br />

with the passage of CAFTA <strong>on</strong> the<br />

grounds that weak worker rights protecti<strong>on</strong>s<br />

under the labor chapter of CAFTA<br />

would replace str<strong>on</strong>ger protecti<strong>on</strong>s provided<br />

under the Generalized System of<br />

Preferences (GSP). The track record<br />

<strong>on</strong> worker rights <strong>in</strong> Guatemala s<strong>in</strong>ce<br />

implementati<strong>on</strong> of CAFTA <strong>in</strong> July 2006<br />

bears out the critics’ c<strong>on</strong>cerns.<br />

S<strong>in</strong>ce implementati<strong>on</strong> of CAFTA<br />

<strong>in</strong> Guatemala, there has been a deteriorati<strong>on</strong><br />

<strong>in</strong> the worker rights situati<strong>on</strong><br />

<strong>in</strong> Guatemala, with a sharp rise <strong>in</strong> violence<br />

aga<strong>in</strong>st trade uni<strong>on</strong>ists accompanied<br />

by near-total impunity, with at<br />

least n<strong>in</strong>e trade uni<strong>on</strong>-related murders<br />

and two rapes of daughters of trade<br />

uni<strong>on</strong> leaders.<br />

Trade Uni<strong>on</strong>ists Targeted<br />

<strong>in</strong> 2008<br />

While some have dismissed the<br />

rise <strong>in</strong> violence aga<strong>in</strong>st trade uni<strong>on</strong>ists<br />

as simply reflective of ris<strong>in</strong>g violence<br />

<strong>in</strong> general <strong>in</strong> Guatemala, worker rights<br />

supporters and trade uni<strong>on</strong>ists disagree,<br />

say<strong>in</strong>g that trade uni<strong>on</strong>ists and other human<br />

rights defenders are be<strong>in</strong>g targeted<br />

under the cover of general violence. A<br />

July 2008 human rights report by La<br />

Unidad de Protección de Defensoras<br />

y Defensores de Derechos Humanos de<br />

Guatemala (UDEFEGUA) found that<br />

trade uni<strong>on</strong>ists have borne the brunt of<br />

attacks the first half of this year, with<br />

well over <strong>on</strong>e third of all assaults <strong>on</strong> human<br />

rights defenders directed at trade<br />

uni<strong>on</strong>ists.<br />

There is no <strong>in</strong>dicati<strong>on</strong> that U.S.<br />

trade leverage under CAFTA has been<br />

effective <strong>in</strong> address<strong>in</strong>g any significant<br />

worker rights c<strong>on</strong>cerns, with U.S. government<br />

officials <strong>in</strong> Guatemala and<br />

Wash<strong>in</strong>gt<strong>on</strong> unable to identify effective<br />

resp<strong>on</strong>ses to the <strong>in</strong>creased violati<strong>on</strong>s<br />

or specific advances for worker<br />

rights that could be l<strong>in</strong>ked to pressure<br />

provided under the CAFTA labor chapter.<br />

While it is theoretically possible<br />

that the April 2008 fil<strong>in</strong>g by the AFL-<br />

CIO and Guatemalan trade uni<strong>on</strong>s of a<br />

CAFTA labor compla<strong>in</strong>t <strong>on</strong> Guatemala<br />

could strengthen<br />

the political hand<br />

of the U.S. government<br />

to press<br />

for advances, the<br />

apparent <strong>in</strong>ability<br />

of the U.S. government<br />

to exercise<br />

effective leverage<br />

up to this<br />

po<strong>in</strong>t stands <strong>in</strong><br />

stark c<strong>on</strong>trast to<br />

the pre-CAFTA<br />

era when U.S.<br />

trade and worker<br />

rights policy with<br />

Guatemala, and<br />

other countries <strong>in</strong><br />

U.S. LABOR EDUCATION IN THE AMERICAS PROJECT<br />

c<strong>on</strong>t<strong>in</strong>ued from page 1<br />

the regi<strong>on</strong>, was governed by GSP.<br />

Fundamentally, as another l<strong>on</strong>gtime<br />

trade uni<strong>on</strong> leader observed, there<br />

is no <strong>in</strong>centive under CAFTA for employers<br />

to respect worker rights, po<strong>in</strong>t-<br />

Cover Up for Murdered<br />

H<strong>on</strong>duran Uni<strong>on</strong>ist?<br />

H<strong>on</strong>duran authorities are<br />

claim<strong>in</strong>g that the April 24, 2008<br />

murder of Rosa Altagracia Fuentes,<br />

the general secretary of the<br />

<str<strong>on</strong>g>Workers</str<strong>on</strong>g>’ C<strong>on</strong>federati<strong>on</strong> of H<strong>on</strong>duras<br />

(CTH), was comm<strong>on</strong> crime,<br />

a claim rejected by the country’s<br />

trade uni<strong>on</strong> movement. Members<br />

of a car theft r<strong>in</strong>g have been<br />

arrested but skeptics po<strong>in</strong>t out that<br />

her car was riddled with bullets<br />

and that neither a laptop nor m<strong>on</strong>ey<br />

were stolen.<br />

<strong>in</strong>g out that under GSP, ec<strong>on</strong>omic dis<strong>in</strong>centives<br />

were born by the employer<br />

while under CAFTA, the ec<strong>on</strong>omic dis<strong>in</strong>centives<br />

are borne by the government<br />

(and any f<strong>in</strong>es are simply returned to<br />

another arm of the government).<br />

Trade uni<strong>on</strong> leaders also report that<br />

<strong>on</strong>e of the ga<strong>in</strong>s from the pre-CAFTA<br />

GSP process is now under attack. As<br />

an outcome of the earlier GSP process,<br />

the Guatemalan government agreed<br />

several years ago to establish a Special<br />

Prosecutor for Violence aga<strong>in</strong>st Trade<br />

Uni<strong>on</strong>ists and Journalists. Now that<br />

CAFTA has replaced GSP, this office<br />

is reportedly be<strong>in</strong>g downgraded, rolled<br />

<strong>in</strong>to another unit with reduced staff.<br />

To add <strong>in</strong>sult to <strong>in</strong>jury, weakened<br />

leverage of U.S. trade policy has been<br />

accompanied by the Bush Adm<strong>in</strong>istrati<strong>on</strong>’s<br />

push to rely <strong>on</strong> the bus<strong>in</strong>ess sector<br />

to police itself abroad. Last year, for example,<br />

the adm<strong>in</strong>istrati<strong>on</strong> provided a $2<br />

milli<strong>on</strong> grant to Bus<strong>in</strong>ess for Social Resp<strong>on</strong>sibility<br />

to promote improvements<br />

<strong>in</strong> labor standards <strong>in</strong> Central America<br />

and the Dom<strong>in</strong>ican Republic, and sup-<br />

c<strong>on</strong>t<strong>in</strong>ued <strong>on</strong> page 7<br />
