GUIDANCE ON THE IMPORT AND EXPORT<br />

OF RADIOACTIVE SOURCES<br />

I. PREAMBLE<br />

During meetings <strong>on</strong> <strong>the</strong> development <strong>and</strong> approval <strong>of</strong> <strong>the</strong> n<strong>on</strong>-legally binding Code<br />

<strong>of</strong> C<strong>on</strong>duct <strong>on</strong> <strong>the</strong> Safety <strong>and</strong> Security <strong>of</strong> <strong>Radioactive</strong> <strong>Sources</strong> (hereinafter referred to<br />

as <strong>the</strong> Code), some Member States requested guidance <strong>on</strong> implementing <strong>the</strong> Code,<br />

particularly in relati<strong>on</strong> to <strong>the</strong> import <strong>and</strong> export <strong>of</strong> radioactive sources. Therefore,<br />

this n<strong>on</strong>-legally binding <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> was developed in 2004 by Member States to<br />

support <strong>the</strong> import <strong>and</strong> export provisi<strong>on</strong>s <strong>of</strong> <strong>the</strong> Code <strong>and</strong> was first published in<br />

2005. As envisaged in its paragraph 20, <strong>the</strong> <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> was reviewed <strong>and</strong> revised in<br />

2011.<br />

States recognize <strong>the</strong> importance <strong>of</strong> IAEA programmes designed to assist <strong>the</strong>m in<br />

streng<strong>the</strong>ning <strong>the</strong>ir nati<strong>on</strong>al infrastructure for <strong>the</strong> c<strong>on</strong>trol <strong>of</strong> radioactive sources.<br />

States fur<strong>the</strong>r recognize that participati<strong>on</strong> in <strong>the</strong>se programmes c<strong>on</strong>tributes towards<br />

States following <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> <strong>the</strong> Code <strong>and</strong> this <str<strong>on</strong>g>Guidance</str<strong>on</strong>g>.<br />

II.<br />

OBJECTIVE<br />

1. The objective <strong>of</strong> this <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> is to improve <strong>the</strong> safety <strong>and</strong> security <strong>of</strong><br />

imports <strong>and</strong> exports <strong>of</strong> radioactive sources in accordance with <strong>the</strong> provisi<strong>on</strong>s<br />

laid down in paragraphs 23–29 <strong>of</strong> <strong>the</strong> Code. With this objective in mind, this<br />

<str<strong>on</strong>g>Guidance</str<strong>on</strong>g> is not intended to impede internati<strong>on</strong>al cooperati<strong>on</strong> or commerce,<br />

as l<strong>on</strong>g as <strong>the</strong>se do not c<strong>on</strong>tribute to <strong>the</strong> use <strong>of</strong> such sources for purposes that<br />

threaten safety <strong>and</strong> security. <strong>Export</strong>ing <strong>and</strong> importing States should aim to<br />

follow this <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> when deciding whe<strong>the</strong>r or not to authorize exports <strong>and</strong><br />

imports <strong>of</strong> Category 1 <strong>and</strong> 2 sources. States should c<strong>on</strong>sider this <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> in<br />

a manner c<strong>on</strong>sistent with <strong>the</strong>ir nati<strong>on</strong>al legislati<strong>on</strong> <strong>and</strong> relevant internati<strong>on</strong>al<br />

commitments.<br />

III.<br />

SCOPE<br />

2. This <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> applies to Category 1 <strong>and</strong> 2 sources within <strong>the</strong> scope <strong>of</strong> <strong>the</strong><br />

import <strong>and</strong> export provisi<strong>on</strong>s <strong>of</strong> <strong>the</strong> Code. This <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> does not apply to<br />

sources or programmes that are not covered by <strong>the</strong> Code, such as nuclear<br />
