Intended end-use(s) <strong>of</strong> <strong>the</strong> source(s); <strong>and</strong><br />

Expiry date (if any) <strong>of</strong> <strong>the</strong> recipient authorizati<strong>on</strong>.<br />

The exporting State may permit <strong>the</strong> exporting facility to c<strong>on</strong>duct <strong>the</strong> review<br />

under this subparagraph instead <strong>of</strong> <strong>the</strong> exporting State.<br />

(b) Satisfy itself, in so far as practicable, that <strong>the</strong> importing State has <strong>the</strong><br />

appropriate technical <strong>and</strong> administrative capability, resources <strong>and</strong><br />

regulatory structure needed for <strong>the</strong> management <strong>of</strong> <strong>the</strong> source(s) in a<br />

manner c<strong>on</strong>sistent with <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> <strong>the</strong> Code. This review by <strong>the</strong><br />

exporting State should be based <strong>on</strong> whe<strong>the</strong>r <strong>the</strong> importing State has<br />

established a regulatory framework covering at least Category 1 <strong>and</strong> 2<br />

sources, which is in place <strong>and</strong> operati<strong>on</strong>al, by:<br />

(i) Promulgating radiati<strong>on</strong> protecti<strong>on</strong> legislati<strong>on</strong> <strong>and</strong> regulati<strong>on</strong>s;<br />

(ii) Designating <strong>and</strong> empowering a regulatory body;<br />

(iii) Establishing a nati<strong>on</strong>al register or inventory <strong>of</strong> radioactive sources;<br />

<strong>and</strong><br />

(iv) Establishing a system for <strong>the</strong> notificati<strong>on</strong>, authorizati<strong>on</strong> <strong>and</strong><br />

c<strong>on</strong>trol <strong>of</strong> radioactive sources.<br />

In additi<strong>on</strong> to <strong>the</strong> above, <strong>the</strong> exporting State may c<strong>on</strong>sider <strong>the</strong> following<br />

informati<strong>on</strong>, if provided to, <strong>and</strong> made available by, <strong>the</strong> IAEA with <strong>the</strong><br />

c<strong>on</strong>sent <strong>of</strong> <strong>the</strong> importing State:<br />

The importing State’s resp<strong>on</strong>ses to <strong>the</strong> <strong>Import</strong>ing <strong>and</strong> <strong>Export</strong>ing States<br />

Questi<strong>on</strong>naire (attached in Annex I <strong>and</strong> described in paragraph 18);<br />

Whe<strong>the</strong>r <strong>the</strong> importing State has written to <strong>the</strong> Director General<br />

indicating that it is working towards following <strong>the</strong> guidance c<strong>on</strong>tained<br />

in <strong>the</strong> Code; <strong>and</strong><br />

Whe<strong>the</strong>r <strong>the</strong> importing State participates in IAEA programmes designed<br />

to assist States in streng<strong>the</strong>ning <strong>the</strong>ir nati<strong>on</strong>al infrastructure for <strong>the</strong><br />

c<strong>on</strong>trol <strong>of</strong> radioactive sources (see paragraph 19).<br />
