APPLICATION OF THIS GUIDANCE<br />

5. This <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> provides a comm<strong>on</strong> framework for <strong>the</strong> import <strong>and</strong> export <strong>of</strong><br />

Category 1 <strong>and</strong> 2 sources. States may also apply this framework to o<strong>the</strong>r<br />

radioactive sources, or may apply c<strong>on</strong>diti<strong>on</strong>s in additi<strong>on</strong> to <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong><br />

this <str<strong>on</strong>g>Guidance</str<strong>on</strong>g>. States may also c<strong>on</strong>sider this <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> in <strong>the</strong> c<strong>on</strong>text <strong>of</strong> an<br />

export or import <strong>of</strong> an aggregati<strong>on</strong> <strong>of</strong> sources that may pose a risk similar to<br />

Category 1 or 2 sources (see paragraph 3.5 <strong>of</strong> Categorizati<strong>on</strong> <strong>of</strong> <strong>Radioactive</strong><br />

<strong>Sources</strong>, IAEA Safety St<strong>and</strong>ards Series No. RS-G-1.9, for additi<strong>on</strong>al<br />

informati<strong>on</strong> <strong>on</strong> aggregati<strong>on</strong> <strong>of</strong> sources). This <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> should not be<br />

c<strong>on</strong>strued to amend or supersede applicable guidance under o<strong>the</strong>r multilateral<br />

import <strong>and</strong> export arrangements, in particular those established by regi<strong>on</strong>al<br />

organizati<strong>on</strong>s <strong>of</strong> an integrati<strong>on</strong> or o<strong>the</strong>r nature, provided that any such<br />

organizati<strong>on</strong> is c<strong>on</strong>stituted by sovereign States. States should interpret this<br />

<str<strong>on</strong>g>Guidance</str<strong>on</strong>g> in accordance with o<strong>the</strong>r initiatives that promote n<strong>on</strong>-proliferati<strong>on</strong>,<br />

nuclear safety <strong>and</strong> security, <strong>and</strong> <strong>the</strong> preventi<strong>on</strong> <strong>of</strong> malicious acts using<br />

radioactive sources. In <strong>the</strong> applicati<strong>on</strong> <strong>of</strong> <strong>the</strong> <str<strong>on</strong>g>Guidance</str<strong>on</strong>g>, <strong>the</strong> establishment <strong>and</strong><br />

use <strong>of</strong> bilateral arrangements between <strong>the</strong> exporting <strong>and</strong> importing States is<br />

encouraged.<br />

VII.<br />

EXPORT OF CATEGORY 1 SOURCES<br />

6. Each State should establish procedures for <strong>the</strong> authorizati<strong>on</strong> <strong>and</strong> c<strong>on</strong>trol <strong>of</strong><br />

exports <strong>of</strong> Category 1 sources. These procedures should cover <strong>the</strong> evaluati<strong>on</strong><br />

by <strong>the</strong> exporting State <strong>of</strong> <strong>the</strong> applicati<strong>on</strong> for an export authorizati<strong>on</strong><br />

submitted by <strong>the</strong> exporting facility; obtaining <strong>the</strong> c<strong>on</strong>sent <strong>of</strong> <strong>the</strong> importing<br />

State prior to authorizing <strong>the</strong> export; <strong>and</strong> providing notificati<strong>on</strong> to <strong>the</strong><br />

importing State prior to <strong>the</strong> specific shipments (see paragraphs 7–9). Each<br />

State should have appropriate measures in place for enforcing <strong>the</strong>se<br />

procedures. In cases <strong>of</strong> excepti<strong>on</strong>al circumstances, as described in paragraphs<br />

15 <strong>and</strong> 16, <strong>the</strong>se procedures should be followed to <strong>the</strong> fullest extent possible.<br />

EVALUATION OF APPLICATIONS FOR EXPORT AUTHORIZATION<br />

7. In deciding whe<strong>the</strong>r to authorize an export <strong>of</strong> <strong>on</strong>e or more Category 1<br />

source(s), <strong>the</strong> exporting State should:<br />
