IMPORT OF CATEGORY 1 AND CATEGORY 2 SOURCES<br />
13. Each State should establish procedures for <strong>the</strong> authorizati<strong>on</strong> <strong>and</strong> c<strong>on</strong>trol <strong>of</strong><br />
imports <strong>of</strong> Category 1 <strong>and</strong> 2 sources. Each State should have appropriate<br />
measures in place for enforcing <strong>the</strong>se procedures. In deciding whe<strong>the</strong>r to<br />
authorize an import <strong>of</strong> such a source or sources, <strong>the</strong> importing State should:<br />
(a) Only do so if <strong>the</strong> recipient is authorized to receive <strong>and</strong> possess <strong>the</strong><br />
source(s) in accordance with <strong>the</strong> laws <strong>and</strong> regulati<strong>on</strong>s <strong>of</strong> <strong>the</strong> importing<br />
State.<br />
(b) Satisfy itself that it has <strong>the</strong> appropriate technical <strong>and</strong> administrative<br />
capability, resources <strong>and</strong> regulatory structure needed for <strong>the</strong><br />
management <strong>of</strong> <strong>the</strong> source(s) in a manner c<strong>on</strong>sistent with <strong>the</strong> provisi<strong>on</strong>s<br />
<strong>of</strong> <strong>the</strong> Code. This c<strong>on</strong>siderati<strong>on</strong> should be based <strong>on</strong> whe<strong>the</strong>r <strong>the</strong><br />
importing State has established a regulatory framework covering at least<br />
Category 1 <strong>and</strong> 2 sources, which is in place <strong>and</strong> operati<strong>on</strong>al, by:<br />
(i) Promulgating radiati<strong>on</strong> protecti<strong>on</strong> legislati<strong>on</strong> <strong>and</strong> regulati<strong>on</strong>s;<br />
(ii) Designating <strong>and</strong> empowering a regulatory body;<br />
(iii) Establishing a nati<strong>on</strong>al register or inventory <strong>of</strong> radioactive sources;<br />
<strong>and</strong><br />
(iv) Establishing a system for <strong>the</strong> notificati<strong>on</strong>, authorizati<strong>on</strong> <strong>and</strong><br />
c<strong>on</strong>trol <strong>of</strong> radioactive sources.<br />
(c) C<strong>on</strong>sider <strong>on</strong> <strong>the</strong> basis <strong>of</strong> <strong>the</strong> available informati<strong>on</strong>:<br />
(i) Whe<strong>the</strong>r <strong>the</strong> recipient has been engaged in cl<strong>and</strong>estine or illegal<br />
procurement <strong>of</strong> radioactive sources;<br />
(ii) Whe<strong>the</strong>r an import or export authorizati<strong>on</strong> for radioactive sources<br />
has been denied to <strong>the</strong> recipient, or whe<strong>the</strong>r <strong>the</strong> recipient has<br />
diverted for purposes inc<strong>on</strong>sistent with <strong>the</strong> Code any import or<br />
export <strong>of</strong> radioactive sources previously authorized;<br />
(iii) The risk <strong>of</strong> diversi<strong>on</strong> or malicious acts involving radioactive<br />
sources.<br />
14. If, after c<strong>on</strong>sidering <strong>the</strong> informati<strong>on</strong> in paragraph 13, <strong>the</strong> importing State<br />
decides to authorize <strong>the</strong> import, it should take appropriate steps to ensure<br />
that:<br />
(a) A copy <strong>of</strong> <strong>the</strong> recipient authorizati<strong>on</strong>, or <strong>the</strong> importing State’s<br />
c<strong>on</strong>firmati<strong>on</strong> that <strong>the</strong> recipient is authorized to receive <strong>and</strong> possess <strong>the</strong><br />
