Instead, I prefer sharingwith you my motivation for getting involvedwith the Quid, and just a fun factabout myself.The ambition which motivated me toapply for the position of Co-Editor-in-Chiefof the Quid Novi is to act as the intermediarybetween you, the readers, and thosewho wish to share their thoughts withyou. The last time I was the “intermediary”was at my Cegep, for theEnglish/Spanish/German literary magazine,The Brief, or whatever it was! Twohundred and fifty copies were printed anddistributed per issue, but whenever Iasked for some feedback on the latestone, I was met with a blank stare and fourwords I would come to hate in this particularorder: “What’s The Brief?” This saddenedme more than anything else: Iknew how important it was for those whosubmitted something to get their messageheard, and to connect. I vowed, “neveragain!”On a lighter note, I wish to share with youthe top three three coolest things I haveever won! I believe this is a lovely conversationstarter forpeople just gettingto know eachother. And so, mytop three are: aone-day trip toDisneyland inFlorida when I wassix, a meter-longToblerone chocolatewhen I was nine, and just last summer,an olive wreath for coming in first ata race in Olympia, Greece.Let’s get the conversation started, LawFac!THOMAS GAGNON-VAN LEEUWENMalgré mon narcissisme envahissant —mais non, je blague — je n’aime pas parlerde moi-même. Malheureusement, certainsétudiants plus vieux avaientmultiplié les références osées (pensezmotel et bubble bath, bref) qu’en tant quejeune innocent de 12 ans, je n’avais pasjugé bon d’éliminer. She tasted tears for the firsttime.Antoine de Saint- Exupéry, the first manwho had touched her heart. Antoine deSaint-Exupéry, the first man who got tosee her soul. She wrote him a letter: shewanted to write, she wanted to read, shewanted to play, she wanted to be.Attached to a red balloon, the letter flewin the sky, disappeared between theclouds. This year’s Orientationwas the result of months of dedicationand hard work by the Orientation Committee,and the end of months of anxietyon the part of the 1Ls. Our theme was“Bienvenue à Chancellor Day High,”conceived not by students, but by AssistantDean Topsakal. Apparently, while alot has changed since she was a new studentat McGill, the high school atmospherehasn’t: we still have lockers, a caf,and a prom. And rather than hide thatfact, this Orientation we embraced it.Il y aurait trop de faits marquants à noter,mais personne n’oubliera de sitôt la premièrejournée avec le discours de bienvenuedu Doyen, la découverte de la culture« Amenez votre vin » au restaurant L’Académie,suivi d’un party ’90 à La Shop (quidevient de plus en plus connue à la Faculté).La Chasse aux trésors et la Tournéedes bars ont testé l’endurance de tousdans la chaleur et la compétition. Deuxcoffeehouses plus tard, le Bal de Bienvenuea conclu l’Orientation tout en style,avec les avocats de McCarthy qui ont définitivementapprécié notre classe.This year, the Committee focused on twomajor themes: getting the 1Ls out of the“McGill bubble” and into the community;and creating more opportunities for meaningfulinteraction among the new class,and between 1Ls and upper years. To accomplishboth these goals, upper yearsled teams of 1Ls through a campus tour,the Scavenger Hunt, the Pub Crawl, a trivianight, and a foosball tournament atthe LSA Coffeehouse. Congratulations goout to the winning team, the Young Offenders.You’ll be able to recognize them bytheir golden coffeehouse mugs (it’s surprisinghow much gold looks like canary yellow…),and the swagger in their step.Mais ce ne sont pas que les Young Offendersqui ont développé des relations durablesentre eux et avec les étudiants desannées supérieures. Cette année, unesérie d’événements en soirée ont permis àtous et chacun de rencontrer et de découvrirla nouvelle cohorte, et la présencemarquée des étudiants de tous les niveauxdémontrent leur succès. Ces événementsont également ouvert les horizonsde tous à ce que Montréal a de mieux àoffrir, allant du Quartier Latin au Vieux-Port.Orientation wasn’t only about socializing.Through the Law Partner program, firstyears made connections with upper yearswho will be able to help them out whenthe stress starts in November. The SAOalso began its six-part first year workshopseries, designed to help the 1Ls throughoutthe year with handling the stressesof their first year. With all the cross-yearconnections madethrough Law Partners,Orientation teams,and at nightlifeevents, the new classwill be able to take fulladvantage of the supportnetwork ourMcGill Law communityoffers.Finalement, nous souhaitonsremerciergrandement les membresdu Comité del’Orientation, dont letravail acharné et ledévouement tout au long de l’été ontcontribué aux amitiés créées durant cesdeux semaines, permettant aussi à l’annéede commencer dans le plus grand enthousiasme.Nos stars de l’organisationsont Arianne Bouchard, Damian Marczuk,Ève Gervais-Quenneville, Georgia Papadolias,Marie-Andrée Plante, Marie-LaureTapp et Paul Girard. Si vous les apercevezdans les corridors, laissez-leur savoir qu’ilsont fait un travail incroyable. I immediately criticizedthe programme, all nine of whose eventswere centred on drinking:J’aurais bien préféré que les activitésd’accueil ne tournassent pas toutesautour de l’alcool. Déjà la consommationexcessive de l’alcool ronge la professionjuridique, et il messied quenous inculquions cette habitude auxnouvelles étudiantes et nouveauxétudiants, surtout les très jeunes.L’omniprésence de boissons alcooliquesen veux-tu en voilà sert aussi àexclure celles et ceux qui ne prennentpas de telles boissons ou qui (commedans mon cas) n’apprécient point lesévénements où l’ivresse est au premierplan.Two people responded, and I answeredthem as follows:Minime fraction ? Il seraitintéressant que vous interviewassiezdes étudiantEs plus âgéEs, moinsnantiEs ou racialiséEs, ainsi que celleset ceux dont la culture ou la religiondiffère beaucoup de la norme canadienne.Ces personnes se sententellesincluses et bienvenues ?Apprécient-elles un programmed’événements assourdissants et bachiques? Y participent-elles ? Se sentent-ellesisolées ?I take the liberty of reproducing my commentsin full here because you will notsee them elsewhere: the LSA quickly andquietly deleted the discussion.When I objected to this act of censorship,the president of the LSA justified it in e-mail on the grounds that my commentsabove, which strike me as measured andsedate, had left some students “mal àl’aise”. Yet the LSA never intervened whenthe forum filled with personal attacks onme. Some animals, it seems, are moreequal than others.Beyond squelching an important discussion,the LSA fostered an atmosphere ofharassment that left numerous students“mal à l’aise”. Of the many students thatprivately supported my opinions, quite afew admitted that the onslaught of personalabuse directed at me had intimidatedthem into silence. This incident of intimidationand censorship suggests that theLSA may not be fulfilling its mandate, definedin its constitution as “to represent, inform,and develop the educational,cultural, political, and social interests ofits members”.In light of this ugly incident, I hope to starta frank, open, and intelligent discussion ofnot only the place of alcohol in our facultybut also the composition and character ofour student body.First of all, the prudence of centring socialevents on heavy drinking is questionable.Bad drinking habits developed in lawschool are likely to contribute to the legalprofession’s already appallingly high rateof alcohol addiction, which receives scantattention within the faculty. The manystudents who have only recently attainedthe drinking age may tbe particularly vulnerableto irresponsible drinking practicespromoted through social pressure withthe apparent endorsement of the LSA.Whole events that revolve around juveniledrinking games not only jeopardizethe academic performance of enteringfirst-year students but also compromisetheir safety, as the large number of robberiesat one of the LSA’s recent bacchanalianbashes indicates.QN • SEPTEMBER 13 2011 • 7

The selection of alcohol-centred activitiesfor all nine of the nighttime events willcertainly exclude and alienate a largenumber of people; it is thus antithetical tothe socializing that orientation is intendedto foster. Æsthetic considerations too militateagainst a monotonous choice of activities,however justified by appeal toputatively majoritarian interests. It is onething to hold Dionysian orgies on two orthree evenings but quite another to holdthem on all nine, for that arrangementleaves many of us with no social activity atall that we can attend without compromisingourselves—something that no studentat the faculty should have to do.Perhaps it was my comment about diversitythat allegedly left some people “mal àl’aise”. I wish to discuss the question insome detail, however, because it is an importantone that we should not be afraidto address.Our student body is predominantly young,white, rich, urban, and Western. Weshould be particularly careful not to exclude,isolate, or alienate students fromunderrepresented populations. Yet alcohol-centredevents do precisely that—afact that escapes the notice of many ofthe rich, white, Canadian yuppies thatmake up the bulk of the student body.Such events tend to exclude or marginalizeentire categories of people: observantreligionists (including Muslims, Sikhs,adherents of certain Christian denominations),people from various Middle Easternand African societies, many peoplefrom Indigenous nations of occupied TurtleIsland, people with health problems ofvarious kinds, people with a personal orfamilial history of alcoholism. Those of usknown euphemistically as “mature students”are likely to feel out of place at abeer-guzzling contest, really the provinceof the young. Perhaps women disproportionatelyabstain from boozy events witha macho pedigree. These considerationsappear not to have informed the selectionof nighttime activities for orientation.Wealth—the elephant in the room at ourfaculty—also coloured the programme.Several events were expensive enough toexclude some students or impose a considerablehardship. One event included theglib announcement “Bottle at 120$ (insteadof the usual 170-180$)”. My jawdropped at that price. Two decades ago,when I was pursuing my first degree, I hadto defer my studies in order to work;twice I almost had to drop out of universityfor want of money. I never set foot ina bar then; I could not afford even a fewdollars for a drink, never mind $120. Evennow, with some savings in the bank, Iwould never spend that much. Presumablythe event was based not on a desire toexclude (or coerce) students who cannotjustify such lavish expenditures but ratheron the background assumption of wealth,and the question of affordability neverarose.The LSA saw fit to censor questions that itshould instead encourage. If our commitmentsto diversity, equity, and responsibilityare not just empty words, we shouldnot shrink from forthright discussion ofthese issues. Being “mal à l’aise” withcontroversial topics ill befits budding jurists.GREENLAWCOMMITTEEREUSABLE DISHWARE SERVICEThe Green Law Committee is pleased to announce its newestproject: a reusable dishware service! SOUSSI-GNÉ-E-SSTATEMENT IN SUPPORT OFMUNACAMUNACA (The McGill University Non-AcademicCertified Association) represents1,700 non-academic staff at McGill. In theFaculty of Law, MUNACA members includeThomas Chalmers and Dalia Piccioniat the Student Affairs Office, StephanieNowak at the Career Development Office,many individuals who work for the McGillLaw library, and support staff for both theadministration and professors.MUNACA's most recent collective bargainingperiod with the university started inDecember 2010, but MUNACA and McGillwere unable to come to an agreement. Inan effort to pressure McGill to be moreopen to the workers' demands, on August24th 2011, the members of MUNACAvoted 88% in favour of strike action if MU-NACA's negotiations with the McGill administrationdid not bring both parties toan agreement. Atthe Université de Montréal, UQAM andConcordia, non-academic staff progressalong a wage scale based on their years ofservice. Based on the position and classificationat these universities, it takes between3 to 14 years for employees at theseuniversities to get to the maximum wagescale position. In otherwords, that McGill has thoroughly consideredways to reduce costs by meansother than paying employees below averageand slashing retiree benefits, and isworking as hard as it can to lobby for increasedprovincial and federal governmentfunding for universities. We havenot seen an indication that this is thecase. If there isno agreed finding of questionablecontent, the article is published as is, orwith edits at the discretion of the Editorsin-Chief.3) ConsultationAt the Consultation stage, the Editors-in-Chief must advise the author that there isa content concern. The Editors-in-Chiefmay consult others about the submission,provided there is no information givenidentifying the author(s). The Editors-in-Chief may consult with any individualsmentioned in the article, fellow students,faculty members, and/or alumni, at thediscretion of the Editors-in-Chief. Consultationis not a question of how-many-forvs. how-many-against; rather, given thenature and role of the Quid, consultationis premised on whether the specificcontent is suitable for publication. The authormay be consulted numerous times ifthe Editors-in-Chief feel this is necessary.4) DecisionThe Editors-in-Chief will discuss the resultsof their consultations and will rendera decision to: [a] accept the submission asis; [b] accept the submission with minoredit(s) to be completed by the Editors-in-Chief; [c] return the submission to the authorfor modification with suggestionsprovided at the discretion of the Editorsin-Chief,or, alternatively, [d] reject publicationwithout modification suggestions.The decision of the Editors-in-Chief is finaland binding. The Editors-in-Chief, attheir discretion, may publish a notice ofrejection in the Quid with their reasons,indicating, at their discretion, the name(s)of the author(s). Alternatively, the author(s)may request that such a notice appear,in which case the notice will bearthe format: AUTHOR -- YEAR -- TITLE OFSUBMISSION was submitted for publicationbut will not be printed in accordancewith the Quid Policy and Operational Guidelines.6) NOTICE AND AMENDMENT PROCESSThe Editors-in-Chief shall publish theseguidelines in the Quid in the first issue ofevery semester. Changes may only be proposedby Quid staff. If there is a proposedchange, it will be indicated in the nextissue of the Quid with the opportunity forstudents to make submissions for a periodof at least one week. Changes must be approvedby a majority of active Quid staff.The Editors-in-Chief must publish noticeof any change or change attempt in theQuid.VERSION FRANÇAISELorsque c’est possible, le Quid publietoutes les contributions qu’il reçoit. Il estdonc essentiel qu’il suive des politiques etprincipes transparents, qui prennent enconsidération la valeur de la liberté d’expressionainsi que les intérêts des étudiantset des professeurs. Les politiques etles principes d’opération sont exposés cibas.Les questions et commentaires s’yrapportant peuvent être adressés à :quid.law@mcgill.ca. Cette politique estmise à jour à la discrétion des rédacteursen-chef,à la seule condition qu’un préavisde la mise à jour soit publiée dans le Quid.Cette version de la politique s’appliquedepuis 2010. chaque numéro. Les articles soumis doiventcontenir le nom de l’auteur ainsi queson année d’étude. Si l’auteur écrit dansun rôle particulier (i.e. “Président del’AÉD”; “Président d’un club étudiant”),ceci doit également être indiqué.Aucun item soumis après la date limite nesera publié sans le consentement explicitedes rédacteurs-en-chef. Les contributionstardives seront conservées et publiéesdans le numéro subséquent.Les articles soumis pour publication peuventêtre révoqués par l’auteur, du momentque cette requête soit faite aumoins deux jours avant la publication dunuméro en question. Le Quid fera de sonmieux pour faire suite à une requête tardive,mais il n’arrêtera pas la publicationd’un numéro qui est déjà en impression.3) POLITIQUE DE CONTRIBUTION ANO-NYMELe Quid publiera des articles anonymes, àla condition que ceux-ci se conforment àses politiques et principes d’opération. Lesarticles anonymes présentent un défi particulierpour la révision du contenu, car ilsne permettent pas aux rédacteurs-en-chefde consulter avec l’auteur. Ainsi, si un articleanonyme est refusé, un avis de refusdoit être publié dans le Quid.4) POLITIQUE DE CORRECTIONChaque item soumis au Quid sera révisé.Le Quid se réserve le droit de faire desmodifications grammaticales afin d’améliorerla présentation et la lisibilité d’un article.Les rédacteurs peuvent égalementcorriger les fautes d’orthographe. Si unecontribution nécessite des modificationsimportantes, dans l’avis de la personnequi le révise, ceci sera indiqué aux rédacteurs-en-chef.Ceux-ci peuvent refuser depublier l’article ou bien effectuer des modificationsimportantes pour ensuite lepublier. Les modifications mineures nesont pas nécessairement communiquéesà l’auteur avant la publication.5) POLITIQUE DE RÉVISION DU CONTENUToutes les contributions au Quid serontrévisées au niveau du contenu. Il existe unprocessus de révision comportant quatreétapes.1) Révision par le rédacteurLe rédacteur ou rédacteur-en-chef chargéde la révision d’un article accomplit cettetâche en vérifiant s’il contient du contenucontestable. Le contenu contestable dénotedu contenu que le rédacteur enquestion juge comme potentiellement offensantou autrement inadéquat pour lapublication. Les facteurs suivants serontconsidérés lors de l’évaluation du potentieloffensant: le ton général de la contribution,les mots précis utilisés dans leurcontexte précis, ainsi qu’une appréciationde la réaction potentielle du corps étudiant,des professeurs, des anciens étudiantset de la communauté juridiquemontréalaise. Si le rédacteur individuelestime que le contenu est contestable, ilcommunique ceci aux rédacteurs-en-chef.Les items qui sont potentiellement inadéquatspour la publication incluent (sanss’y limiter): les contributions qui sont troplongues ou trop courtes; les contributionsqui possèdent le potentiel de créer un environnementhostile pour les professeursou les étudiants; et les contributions à naturediffamatoire.2) DiscussionÀ la deuxième étape de la révision, les rédacteurs-en-chefet le rédacteur qui a accomplila révision initiale discutent deleurs conclusions spécifiques vis-à-vis l’article.S’il existe un consensus de contenucontestable parmi une majorité (moinsdeux sur trois parmi le rédacteur et les rédacteurs-en-chef),l’article procède àl’étape de la consultation. S’il n’existe pasun tel consensus, l’article est publiécomme tel ou avec des modifications portéesà la discrétion des rédacteurs-enchef.3) ConsultationAu stade de la consultation, les rédacteurs-en-chefdoivent aviser l’auteur qu’ilexiste des préoccupations au niveau ducontenu. Les rédacteurs-en-chef peuventconsulter d’autres individus au sujet de lacontribution, à la condition de ne fourniraucune information permettant d’identifierl’auteur. Les rédacteurs peuventconsulter avec des individus mentionnésdans l’article, d’autres étudiants, des professeursou des anciens étudiants, à leurpropre discrétion. La consultation n’estpas un concours de “combien-sont-pourvs. combien-sont-contre”. Compte tenu dela nature et du rôle du Quid, la consultationdoit déterminer si le contenu spécifiqueest digne de publication. L’auteurpeut être consulté à de nombreuses reprisessi les rédacteurs-en-chef jugent quececi est nécessaire.4) DécisionLes rédacteurs-en-chef discuteront des résultatsde leurs consultations et rendrontune décision de: a) accepter la contributioncomme telle; b) accepter la contributionavec des modifications mineuresportées par eux-mêmes; c) retourner lacontribution à l’auteur pour modificationavec des suggestions portées à la discrétiondes rédacteurs-en-chef; d) rejeter lacontribution sans offrir des suggestions.La décision des rédacteurs-en-chef est finaleet incontestable.Les rédacteurs-en-chef, à leur discrétion,peuvent publier un avis de refus dans leQuid avec les raisons du refus ainsi que lenom de l’auteur. L’auteur peut égalementdemander qu’un tel avis apparaisse; dansun tel cas, l’avis portera le format suivant:« AUTEUR --- ANNÉE --- TITRE a été soumispour publication mais ne sera pas imprimé,en accord avec les politiques etprincipes d’opération du Quid ».6) POLITIQUE DE PRÉAVIS ET D’AMENDE-MENTLes rédacteurs-en-chef publieront cesprincipes dans le premier numéro du Quidà chaque semestre. Des amendementspeuvent être proposés uniquement par lepersonnel du Quid. Si un amendement estproposé, il sera indiqué dans le numérosubséquent du Quid afin d’offrir une opportunitéd’au moins une semaine auxétudiants de rédiger des contributions.Les amendements doivent être approuvéspar une majorité du personnel actif duQuid. Le connu-méconnu fascine.Ce lampadaire explose encrépitement frictionnel, tambour rythmé,bruissement d’ailes incohérent. L’électricitétrace sa voie au-travers des fils, combattantles secondes. Elle monte etdescend, avec minutie, crie à tue-tête.L’ampoule s’allume. Un nuage se forme.Venus de partout et de nulle part, tousrassemblés sous son éclat envoutant, ilsappartiennent maintenant à un seul etmême groupe, photographiés dans letemps. En effet, leur diversité s’éclipsesous une impulsion donnée. Car elle, la diversité,est une chose bien relative.Il y en a beaucoup qui veulent faire unedifférence dans leur milieu, améliorer lequotidien des autres et réformer la société.Pour ce faire, il est nécessaire de lacomprendre, ainsi que son cadre, maisaussi d’avoir un regard juste et sans préjugésur ceux qui la forme. Car elle, la diversité,est une chose bien relative.Les messages d’introduction sont travestisde par nature. Ils ont pour but de donnerun aperçu, de synthétiser, ce qui ne peutl’être. L’expérience devra être vécue. Pleinement.En ce sens, à quoi bon le faire?Vaut mieux donner un conseil qui, aussiinsipide alors, prendra tout son sens aumoment venu. Un message générals’adaptera au plus grand nombre, à ces individussi différents et pourtant, tellementsimilaires. Car elle, la diversité, est unechose bien relative.Le partage d’un point de vue peut s’avérerdéterminant dans la construction d’uneperspective large, à la fois simple et complexe.Certaines pensées promulguées par d’autrespeuvent faire germer dans l’espritd’autrui des réflexions particulièrementintéressantes et même, se révéler la cléd’une porte dont il ignorait jusqu’alorsl’existence. Sommes-ils différents, ses papillonsde nuits, moustiques et autres,sous le halo du lampadaire?Assurément, de par nature, ils le sont. Cependant,leur fonction les unit, les transforme.De même que leurs actes. Ils secoulent, ils se moulent. De ce qu’ilsétaient, que restera-t-il?Ils ont un passé. Celui constitué avant quela lumière ne s’allume. Ils ont un futur.Celui après.
