The principal must, in any event, disclose the following defects:<br />
- wind sucking and crib biting;<br />
- periodic ophthalmia (moon blindness);<br />
- box walking;<br />
- weaver (transfer of weight from one forelimb to the other alternately).<br />
Should these not be disclosed, the buyer may make a claim within 8 days from the date of purchase. All claims<br />
for the above defects must be made by the buyer directly both to the principal and to S.G.A., which may temporarily<br />
retain the amount received for the sale until the dispute is settled, in an account which does not bear<br />
interest for the contracting parties.<br />
In case of redhibitory defect the horse will be put, to expenses of the purchaser, in a veterinary clinic chosen<br />
by S.G.A., in order to attest and to document the nature and truthfulness of the defect.<br />
The sale by auction of a horse affected by laryngeal paralysis or by epiglottic entrapment, will give rise to the<br />
termination of the contract by express agreement of all those persons who enter horses for the sale provided<br />
that the horse has not been removed from the sale area by the purchaser.<br />
The purchaser, if he think that the horse is affected by laryngeal paralysis or by epiglottic entrapment, is entitled,<br />
within mid-day of the day following adjudication, and in any event without removing the horse from<br />
the sale area, to subject the yearling to a lunging test (or wind test) or, alternatively, if stated among the parties,<br />
to the endoscopy. Should the veterinary surgeon detect suspicious breathing noises, and only in such<br />
case, he shall notify S.G.A.’s office on the appropriate form of the veterinary certification. S.G.A. shall immediately<br />
inform the Principal of the claim.<br />
The Principal shall be entitled, within 24 hours of the notification, to have the same test carried out by his<br />
own veterinary surgeon. In case of dispute between the diagnoses of the two veterinary surgeons of the parties,<br />
the Principal and the purchaser shall submit the dispute to the binding decision of a third veterinary surgeon,<br />
appointed by S.G.A., who shall be entitled to carry out an endoscopy.<br />
Should the fault exist, and the purchaser have already paid the price for the horse, S.G.A. is authorized to return<br />
it. Claims by buyers for any other cause must also be notified by the buyer to the principal and to S.G.A.<br />
No claim may, in any event, be made to the principal if the buyer has not paid for the horse in dispute; S.G.A.,<br />
at its sole discretion, may temporarily retain the amount received for the sale until the dispute is settled in an<br />
account which does not bear interest for the contracting parties. In the case of cancellation of the sale, the<br />
principal shall be obliged to pay the sales commission equal to 5% of the sale price.S.G.A. recommends to<br />
buyers that they should carefully inspect the horses before they purchase them, asking the Principal directly,<br />
whenever they believe it appropriate, to carry out x-rays at their own expense. The breeder may, in his turn,<br />
file all veterinary documentation at the Offices for examination by possible buyers.<br />
Art. 7 – PROHIBITION AGAINST USE OF DRUGS<br />
Principals are expressly prohibited from using anti-inflammatory drugs or anabolic steroids or any of them indicated<br />
in UNIRE rules, except for those curative tretaments, notified in advance .<br />
The use of anti-inflammatory drugs which can mask defects or injuries of the horses must be declared prior<br />
to the Auction Sale.<br />
S.G.A. reserves the right to do inspections, following the UNIRE rules.<br />
The buyer may also ask for these checks to be carried out after the purchase at his own expense, before the<br />
horse leaving the sales area.<br />
Any positive outcome shold be immediately transmitted from the buyer to the principal, who will be immediately<br />
entitled to do inspections by himself. If the two tests disagree, principal and buyer will submit to the<br />
bidding arbitration of a third lab, nominated by S.G.A.<br />
In the case of a positive outcome, the sale may be declared void under article 6.<br />
Art. 8 – OTHER OBLIGATIONS OF THE PRINCIPAL<br />
Horses destined to be put up for sale at the auction must be on the premises before the time of the sale in order<br />
to be inspected by buyers (at least 24 hours before they go into the ring). Principals must assure the presence<br />
of a groom, paid for by them, and acting under their responsibility, for the custody of not more than 4<br />
horses for each groom.<br />
Art. 9 – PRINCIPAL’S AND BUYER’S OBLIGATIONS RELATIVE TO<br />
