The turnover must be composed for at least two thirds by the sale of agricultural products included in Table A,<br />
part I, Presidential Decree 633/72:<br />
- invoice with application of V.A.T. of 21% on the sale price;.<br />
c) farmers subject to simplified regime with a turnover – achieved in the previous calendar year – higher than<br />
Euro 2.582,28 (Euro 7.746,85 for mountain communities)<br />
The turnover must be composed for at least two thirds by the sale of agricultural products included in Table A,<br />
part I, Presidential Decree 633/72<br />
- declaration by principal who is agricultural producer from which the exemption regime from the issue of the<br />
invoice results;<br />
- issue of self-invoice by buyer who acts as person exercising business activities applying the percentage of setoff<br />
equal to 7.5% already included in the sale price of the horse;<br />
3) private individual without V.A.T. number<br />
- issue of a releasing receipt to be delivered to buyer (whether individual or person exercising a business activity)<br />
applying the stamp of Euro 1,29 with the following wording: “Transaction excluded from the scope of application<br />
of V.A.T. because of the absence of the subjective requisite under articles 1 and 4 of Presidential Decree<br />
633/72”.<br />
Principals must give notice in writing to S.G.A.’s administration of the details necessary to invoice the horses<br />
sold at auction (VAT regime applied, progressive number of invoice and date of issue). In the absence of such<br />
indications, the time limit for payment shall be deferred.<br />
CHARGED TO BUYER:<br />
- VAT on sale price for the horse on the basis of point 1) and 2) above, subject to exclusion;<br />
- COMMISSION FEE: 5% (subject to V.A.T. % and tax withholding, if due, under the provisions set forth in article<br />
9) on the sale price, auction commission in favour of S.G.A., whether the horse has been sold on the fall of the<br />
hammer of the auctioneer, or whether it is sold by private treaty (article 18).<br />
The auction commission shall be applied also to the amount of any eventual reserves on prizes won communicated<br />
to S.G.A.;<br />
- Euro 68,62 (Euro 54,00) due to the UNIRE Area Galoppo for the transfer of title. Such transfer of title shall be<br />
effected only once the balance of the purchase price has been paid together with the relative auction fees.<br />
Art. 17 – ENTRIES<br />
Should a horse be declared on sale at the auction with its entries (Italian or foreign), the buyer shall be responsible<br />
for taking on any further future forfeit fees.<br />
The principal shall be responsible for entries not indicated in writing.<br />
Art. 18 – SALES BY PRIVATE TREATY<br />
In respect of any horse sold by private treaty entered in this catalogue and reported as unsold during the sale<br />
or at any following sales, and until the thirtieth day following the date of the sale, the buyer and principal<br />
must pay to S.G.A. the auction commissions on the declared sale price, as defined in Article 16.The current rules<br />
should be applied to private sales.<br />
These regulations shall be applied thereto.<br />
Art. 19 – SALES OF MARES<br />
The sales of mares to be considered in foal even with a medical veterinary certificate or from laboratory confirming<br />
the result of the covering will be cancelled if the mare will be considered barren or carrying twins. The<br />
diagnosis of pregnancy is done by the purchaser from a trusting veterinary o the veterinary service of the sale,<br />
before the 24 hours form the date of sale, costs and risks are in charge of the purchaser. The vendor could<br />
not refuse, after the mare is sold, toallow the diagnosis of pregnancy, punishment the cancelling of the sale.<br />
Art. 20 – DISPUTES<br />
The Court of Milan shall have sole jurisdiction over any dispute.<br />

shall at all times prevail.
