By reading the following reports from our Director,<br />

Sue Rogers, and my fellow committee chairmen, you<br />

will see that <strong>2005</strong> was a challenging but successful year<br />

for all the team involved with BAMA.<br />

Chairman’s Report<br />

The 2004 UK aerosol filling statistics have<br />

shown that, despite some filling activity moving<br />

to lower cost base countries in Eastern Europe,<br />

the <strong>British</strong> aerosol industry has been able to<br />

maintain its ground. The UK is still the<br />

European market leader in the aerosol industry,<br />

filling over 28% of all European aerosols and<br />

this is certainly an achievement we can be<br />

proud of. The <strong>2005</strong> figures were still being<br />

collated while I wrote this report, but based<br />

on all the issues that have been tackled by<br />

BAMA in <strong>2005</strong> and discussions held during<br />

our various committee and member forums,<br />

I can confidently say that our industry is still<br />

strong and very pro-active.<br />

In <strong>2005</strong>, the Executive Committee’s main goal<br />

was to scope out the industry’s strategy to ensure<br />

future success under the umbrella of ‘Sustainable<br />

Development’. The work has involved all the<br />

committees and sub-committees, which have been<br />

reorganised in line with the FEA format. We started in<br />

June by briefing member CEOs on our plans, and<br />

after an effective away day and various meetings,<br />

we have taken stock of the major issues facing our<br />

industry in the future and are well on our way to<br />

implementing an appropriate action plan. The strategy<br />

will of course be a dynamic one which will allow us<br />

to adjust our actions in line with forthcoming events<br />

or legislation.<br />

I would like to address my thanks to all our members<br />

for their support during last year, and hope that<br />

our results will encourage them to be as supportive<br />

in 2006. I am also particularly thankful to the<br />

participants of all the committees, working groups<br />

and my fellow committee chairmen for their invaluable<br />

contribution, without forgetting the committee members<br />

who retired last year and all the newcomers.<br />

Finally, I wish to say a big thank you to the BAMA<br />

dedicated team headed by Sue Rogers, without whom<br />

all our results would have been impossible to achieve.<br />

By reading the following reports, from our Director,<br />

Sue Rogers, and my fellow committee chairmen, you<br />

will see that <strong>2005</strong> was a challenging but successful<br />

year for all the team involved with BAMA. We have<br />

managed various indoor air quality and regulatory<br />

issues impacting our industry and we are still focusing<br />

our time on the EU Chemicals policy (REACH), the<br />

regulations on F-Gases including HFC use in <strong>Aerosol</strong>s,<br />

and the <strong>Aerosol</strong> Directive. BAMA has tapped into the<br />

wealth of expertise offered by its members to present<br />

unified industry views on all items to key stakeholders.

value which we aim to provide to our members.<br />

‘A valid criticism of many trade associations is<br />

that they are too concerned with short term<br />

issues and therefore fail to influence the<br />

climate of opinion which a few years down the<br />

track will generate more short term issues.<br />

The good trade associations are engaged in<br />

fire prevention as well as fire fighting.’<br />

This exactly fits our long standing philosophy in BAMA.<br />

The long term identification and management of issues is<br />

a key part of the service and added value which we aim<br />

to provide to our members. The quote is taken from a<br />

recent report by Mark Boléat, a well known expert in the<br />

management and governance of trade associations. He<br />

was commissioned to review high level representation of<br />

the chemicals industry, looking at the roles of the Chemical<br />

Industries <strong>Association</strong> and the members of the Alliance of<br />

Industry <strong>Association</strong>s, the ‘AIA’.<br />

The AIA is an informal group of associations representing<br />

sectors like ours which use chemicals in their products,<br />

but are a part of the consumer goods market rather than<br />

the chemicals supply chain. We have been working<br />

together since the early 90s. The member associations<br />

group together as necessary to manage issues of particular<br />

importance to their sectors. This helps prevent the<br />

duplication of resources and to share expertise. During<br />

the 90s BAMA led the activity on behalf of the group on<br />

the SACKI (‘solvent abuse can kill instantly’) warning;<br />

recently the Directors and technical staff of all the AIA<br />

members have worked together on the requirements<br />

of REACH. Boléat’s conclusion was that the informal<br />

links between the AIA members are “an excellent example<br />

of how trade associations of their own volition cooperate in<br />

a way that benefits all of them yet at a minimal cost”.<br />

The overarching issues such as health and<br />

environment affect many of our sectors and we<br />

continue to develop ways of dealing with them<br />

effectively. For the last two years we have been<br />

working very closely with CTPA and UKCPI on indoor<br />

air quality issues. We have developed a simple web<br />

page to direct internet users to our own web sites if<br />

they are looking for information from industry on<br />

these issues. Previously, internet searches tended to<br />

yield only one side of the debate. We have also<br />

widened the networking activity to include the <strong>British</strong><br />

Fragrance <strong>Association</strong>, whose products are common<br />

to us all and their active involvement is a vital part of<br />

the future management of indoor air issues.<br />

The popular negative perception of ‘chemicals’ is central<br />

to many of the issues and the work we are doing to<br />

develop a sustainable development strategy for the sector<br />

will be part of the way we address that. In 2006 we shall<br />

continue to work on this long term initiative and will<br />

begin to involve the BAMA committees more and more<br />

in the process. As part of the strategy we are developing a<br />

Message Matrix which will form the core of our external<br />

communications on aerosol products.<br />

Equally, we do not neglect the other core activities<br />

of providing practical information and guidance to<br />

our members. A lot of work has gone into developing<br />

several guides this year such as the document<br />

‘Are YOU Getting Ready for REACH?’ BAMA, through<br />

Paul Jackson, has played an important role in the<br />

PRODUCE (Piloting REACH on Downstream Use<br />

and Communication in Europe) study, a practical<br />

run-through of the REACH process. Information<br />

BAMA welcomed the following new members during <strong>2005</strong>: KBIG Ltd;<br />

Tallon International; and Sumitomo Chemical (UK).<br />

Three members also left during the year bringing the total number of<br />

BAMA members to 66 at year end.<br />

Director’s Report<br />

from BAMA’s database and exposure model proved<br />

invaluable and we are building on that in order to<br />

provide a service in the future. From the experience<br />

of the PRODUCE study, this will be a significant and<br />

unique benefit to all members, whether large or small.<br />

I would like to thank the members who have been<br />

so involved in developing and presenting a new<br />

practical training course on propellant safety, which<br />

is proving popular.<br />

I would also like to thank all our members for their<br />

support and especially those on our committees<br />

for their hard work; and all my staff, who work<br />

extraordinarily hard. And I want to single out<br />

Vic Hyde who retired at the end of <strong>2005</strong>. Vic has<br />

been a real stalwart of the industry, BAMA and<br />

FEA for many years, and his knowledge,<br />

understanding and expertise will be greatly missed.<br />

We wish him every happiness in his retirement.<br />

AEROSOLS 2007 – THE THEME OF WHICH IS<br />

‘PROPELLING AEROSOLS WORLD-WIDE’<br />

The industry prospectus for <strong>Aerosol</strong>s 2007 says it all<br />

and our decision to use the vibrant city of Manchester<br />

is looking more comfortable by the day. Our chosen<br />

Conference Organiser, Concorde Services Ltd, has set<br />

to work already and on our stand at the FEA Congress<br />

in Athens in September <strong>2005</strong>, they managed to sell<br />

some 40% of the stand space - two years ahead of<br />

the event. As already mentioned, they have also<br />

produced an excellent industry prospectus which<br />

reflects the level of creativity and innovation going<br />

into the planning of this event.<br />

We are determined to present a new format for the<br />

Congress itself while still adhering to the main theme<br />

and to the environmental, social and economic issues<br />

affecting our industry, which are covered by the phrase<br />

Sustainable Development. Additionally, we are including<br />

the first international FEA <strong>Aerosol</strong>s Industry Awards<br />

to recognise and reward the skills within our industry.<br />

The work programme is building and the benefits of<br />

a strong committee will allow us to spread the load<br />

amongst the members but our thanks go out to the<br />

full time staff of BAMA for their continued help and<br />

commitment. This will be a truly memorable<br />

occasion for all the industry.

The Commercial and Planning Committee has met<br />

four times in <strong>2005</strong>.<br />

SUSTAINABLE DEVELOPMENT STRATEGY<br />

The Committee continued to focus on BAMA’s<br />

Sustainable Development approach. A questionnaire<br />

was developed and issued in order to get some base<br />

data for the commencement of our sustainable<br />

development journey. A CEOs’ meeting was held in June<br />

in order to canvass support for the approach, and an<br />

Executive Committee Away Day was held in the Autumn<br />

to revisit our strategy. This final event helped in<br />

crystallising our efforts and priorities have now been<br />

set for our 2006 activities.<br />

BAMA STANDARD<br />

Issue 2 of BAMA’s Standard for Consumer Safety<br />

and Good Manufacturing Practice continues to be used<br />

widely as a reference tool. Audits were carried out at<br />

component suppliers and a distribution facility in order<br />

to test the process. No formal verifications have taken<br />

place yet but it has been agreed that external ISO 9001<br />

auditors can be used to verify certain modules of the<br />

Standard. Work will start in 2006 on Issue 3 which<br />

will be launched at the FEA International <strong>Aerosol</strong><br />

Congress and Exhibition in 2007.<br />

FINANCIAL PLANNING &<br />

MEMBERSHIP RECRUITMENT<br />

The Committee reviewed the subscription rates and,<br />

as a result, subscriptions were increased in line<br />

with inflation.<br />

BAMA TRAINING<br />

BAMA courses remained popular during <strong>2005</strong>.<br />

A new course on the Safe Handling of <strong>Aerosol</strong><br />

Propellants was launched and, in total, five BAMA<br />

courses were held during the year.<br />

CHEMICALS REGULATORY FORUM<br />

BAMA is a member of this key Forum established<br />

by the DTI and The Cabinet Office. As part of its<br />

work, a study is underway to consider the cumulative<br />

burden of regulations on companies in our sector.<br />

The Committee recommended that BAMA should<br />

contribute to the study. We had a positive response<br />

from membership and data gathering will commence<br />

in early 2006.

The PR Group met three times in <strong>2005</strong>.<br />

SUPPORTING BAMA MEMBERS<br />

BAMA continued to drive and develop the annual<br />

programme of Events and Training. The two day<br />

Spring and Autumn BAMA Forums were well attended<br />

and we were delighted to welcome expert speakers<br />

covering such a broad spectrum of aerosol-related<br />

subjects. The <strong>2005</strong> AGM and Annual Lunch was<br />

held on 23 June. Training courses on the Introduction<br />

to <strong>Aerosol</strong> Technology, Safe Handling of <strong>Aerosol</strong><br />

Propellants, <strong>Aerosol</strong> Labelling, and the Transport<br />

of <strong>Aerosol</strong>s took place. These BAMA courses are<br />

extremely popular and we particularly thank all those<br />

members that assist in the running of the courses.<br />

Four new BAMA Guides were launched during the<br />

year on Transport; Packing Filled <strong>Aerosol</strong>s Safely;<br />

Warehousing; and Recycling Empty <strong>Aerosol</strong>s from<br />

Industrial, Commercial and Institutional Premises.<br />

Publication of the quarterly member update, Press<br />

for Success, continues and we are pleased that<br />

this is recognised to be such an important vehicle<br />

for ensuring members are kept up-to-date on all<br />

matters affecting the industry.<br />

PROMOTING INNOVATION<br />

As part of our drive to encourage innovation within the<br />

industry, the sponsorship of the <strong>British</strong> Design and Art<br />

Direction (D&AD) Student Design Awards culminated<br />

with judging in late April and the Awards Ceremony in<br />

July. The aerosol brief challenged students to design an<br />

aerosol product ‘that will decrease the stresses and<br />

strains of modern life or increase the quality of an<br />

experience’. We were delighted that the winners of our<br />

aerosol category, a team of students from Central Saint<br />

Martins College of Art and Design in London, then went<br />

on to win the Overall Design Award and the prestigious<br />

Yellow Pencil as D&AD Winner <strong>2005</strong>. The winners and<br />

runners up presented their concepts at the Autumn<br />

BAMA Forum. We plan to maintain our involvement with<br />

the D&AD Awards, launching an aerosol brief in April<br />

2006 for the 2007 Awards and are investigating further<br />

options of developing our links within the design field.<br />

Two further issues of Aerodynamics were produced,<br />

presenting the best in aerosol innovation and new<br />

product technology. These newsletters offer a valuable<br />

opportunity to showcase new technology and highlight<br />

new developments to both packaging decision makers<br />

and the press.<br />

Robert Opie launched his new Brands, Packaging<br />

and Advertising Museum in Notting Hill, London.<br />

Apart from the obvious nostalgic trip through<br />

packaging history, the Museum features a Metals<br />

Packaging Display, part-sponsored by BAMA, which<br />

showcases why the aerosol is still relevant today.<br />

AEROSOL RECYCLING<br />

The BAMA campaign to promote recycling of<br />

aerosols through local authorities has continued<br />

and we are delighted that now over 75% of local<br />

authorities recycle aerosols. We have taken all<br />

opportunities to promote this and will further<br />

investigate how we can assist in promoting the<br />

recycling of aerosols. In conjunction with this work<br />

we printed and promoted a new Guide: recycling<br />

empty aerosols from industrial, commercial and<br />

institutional premises.<br />

WORKING WITH RETAILERS<br />

BAMA continued to drive its direct communication<br />

link with the major retailers and two meetings of<br />

the Retailers’ Liaison Group took place within the<br />

year. During this meeting we were able to update<br />

the retail contacts on legislative and regulatory<br />

developments, alongside recent aerosol issues. We<br />

will continue this contact in 2006.

WORKING WITH THE PRESS<br />

Maintaining our focus on monitoring media attention<br />

concerning aerosols has continued. A media breakfast<br />

was held in July <strong>2005</strong>, followed by a factory visit to<br />

one of our members. These were both valuable<br />

opportunities to promote many of the developments<br />

within the industry. BAMA has for most of this year<br />

been hard at work, alongside other trade associations<br />

such as UKCPI and CTPA, to set the record straight<br />

about aerosols and air fresheners following misleading<br />

press publicity about these products.<br />

The VSA Committee met three times in <strong>2005</strong>.<br />

Thanks are due to Committee members for their<br />

continued support on this important issue. Special<br />

thanks are extended to external members Warren<br />

Hawksley, Richard Ives, Steve Lambert and John<br />

Ramsey for the passion and energy they bring to<br />

the Committee.<br />

SPONSORSHIP/PRESENTATIONS<br />

During <strong>2005</strong> the <strong>Association</strong> made a number of<br />

sponsorship contributions. In 2004, with BAMA<br />

support, Re-Solv redeveloped their successful on-line<br />

training course for professionals who are dealing<br />

with VSA. In <strong>2005</strong> BAMA followed this up with<br />

support to promote the course to users. BAMA also<br />

again provided funds to the Scottish Drugs Forum for<br />

their VS Focus newsletter. In addition, BAMA made<br />

a number of presentations highlighting industry<br />

efforts to tackle VSA, most notably at LOST and<br />

Solve-It conferences.<br />

VSA STATISTICS<br />

The 2003 St George’s report on VSA fatalities,<br />

released mid <strong>2005</strong>, revealed that in 2003 there<br />

were 51 deaths in the UK associated with volatile<br />

substance abuse. This is the lowest annual total<br />

recorded since 1983. The report ‘Trends in Death<br />

Associated with Abuse of Volatile Substances<br />

1971-2003’, which was prepared for the<br />

Department of Health, describes trends in death<br />

associated with the abuse of gas fuels, aerosols,<br />

glues and other solvent-based products.<br />

The Environment Committee met five times during<br />

the year. There were also meetings of the Scientific<br />

Panel and the <strong>Aerosol</strong> Ingredients Working Group.<br />

BAMA representatives were also heavily committed<br />

to the European <strong>Aerosol</strong> Federation (FEA)<br />

Environment Committee, the VOC Working Group,<br />

the HFC Working Group, the <strong>Aerosol</strong> Ingredients<br />

Working Group, and Integrated Product Policy<br />

Working Group.<br />

with butane cigarette lighter refills, prohibited by<br />

legislation for sale to under 18s. In 2002, there<br />

were 24 deaths in under 18 year olds, of which 15<br />

were associated with butane cigarette lighter refills.<br />

Deaths were generally sudden and in 2003 were three<br />

times more common in males than females. For both<br />

adults and children, volatile substance abuse leading<br />

to death usually took place in the home.<br />

As pointed out in previous Committee reports, the<br />

VSA Committee feels strongly that to reduce the<br />

number of deaths requires a concerted, integrated<br />

effort between experts and the government.<br />

STAKEHOLDER FORUM<br />

The Department of Health has produced a Volatile<br />

Substance Abuse framework, enlisting other<br />

Government departments in a cross-government<br />

initiative. As part of this framework, four priorities<br />

were identified:<br />

■ better education<br />

■ dealing with VSA better locally<br />

■ minimising the opportunities for abuse<br />

■ research<br />

VSA Committee members are actively involved in the<br />

working groups set up to address these priorities.<br />

INDOOR AIR QUALITY<br />

This topic continued to be a major issue and attracted<br />

considerable media attention, driven by various<br />

consumer groups and other NGOs. More recently,<br />

the European Scientific Committee on Health and<br />

Environmental Risks (SCHER) was asked by the<br />

European Commission to review some of these<br />

reports. BAMA plans some new studies which it<br />

hopes will provide invaluable defence of our<br />

products and will also help contribute to some<br />

issues under the REACH programme.<br />

VOLATILE ORGANIC COMPOUNDS<br />

The EU Thematic Strategy on Air Pollution was<br />

published this year, and although it did not specifically<br />

call for reductions in VOCs from consumer products,<br />

the supporting draft Clean Air For Europe (CAFÉ)<br />

Directive, does refer to the Decorative Paints Directive,<br />

which does set VOC content limits. Some countries,<br />

notably Belgium and Holland, are continuing to look<br />

hard at how they can further reduce their VOC<br />

emissions in order to comply with their obligations<br />

under the National Emissions Ceiling (NEC) Directive.<br />

The Dutch Government-sponsored IVAM Study on<br />

reducing VOCs from cosmetic and cleaning products<br />

was published, suggesting that some VOC reductions<br />

could be achieved from these categories of products.<br />

However, the Dutch Government stated that it would<br />

not act alone and would only seek regulation on an

EU-wide basis, as an overall part of the planned<br />

revision to the NEC Directive. The FEA VOC Working<br />

Group continues to work hard to have a robust<br />

defence to any challenges that may arise, and is<br />

now working jointly with the AISE and COLIPA VOC<br />

Committees on this issue.<br />

CLIMATE CHANGE<br />

The major focus during the year was once again the<br />

Fluorinated Gases Regulation under the European<br />

Climate Change Programme. The use of HFCs in<br />

‘novelty’ products will definitely be outlawed.<br />

However, following major lobbying by BAMA and its<br />

German counterpart ‘IGA’, uses in technical products<br />

will be preserved on the grounds of safety and lack<br />

of suitable, technically feasible alternatives. It is likely<br />

that the F-Gases Regulation will be implemented in<br />

2006, with the ban on HFCs in novelty products<br />

coming into force in 2009. Some Member States<br />

will be allowed to keep more stringent national<br />

legislation, which may affect some technical<br />

products in those countries.<br />

PACKAGING & PACKAGING WASTE<br />

Importantly, BAMA continues to support the recycling<br />

of empty aerosol cans, and is happy to report that now<br />

more than 75% of Local Authorities accept aerosols as<br />

a part of their recycling operations.<br />

EU CHEMICAL POLICY<br />

In late <strong>2005</strong>, the EU made huge progress with<br />

the new European Chemical Regulations, REACH. It<br />

is now expected REACH will begin implementation<br />

in late 2007. Correspondingly, a huge amount of<br />

work has been going on within BAMA following<br />

the deliberations at the EU, and the various<br />

activities under the European Commission’s Interim<br />

Strategy. In October, BAMA published a guide<br />

‘Are YOU Getting Ready for REACH?’, as a support<br />

to members, in raising the awareness of REACH<br />

and the actions that companies should be taking<br />

now in preparation.<br />

The BAMA <strong>Aerosol</strong> Ingredients Working Group and<br />

the Scientific Panel have led the work and adopted a<br />

strategy of collecting relevant data on key ingredients,<br />

and working on improving the BAMA Exposure Model.<br />

This information will be fed into the FEA <strong>Aerosol</strong><br />

Ingredients Working Group which has also been active in<br />

collecting data on 10 key aerosol ingredients to support<br />

the development of appropriate risk assessments.<br />

INTEGRATED PRODUCT POLICY (IPP)<br />

This issue continues to develop rather slowly in the<br />

EU, although there appears to be a renewed interest<br />

in the use of Life Cycle Analysis in IPP, as a tool that<br />

can be used to identify environmental impacts. IPP<br />

aims to achieve continuous environmental improvement<br />

to products and services, with a focus on Life Cycle<br />

Analysis, Environmental Labelling and Green<br />

Procurement. BAMA’s involvement is through the<br />

FEA IPP Working Group which is active in preparing<br />

to respond to any work in this area.<br />

On behalf of BAMA, I would like to extend my<br />

grateful thanks for the support and expertise of<br />

all those members of the Committee and Working<br />

Groups for the efforts they put in to further the<br />

environmental interests of our industry. We lost a<br />

number of committee members during the last year<br />

and we would warmly welcome any new member<br />

who wishes to help us improve the environment<br />

for all of us. Particular thanks go to Vic Hyde who<br />

retired at the end of the year following 42 years<br />

The Operational Safety Committee was formed in<br />

<strong>2005</strong> as a result of the reorganisation of the BAMA<br />

committee structure. Within our remit we have all<br />

manufacturing and distribution safety issues and the<br />

difficult area of Transport of Dangerous Goods. Therefore<br />

most members have a manufacturing or distribution<br />

background and come from the previous Technical<br />

Committee and working groups on Warehouse Safety<br />

and DSEAR that performed so successfully in the past<br />

to protect our industry and our employees. As a<br />

Committee we hope to maintain the enviable BAMA<br />

reputation for providing authoritative and thorough<br />

advice to our members and the respect that we have<br />

earned from authorities like the HSE and Department<br />

for Transport (DfT). We are now aligned to the FEA<br />

committee structure and our mission is clear, to<br />

support our members on Operational Safety matters.<br />

During <strong>2005</strong>, regulations to implement ADR/RID<br />

<strong>2005</strong> were put in place in the UK. This cleared away<br />

UK specific legislation and brought us into line with<br />

much of the rest of the world. BAMA is working with the<br />

DfT to develop a code of practice for how companies<br />

may apply for authorisation to implement an alternative<br />

to the hot water bath test before this facility becomes<br />

fully available by law in 2007. The Committee is<br />

watching developments carefully regarding proposed<br />

restrictions to the Limited Quantity concept. With the<br />

constant and much valued support of Martin Castle<br />

of Pira International and through FEA, BAMA is in a<br />

strong position to positively influence the outcome of<br />

these discussions.<br />

The 3rd edition of the BAMA Guide to the Safe<br />

Warehousing of <strong>Aerosol</strong>s was published in May; many<br />

thanks to the working group who brought this together.<br />

of the Pollution Prevention and Control Regulations<br />

(PPC) on the aerosol industry. After careful negotiation<br />

with Environment Agency inspectors, BAMA was<br />

able to steer a path through the legislation that<br />

largely excluded the core of the industry from the<br />

regime. A guide was speedily published for members<br />

towards the end of the year; many thanks to the<br />

Working Group for this success. It is with regret that<br />

we say goodbye to Ian Davies who has left the<br />

aerosol industry to pursue his career elsewhere.<br />

Work to develop a test method for accidental<br />

actuation through applying a top load continued. In<br />

Europe, the FEA expressed an interest in adopting<br />

this work with a view to creating a standard for<br />

the industry.<br />

The Committee also started looking at suitable<br />

ways to measure the effectiveness and performance<br />

of safety management systems. This was as a direct<br />

result of the comments from the <strong>Association</strong> of <strong>British</strong><br />

Insurers who said that the BAMA Standard is a useful<br />

document but needed to be validated through<br />

measurement. One area that has potential and is<br />

being studied is the web-based health and safety<br />

performance indicator tools recently published by HSE.<br />

The Committee has also been active in the development<br />

of a project to study the effectiveness of High Expansion<br />

Foam to extinguish aerosol fires in warehouses. A Project<br />

has been initiated through FEA and a consortium of<br />

industry members is being created to manage this<br />

activity. BAMA, through its Operational Safety<br />

Committee, is helping with the development of the<br />

project and the creating of the consortium.<br />

During the year, a Working Group was formed under<br />

the chairmanship of Ian Davies to look at the impact

This was the first year of operation for the Packaging<br />

and Contents Committee since it was formed by the<br />

amalgamation of the previous Regulatory Affairs and<br />

Technical Committees. Activity for the year concentrated<br />

on the proposed amendment to the <strong>Aerosol</strong> Directive<br />

and associated issues.<br />

AEROSOL DISPENSERS DIRECTIVE (ADD)<br />

At the beginning of <strong>2005</strong> the European Commission<br />

agreed to proceed with the proposed amendment to<br />

ADD under the procedure for Adaptation to Technical<br />

Progress. Good progress has been made during the<br />

year and most of industry’s proposals look likely to be<br />

included in the amendment. During the consultation<br />

with Member States and the public consultation phase<br />

of the process, some suggestions were made which<br />

would have been unhelpful to industry but these have<br />

been largely rejected by the Commission. One or two<br />

items remain outstanding but we are confident there<br />

will be a satisfactory outcome and the process should<br />

be completed during 2006.<br />

PRESCRIBED QUANTITIES (RANGES) DIRECTIVE (PQD)<br />

The Commission continued with the process of<br />

repealing this piece of legislation. This is an important<br />

issue for the aerosol industry as it permits the declaration<br />

of contents by volume only for the majority of aerosol<br />

products which is the preferred approach for most<br />

marketers. Article 8 of ADD requires declaration<br />

of contents by weight and volume and this part of<br />

the Directive cannot be amended under the ATP<br />

procedure. This would require amendment via<br />

a co-decision process involving the European<br />

Parliament which can be very protracted, so we<br />

are anxious to avoid following this route. Thus the<br />

maintenance of PQD in some form is important to<br />

the aerosol industry. The Commission is sympathetic<br />

to our case and although the situation is somewhat<br />

confused at present, we are hopeful that the issue<br />

will be resolved to our satisfaction.<br />

PLASTIC AEROSOLS<br />

At present, ADD is not aligned with the regulations<br />

for the Transport of Dangerous Goods by Road<br />

and Rail (ADR/RID) for plastic aerosols, in that the<br />

former only allows a maximum capacity of 220ml<br />

whereas the latter allows a capacity up to 500ml.<br />

At this stage, FEA does not consider there is<br />

sufficient safety information to support an increase<br />

in size to 500ml within ADD, so a Task Force has<br />

been set up to review the situation and generate<br />

the required data.

We have audited the financial statements of <strong>British</strong><br />

<strong>Aerosol</strong> Manufacturers‘ <strong>Association</strong> for the year ended<br />

31 December <strong>2005</strong> on pages 16-19. These financial<br />

statements have been prepared in accordance with the<br />

accounting policies set out therein and the requirements<br />

of the Financial Reporting Standard for Smaller Entities<br />

As described on page 14, the <strong>Association</strong>'s Executive<br />

Committee is responsible for the preparation of financial<br />

in accordance with relevant legal and regulatory<br />

requirements and International Standards on Auditing<br />

BASIS OF AUDIT OPINION<br />

We conducted our audit in accordance with International<br />

Standards on Auditing (UK and Ireland) issued by the<br />

Auditing Practices Board. An audit includes examination,<br />

on a test basis, of evidence relevant to the amounts<br />

and disclosures in the financial statements. It also<br />

includes an assessment of the significant estimates<br />

and judgements made by the Executive Committee in<br />

the preparation of the financial statements, and of<br />

whether the accounting policies are appropriate to the<br />

<strong>Association</strong>'s circumstances, consistently applied and<br />

adequately disclosed.<br />

We planned and performed our audit so as to<br />

obtain all the information and explanations which<br />

we considered necessary in order to provide us with<br />

sufficient evidence to give reasonable assurance that<br />

the financial statements are free from material<br />

misstatement, whether caused by fraud or other<br />

irregularity or error. In forming our opinion we also<br />

evaluated the overall adequacy of the presentation<br />

1 ACCOUNTING POLICIES<br />

2 TURNOVER<br />

Accounting convention<br />

The financial statements have been prepared under the historical<br />

cost convention and in accordance with the Financial Reporting<br />

Standard for Smaller Entities (effective January <strong>2005</strong>).<br />

The turnover and surplus before taxation are attributable to the<br />

one principal activity of the <strong>Association</strong>.<br />

3 OPERATING SURPLUS<br />

Turnover<br />

Turnover represents net sales of goods and services, excluding<br />

Value Added Tax.<br />

Tangible fixed assets<br />

Depreciation is provided at the following annual rates in order to<br />

write off each asset over its estimated useful life or, if held under<br />

a finance lease, over the lease term, whichever is the shorter.<br />

Short term leasehold – 100% on cost<br />

Office & general equipment – office and computer equipment<br />

33.3% on cost, furniture 20% on cost<br />

Deferred tax<br />

Deferred tax is recognised in respect of all timing differences<br />

that have originated but not reversed at the balance sheet date.<br />

Foreign currencies<br />

Assets and liabilities in foreign currencies are translated<br />

into sterling at the rates of exchange ruling at the balance<br />

sheet date. Transactions in foreign currencies are translated<br />

into sterling at the rate of exchange ruling at the date of<br />

transaction. Exchange differences are taken into account<br />

in arriving at the operating result.<br />

Hire purchase and leasing commitments<br />

Assets obtained under hire purchase contracts or finance<br />

leases are capitalised in the balance sheet. Those held under<br />

hire purchase contracts are depreciated over their estimated<br />

useful lives. Those held under finance leases are depreciated<br />

over their estimated useful lives or the lease term, whichever<br />

is the shorter.<br />

Factors that may affect future tax charges<br />

Losses of £35,912 (2004 - £43,279) are available for<br />

corporation tax purposes.<br />

The interest element of these obligations is charged to the<br />

income and expenditure account over the relevant period. The<br />

capital element of the future payments is treated as a liability.<br />

Pensions<br />

The <strong>Association</strong> operates a defined contribution pension<br />

scheme. Contributions payable for the year are charged in the<br />

income and expenditure account.<br />

International <strong>Aerosol</strong>s Congress and Exhibition 2007<br />

In September 2007 the <strong>Association</strong> is to host an international<br />

congress and exhibition in Manchester on behalf of the<br />

European <strong>Aerosol</strong> Federation (FEA). Deposits are already being<br />

received from exhibitors and expenditure is being incurred.<br />

These items are to be carried forward until the accounting<br />

period in which the event takes place, when they will be<br />

credited/charged to income and expenditure account.

9 PENSION COMMITMENTS<br />

In the past the <strong>Association</strong> utilised the services of employees of<br />

the Chemical Industries <strong>Association</strong> (CIA) whose employment<br />

contracts provided for retirement benefits based on final<br />

pensionable pay. On 31 May 2002 this ‘defined benefits’<br />

scheme ceased and was replaced by a defined contribution<br />

scheme. There is a Minimum Funding Requirement deficit on<br />

the defined benefits scheme which is due to be eliminated by<br />

June 2012. The <strong>Association</strong> is currently contributing £1,048<br />

per month to make good the proportion of this deficit that<br />

relates to these employees, but future contributions cannot<br />

be calculated accurately at this time. The amount charged to<br />

income and expenditure account during the year in respect of<br />

the defined benefits scheme was £12,576 (2004 - £16,076).<br />

The <strong>Association</strong> now contributes to a defined contribution<br />

scheme, managed by Scottish Equitable, for all staff. The<br />

<strong>Association</strong> is invoiced by CIA in respect of staff pension<br />

contributions, and these are charged to income and expenditure<br />

account as invoiced. The amount charged to income and<br />

expenditure account during the year in respect of the defined<br />

contribution scheme was £19,232 (2004 - £19,641).<br />

At the balance sheet date the amount provided in respect of<br />

unpaid contributions was £2,907 (2004 - £2,536).<br />

The <strong>Association</strong> occupies premises under a lease with fiveyearly<br />

rent reviews; the commitment is for five years from<br />

February 2002. Current annual charges are: Rent £44,000,<br />

Service Charge £7,000 and Management Charge £16,000.<br />

The <strong>Association</strong> is committed to hosting the International<br />

<strong>Aerosol</strong>s Congress and Exhibition on behalf of the European<br />

<strong>Aerosol</strong> <strong>Association</strong> (FEA), to be held at the Manchester<br />

International Convention Centre in September 2007. The cost<br />

of the venue is £305,060 of which £91,518 had been paid<br />

by the balance sheet date. The balance is to be paid in full<br />

by September 2006.<br />

The <strong>Association</strong> is also committed to a consultancy agreement<br />

with Axiom Communications at a cost of £28,000 for 2006.
