It is an ordinance that will allow the Fire District to charge for and recoup for Emergency and Non Emergency Services Rendered to Non-Tax Paying Residences of the District. NSNEB Cont... demands, where maintaining an effective response by the fire department decreases the costs of incidents to insurance carriers, businesses, and individuals through timely and effective management of emergency situations, saving lives and reducing property and environmental damage; and WHEREAS, raising real property tax to meet the increase in service demands would not be fair when the responsible party should be held accountable for their actions; and WHEREAS, the City Council of the North Stone Northeast Barry County FPD desires to implement a fair and equitable procedure by which to collect said mitigation rates and shall establish a billing system in accordance with applicable laws, regulations and guidelines; Now, Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE NORTH STONE NORTHEAST BARRY COUNTY FPD: SECTION 1: The North Stone Northeast Barry County FPD shall initiate mitigation rates for the delivery of emergency and non-emergency services by the fire department for personnel, supplies and equipment to the scene of emergency and nonemergency incidents as listed in “EXHIBIT A”, the mitigation rates shall be based on actual costs of the services and that which is usual, customary and reasonable (UCR) as shown in EXHIBIT A”, which may include any services, personnel, supplies, and equipment and with baselines established by addendum to this document. SECTION 2: A claim shall be filed to the responsible party through their insurance carrier. In some circumstances, the responsible party will be billed directly. SECTION 3: The fire department’s City Council may make rules or regulations and from time to time may amend, revoke, or add rules and regulations, not consistent with this Section, as they may deem necessary or expedient in respect to billing for these mitigation rates or the collection thereof. SECTION 4: It is found and determined that all formal actions of this City Council concerning and relating to the adoption of this Ordinance were adopted in open meetings of this City Council, and that all deliberations of this City Council and any of its committees that resulted in such formal actions were in accordance with all legal requirements, and the Codified Ordinances of the City Council. SECTION 5: This Ordinance shall take effect thirty days (30) from the date of adoption as permitted by law. Regular Meeting Of The Board Of Aldermen BOARD OF ALDERMEN Tuesday, 7:00 PM February 13, 2012 City Hall A regular meeting of the Crane Board of Aldermen was held at the Crane City Hall, Monday, February 13, 2012 at 7:00 p.m. with the following members present by roll call, Mayor Collin Brannan, Aldermen Ron Fearn, Tina Terrell, Jessica White, and Kyle Bentley. A quorum was present. Mayor Brannan called the meeting to order. Alderman Bentley made a motion to approve the January 30, 2012 regular meeting minutes as presented. Alderman Terrell seconded the motion, which carried unanimously by vote: Alderman Fearn—aye; Alderman Bentley—aye; Alderman Terrell— aye; Alderman White—aye. Remarks from Visitors: None. Department Reports: Police Department. Police Chief John Elmore reported that Emergency Services Day is scheduled for April 13, 2012 at the Elementary School. He will be working with the fire department, ambulance service, Highway Patrol, etc.; and will possibly secure a helicopter for the children to see. His plan is to introduce the emergency services to the middle and high school students next year. This week they will be picking up the new police car which is partially paid for by a Department of Public Safety grant. He has issued several nuisance abatement warnings since the last Board meeting. Public Works. Public Works Board member Gary Webb was present. Mr. Webb reported that the pump at the old silver tower had to be replaced due to an apparent lightning strike. When the Board receives the bill, the Clerk will contact the insurance company. Public Works is still replacing defective electric poles. A discussion was held regarding ventilation at the new well house. Recycling. No representative present. Parks. No representative present. Mayor Brannan reported that Park Board would like to talk with the Public Works Board regarding the utility bills. Payment is being held at this time. The Park Board also wishes to speak with the school board concerning the ball field contract. Fire Department. No representative present. Planning Commission. The next meeting is scheduled for February 22, 2012. They are half way through the proposed new ordinances. Bills were presented and reviewed with electric $76,982.17, general revenue $27,321.31, refuse $10,144.94, street $5,179.72, and water $18,777.85. A motion was made by Alderman Fearn and seconded by Alderman White to approve the bills as presented. The motion passed unanimously by vote: Alderman Fearn— aye; Alderman Bentley—aye; Alderman Terrell—aye; Alderman White—aye. UNFINISHED BUSINESS: Water Improvement Project. Public Works Board member Gary Webb reported that they are going to drain the new water tower tomorrow. He further reported that they have had two good samples. Once the tower is filled, there will be two more samples taken. If they are good, it will be deemed approved for consumption. Caldwell Tank has been asked for a change order to finish the fence and install the gate. They further plan to begin flushing water lines tomorrow. Page 2 Board of Aldermen Meeting February 13, 2012 Safe Route to School Sidewalk Project. Mayor Brannan reported that he has signed the letter regarding the street lights for the project which must come from a single source in order to match the other street lights. Budget. Mayor Brannan read Bill #1173-12 An Ordinance Approving And Adopting The City Of Crane, Missouri, Annual Budget For The Fiscal Year 2012 And Appropriating Funds Thereto. Alderman Fearn made a motion to have a 2 nd reading of Bill #1173- 12 An Ordinance Approving And Adopting The City Of Crane, Missouri, Annual Budget For The Fiscal Year 2012. Alderman Terrell seconded the motion, which passed unanimously by roll call vote: Alderman Fearn— aye; Alderman Bentley—aye; Alderman Terrell—aye; Alderman White—aye. Alderman Fearn made a motion to approve the 2 nd reading of Bill #1173-12 An Ordinance Approving And Adopting The City Of Crane, Missouri, Annual Budget For The Fiscal Year 2012. Alderman Terrell seconded the motion, which passed unanimously by roll call vote: Alderman Fearn— aye; Alderman Bentley—aye; Alderman Terrell—aye; Alderman White—aye. The bill became Ordinance 1050. Alderman Fearn made a motion to make the pay rate increase retroactive to October 1, 2011 for all employees with a budgeted pay increase. Alderman Terrell seconded the motion, which passed unanimously by roll call vote: Alderman Fearn— aye; Alderman Bentley—aye; Alderman Terrell—aye; Alderman White—aye. Bond Refinancing. Crane School Superintendent Tyler Laney contacted Mayor Brannan regarding placement of their radio antenna on the new tower. The Board will allow them to utilize the abandoned antenna on the north tower until the new tower is ready. Verizon Lease. The clerk obtained a rate survey of what other cities are receiving in rent/ lease payments for antenna space on their water towers. Mayor Brannan reported that Verizon sent a letter asking for consent to their antenna array, which would allow them to improve or weld on the tower. Nixa Amateur Radio. Mayor Brannan reported that Nixa amateur radio is moving forward with their antenna placement and he would like them to make a presentation on the project to the Board at a future meeting. NEW BUSINESS: Mayor Appointments. None. Trail of Tears in Stone County. Jim Huy, Northern Stone County Commissioner and President of the Stone County Historical Society shared some history of the Trail of Tears route in Stone County, which goes through an area one half mile north of Crane. Full-time Police Officer. Chief Elmore recommended that the Board hire Richard Morrison as a full-time police officer at the budgeted amount. Alderman Fearn made a motion to approve the hiring of Richard Morrison as a full-time police officer at the budgeted amount. Alderman Bentley seconded the motion, which carried unanimously by vote: Alderman Fearn— aye; Alderman Bentley—aye; Alderman Terrell—aye; Alderman White—aye. With no further business, a motion was made by Alderman Terrell and seconded by Alderman Fearn to adjourn the meeting. Motion carried, meeting adjourned at 8:37 p.m. /s/J.
