Calderón announced last December 511 —and reiterated in his February speech to <strong>the</strong><br />

CNDH 512 —that he was taking several steps to curb abusive practices, including: ordering<br />

security forces to immediately transfer detainees, including those detained in flagrante, to<br />

civilian prosecutors; instructing security forces to make public and, where necessary,<br />

establish laws on use of force, detention protocol, and preservation of evidence; and<br />

developing an inter-governmental federal database for <strong>the</strong> “disappeared.”<br />

Similarly, we are encouraged by <strong>the</strong> recent public statements of Secretary of Defense<br />

Guillermo Galván Galván, who acknowledged that <strong>the</strong> Armed Forces have committed<br />

“mistakes” in <strong>the</strong>ir efforts, and that recognizing those mistakes—as well as holding<br />

accountable those who have committed <strong>the</strong>m—is a show of loyalty to <strong>the</strong> institution. 513 And<br />

we welcome <strong>the</strong> General’s statement that “<strong>the</strong> institutions of <strong>the</strong> military justice<br />

system…have issued pronouncements” in favor of transferring cases involving human rights<br />

abuses to <strong>the</strong> civilian justice system, which is a critical step towards reducing impunity for<br />

military abuses. 514<br />

However, <strong>the</strong>se reform efforts are falling short in critical areas, and <strong>the</strong>se important<br />

statements have not yet resulted in changes in practice. Arguably <strong>the</strong> most glaring example<br />

of <strong>the</strong> former is <strong>the</strong> Calderón government’s ongoing failure to reform <strong>the</strong> military justice<br />

system. The Inter-American Court of <strong>Human</strong> <strong>Rights</strong> (in four recent rulings) and Mexico’s<br />

Supreme Court have both issued judgments stating that all cases of human rights violations<br />

allegedly committed by <strong>the</strong> military should be investigated and prosecuted in <strong>the</strong> civilian<br />

justice system, because <strong>the</strong> military justice system’s proven lack of impartiality and<br />

independence in judging <strong>the</strong>se cases. However, ra<strong>the</strong>r than comply with <strong>the</strong> rulings of <strong>the</strong><br />

Inter-American Court, in October 2010 <strong>the</strong> president presented an initiative that would only<br />

exclude three kinds of violations from military jurisdiction, and would give considerable<br />

discretion to military officials in classifying complaints, despite <strong>the</strong>ir track record of<br />
