6 ENVIRONMENTAL LEGISLATION IN S.A.<br />

6.1 Water Resources Act 1997.<br />

In seek<strong>in</strong>g to establish or exp<strong>and</strong> a feedlot a proponent should seek advice from the<br />

Department adm<strong>in</strong>ister<strong>in</strong>g the Water Resources Act 1997 as to the availability <strong>of</strong> water <strong>in</strong> that<br />

location <strong>and</strong> the approvals required.<br />

The Water Resources Act 1997 is adm<strong>in</strong>istered by the Department <strong>for</strong> Water, L<strong>and</strong> <strong>and</strong><br />

Biodiversity Conservation on behalf <strong>of</strong> the M<strong>in</strong>ister <strong>for</strong> Environment <strong>and</strong> Conservation.<br />

The Water Resources Act establishes a system <strong>for</strong> the susta<strong>in</strong>able use <strong>and</strong> management <strong>of</strong> the<br />

water resources <strong>of</strong> South Australia. An essential aspect <strong>of</strong> the Act is the establishment <strong>of</strong> water<br />

access rights which can be held separately from the l<strong>and</strong> through, over or under which water<br />

flows.<br />

Section 7 establishes the right to take water. In a prescribed area <strong>of</strong> the State authorisation, <strong>in</strong><br />

the <strong>for</strong>m <strong>of</strong> a water licence, is required to take water from a prescribed watercourse, lake or well<br />

or to take surface water from a surface water prescribed area.<br />

In areas <strong>of</strong> the State which are not prescribed water must not be taken if to do so would<br />

detrimentally affect the ability <strong>of</strong> another person to exercise the right to take water or would<br />

detrimentally affect the enjoyment <strong>of</strong> the amenity <strong>of</strong> water <strong>in</strong> the watercourse or lake by the<br />

occupier <strong>of</strong> the l<strong>and</strong>.<br />

Section 29 establishes the process whereby water licences are granted.<br />

A licence<br />

must specify the water resource from which the water is to be taken; <strong>and</strong>,<br />

• must, <strong>in</strong> the case <strong>of</strong> a licence endorsed with a water (tak<strong>in</strong>g) allocation, specify the<br />

part or parts <strong>of</strong> the resource from which the water may be taken; <strong>and</strong><br />

must be endorsed with a water allocation.<br />

is subject to conditions prescribed from time to time by regulation <strong>and</strong> such other<br />

conditions as are endorsed on the licence by the M<strong>in</strong>ster; <strong>and</strong><br />

rema<strong>in</strong>s <strong>in</strong> <strong>for</strong>ce until the licence is term<strong>in</strong>ated by or under the Water Resources Act; <strong>and</strong><br />

may specify <strong>in</strong>tervals at which the M<strong>in</strong>ster may vary the conditions <strong>of</strong> the licence.<br />

A licence (<strong>in</strong>clud<strong>in</strong>g the water allocation <strong>of</strong> the licence) is personal property vested <strong>in</strong> the<br />

licensee <strong>and</strong> will pass to another person under Division 3 or (subject to that Division) <strong>in</strong><br />

accordance with any other law <strong>for</strong> the pass<strong>in</strong>g <strong>of</strong> property.<br />

A licensee who contravenes or fails to comply with a condition <strong>of</strong> his or her licence is guilty <strong>of</strong> an<br />

<strong>of</strong>fence. Penalties may be <strong>of</strong> a f<strong>in</strong>ancial nature or may result <strong>in</strong> cancellation, suspension or<br />

variation <strong>of</strong> the licence.<br />

Sections 34 <strong>and</strong> 35 determ<strong>in</strong>e the allocation <strong>of</strong> water. The water allocation, or a component <strong>of</strong><br />

the water allocation, <strong>of</strong> a licence may be obta<strong>in</strong>ed from the M<strong>in</strong>ister, from the holder <strong>of</strong> another<br />

licence, or by convert<strong>in</strong>g a water (hold<strong>in</strong>g) allocation to a water (tak<strong>in</strong>g) allocation. The<br />

M<strong>in</strong>ister’s decision to allocate an amount <strong>of</strong> water on a licence must be consistent with the<br />

relevant water allocation plan. Water allocation plans are prepared <strong>in</strong> accordance with section<br />

101 <strong>of</strong> the Act. It should be noted that the M<strong>in</strong>ister, under section 37, may reduce the water<br />

allocation endorsed on a licence <strong>in</strong> order to protect the resource.<br />
