2. Current paraprofessionals within a building shall be offered the opportunity for<br />

reassignment before any position with the same building is classified as a vacancy and<br />

posted as such. All requests for reassignment within the building will be considered before<br />

any new personnel are hired or assigned.<br />

3. Paraprofessionals within the building shall notify the principal of their interest in<br />

reassignment by submitting a written request for reassignment to any desired position,<br />

which may become open for the next school year not later than April 1. Requests for<br />

reassignment shall include the position that the paraprofessional desires to be reassigned<br />

in the order of preference.<br />

ARTICLE XIII - PART I<br />

TEACHER EVALUATION<br />

A. 1. The <strong>District</strong> shall follow recommendations and guidelines set forth in the state-mandated<br />

performance appraisal system.<br />

2. All monitoring or observation of the work performance of a teacher shall be conducted<br />

openly and with full knowledge of the teacher. The use of eavesdropping, public address,<br />

audio systems and similar surveillance devices shall be strictly prohibited.<br />

3. Teachers shall be evaluated only by persons sanctioned by the State Department of<br />

Education.<br />

4. Unannounced classroom observations associated with the state-mandated appraisal<br />

system shall not be conducted on the day preceding Thanksgiving, Winter, or Spring<br />

Breaks, nor on the days following a teacher absence of three or more consecutive days.<br />

5. Employees will be given at least two days advanced notice of pre-observation conferences<br />

for announced observations.<br />

B. 1. A teacher shall have the right, upon request, to review the contents of his/her personnel file<br />

and building site file, except for confidential documents as determined by the person in<br />

charge of said file and removed by that person in the presence of the teacher, and to<br />

receive a reasonable number of copies at Board expense of any documents contained<br />

therein. A teacher shall be entitled to have a representative of the Association during such<br />

review. At least once every two (2) years, a teacher shall have the right to indicate those<br />

documents and/or other materials in his/her file which he/she believes to be obsolete or<br />

otherwise inappropriate to retain. Said documents shall be reviewed by the Superintendent<br />

or his designee and if, in fact, they are obsolete or otherwise inappropriate to retain, they<br />

shall be destroyed. Any documents identified as confidential (in Section, B.1. above) and<br />

which are removed before review by the teacher, will be identified by category (i.e.,<br />

personal references, professional reference, teacher college placement file).<br />

The Director of Human Resources will arrange a review of a teacher’s file within three (3)<br />

working days from the receipt of the request. In the event that the Director is unable to<br />

schedule the review within three days, the Superintendent shall appoint an appropriate<br />

designee to complete the review. The employee may initial and date each page of the<br />

personnel file in the presence of the Human Resources Director or designee.<br />

2. No material derogatory to an employee's conduct, service, character or personality shall be<br />

placed in his/her personnel file unless the employee has had an opportunity to review the<br />

material. The teacher shall acknowledge that he/she has had the opportunity to review<br />

such material by affixing his/her signature to the copy to be filed with the expressed<br />

understanding that such signature in no way indicates agreement with the contents thereof.<br />
