however, that when they do so they shall indicate that they are speaking personally and not<br />
on behalf of the school, its administration or the Board.<br />
3. Teachers shall not be censored or restrained in the performance of their teaching functions<br />
on the grounds that the material discussed and/or opinions expressed are distasteful or<br />
embarrassing to those in authority in the school system.<br />
4. It is the responsibility of the employee to implement the district curriculum. In performing<br />
this function, employees may use a variety of materials, in addition to those provided by the<br />
<strong>District</strong>.<br />
ARTICLE XXVI<br />
BOOKS AND OTHER INSTRUCTIONAL MATERIALS AND SUPPLIES<br />
A. The Board shall allocate sufficient funds to provide for the purchase and/or replacement of<br />
textbooks, library books, instructional materials, supplies and equipment of sufficient quality and<br />
quantity to enable teachers to properly fulfill their teaching responsibilities.<br />
B. The procedure for reviewing and evaluating curriculum, to include instructional materials and<br />
supplies, shall be defined by Board Policy.<br />
C. Textbooks and instructional materials in all subject areas and at all grade levels shall be selected so<br />
as to best show the cultural diversity and pluralistic nature of American society in both textual and<br />
illustrative material and reflect the most recent authoritative scholarship on the history and<br />
contributions of various racial, ethnic and religious groups and their prominent representatives in<br />
American life.<br />
ARTICLE XXVII<br />
DEDUCTION FROM SALARY<br />
A. The Board agrees to deduct from the salaries of its employees, dues for the Association, the<br />
Delaware State Education Association and the National Education Association. Such deductions<br />
shall be made in compliance with Delaware Laws and under rules established by the State<br />
Treasurer. Deduction forms for employees hired before September 1 must be submitted to the<br />
<strong>District</strong> Office thirty (30) days prior to the implementation of such authorized deductions.<br />
B. The Association shall certify to the Board, in writing, the current rate of membership dues for each<br />
of the associations named above. The Association shall give the Board written notice of changes in<br />
such membership dues prior to the effective date of such change. Changes in dues shall only be<br />
effective on September 1.<br />
C. Employees will become members of the Association or will pay a service fee determined by the<br />
Association. The <strong>District</strong> agrees to deduct such Association service fee from the pay of employees<br />
in the collective bargaining unit for more than thirty (30) days who are not, who do not become, or<br />
who do not remain members of the Association.<br />
ARTICLE XXVIII<br />
MISCELLANEOUS PROVISIONS<br />
A. The Board and the Association agree that there shall be no discrimination and that all practices,<br />
procedures and policies of the school system shall clearly exemplify that there is not discrimination<br />
in the hiring, training, assignment, promotion, transfer or discipline of employees or in the<br />
application or administration of this <strong>Agreement</strong> on the basis of sex, race, age, religion, national<br />
origin, disabilities, sexual orientation, or marital status.<br />
