Petitioner alleges that prior to the trustee’s death, petitioner lent funds to Cynthia Buckler for repairs made to her property and personal use. A promissory note outlines sums due to Marjan Sheehan. The total amount due is $34,896.02 principal and $12,607.40 interest. Petitioner further alleges that these sums exceed the amount Cynthia Buckler would receive in distribution. The trustee requests authority of the Court to forgive Cynthia Buckler’s notes as her distribution even though it is an amount larger than the other heirs will receive. Thus, the entire trust estate will be distributed between the remaining heirs in equal shares without collection of such note after the expenses of administration are paid.
