WASTE-DISCHARGE CHARGE SYSTEM
As a means of pursuing the goal of sustainable water use in South Africa, the Department
of Water Affairs (DWA) developed the Waste Discharge Charge System (WDCS).
the wDcs was established under the pricing strategy
for water use charges in terms of Section 56 of the
National Water Act (Act 36 of 1998) and serves as an
economic instrument that aims to improve water quality
and to achieve water quality objectives through waste
reduction, either at the source or in the water resource.
legislation that pertains to the wDcs is informed by
the water Uses listed in section 21 of the nwa, in
particular:
• Section 21 (e): engaging in a controlled activity.
• Section 21 (f): discharging waste or water
containing waste into a water resource.
• Section 21 (g): Disposing of waste in a manner
which may detrimentally impact on a water
resource.
• Section 21 (h): Disposing of water which contains
waste from, or which has been heated in, any
industrial or power generation process.
the wDcs is based on the polluter-pays principle, and
aims to:
• Promote the sustainable development and
efficient use of the water resource.
• Promote the internalisation of environmental
management processes.
• Create financial incentives for discharges to
reduce waste and to use the water resource in a
more optimal way.
• Recover costs that are associated with mitigating
water quality impacts of waste discharge.
the wDcs creates a win-win situation where economic
and environmental factors are both considered for
sustainable development. the economic and social
circumstances are also taken into account to ensure
that the system is affordable. the charge structure
and its estimation are simple, so as to be understood
by both the implementing agent and the discharger of
waste. the estimation and disbursement of charges
are accompanied by an extensive consultative process
with the participation of the affected parties and uses
information that is in the public domain. the system
complements the regulatory approach of water resource
management and the direct linkage and interaction
between these two systems ensures effectiveness and
consistency.
Waste Constituents under the
WDCS:
Salinity (Electrical conductivity (EC), chloride,
sodium, and/or sulphate)
Nutrients (Soluble phosphorus, Nitrate,
Ammonium
PH
Heavy metals: Arsenic, cadmium, chromium,
copper, mercury, lead, nickel, zinc
Organics: Biochemical Oxygen Demand (BOD)
or Chemical Oxygen Demand (COD)
the Dwa is responsible for the national roll-out of the
wDcs and retains the oversight and support functions.
the catchment management agencies (cmas) are to
assume key responsibility for implementation, which
includes planning, identifying discharges, invoicing, debt
collection and financial management disbursement, and
monitoring and evaluation.
In the breede water management area, the breede
THE BARRYDALE REDFIN:
A FISH ON THE BRINK OF EXTINCTION
The Breede River system is home to a unique indigenous fish, the Breede River
redfin (Pseudobarbus burchelli). A study by the South African Institute for Aquatic
Biodiversity (SAIAB) has shown that the Breede River redfin is in fact three genetically
distinct fish, which are currently being described as new species.
The Critically Endangered Barrydale redfin. Photo © Ernst
swartz (saIab)
one of these species occurs in the breede river
(Burchell’s redfin), one in the Heuningnes river system
on the Agulhas Plain (Heuningnes redfin), and one in
the tradouw river system. this species is known as the
Barrydale redfin.
the barrydale redfin has a very limited natural
distribution, only the tradouw river and its major
tributary, the Huis river. this river runs through the town
of barrydale. a recent assessment by the International
Union for the conservation of nature (IUcn) shows that
the Barrydale redfin is Critically Endangered. This means
that it will soon become extinct if it is not conserved
immediately.
The survey shows that the Barrydale redfin’s distribution
has changed significantly in recent years and has
become much smaller.
this is due to a number of threats, which include:
• excessive and unregulated abstraction of water
from the river for domestic and agricultural use;
• modification of the stream habitat by unsound
agricultural practices such as bulldozing and
removing the riparian vegetation;
• pollution of the water resource by agricultural
chemicals and sewage effluent; and
• alien fish species in the river.
Alien fish threaten indigenous fish, such as redfins,
through predation (eating the indigenous fish) and
by competing with the indigenous fish for food. The
ecological threats in the tradouw river and its tributaries
are not unique and occur in many rivers in the cape
Floristic region (cFr).
PAGE 4 - bocma newsletter 10
To protect the Barrydale redfin
and ensure its survival in the
wild, a conservation plan
was initiated by capenature.
this plan aligned is with
guidelines that are published
in the national environmental
management: biodiversity
act (nemba) (act no. 10 of
2004). The guidelines call
for an integrated approach
to species conservation
whereby stakeholders from
government departments,
municipalities and private
the tradouw Pass: the
main area of distribution
of the Barrydale redfin.
landowners are included through a public participation
process. the participation of all stakeholders in the
process means that maximum awareness is created and
knowledge is disseminated to non-conservation agencies.
this then aligns the priorities of all stakeholders from
the different sectors.
The conservation plan for the Barrydale redfin is in a
draft phase and anyone interested in further details can
Conserve the indigenous fish of the
Breede River system
Landowners and farmers can help to conserve the unique fish fauna of the Western
Cape, such as the Barrydale redfin, through:
Good land use management:
• Do not expand farming operations into sensitive areas such as floodplains and riparian zones. By law, no
farming activities or residential development can occur within the 1:100 year flood-line of a river system.
• Do not graze animals, such as cattle, on riverbanks as their trampling damages the riparian vegetation.
• Remove and manage invasive alien vegetation (e.g. wattle trees) in riparian zones.
ensuring a healthy aquatic ecosystem:
• Do not over-abstract water from rivers during low-flow summer months; and ensure that all water-use is
registered with the bocma.
• Do not bulldoze or canalize a river as it destroys the instream aquatic habitat.
• Never move or stock live fish without a transport permit from CapeNature.
Upper Breede Alien Clearing and Restoration
Project
The Upper Breede Alien Clearing and restoration project is a Collaborative approach
to alien clearing by means of a Memorandum of understanding between the 3 parties
involved namely the Wolseley Water User Association, the Department of Agriculture
(Land Care Division) and the Breede-Overberg Catchment Management Agency.
It is also a success story thanks to the dedication
of the farmers along the stretch of river. the role
of the farmer is the supervision of the team and
the cost of the petrol needed for the chain saws.
the farmer also registers at the Department of
agriculture for the herbicide needed for the project
and takes responsibility to see to the efficient and
correct handling and spraying thereof.
The project identified alien clearing needs over a 15 km
stretch of the Upper breede river with an estimated
project cost of R2 million of which 60% was estimated
to be labour costs.
with the funds made available the task was taken on.
to date the collaborative effort has cleared an amountof
551 ha along the river at a total cost of R545 235. The
project provided 2270 person days during this time.
the farmer contribution towards the project has been
R73 810 thus far.
the breede-overberg catchment management agency
is proud to form part of the collaborative and innovative
project and thanks all the parties involved for their
dedication towards the project!
Compliance, Monitoring and Enforcement
in the Water Sector
Regulation is a key function of the Department of Water Affairs which involves
regulating all aspects of water use and management. Regulation was identified as a
key risk area that requires dedicated attention and as a result, it was established as
a dedicated programme in 2009, with implementation from 2010.
the current functions that are covered by the regulation
Programme are:
• Water allocation
• Resource protection and waste
• Abstraction and in-stream use
• Water services regulation and
• Compliance, monitoring and enforcement.
In an effort to curb water transgression, a compliance,
monitoring and enforcement unit was established. this
unit aims to ensure the protection of water resources in
south africa through compliance with water legislation,
which includes the national water act, the water
services act and other related legislative provisions.
Currently, within the unit, 30% of staff are allocated to
the National Office with the focus on Enforcement, with
70% of staff deployed to the Regional Offices, with focus
on compliance monitoring.
The Verification and Validation Process that is currently
being implemented by the breede-overberg cma is the
first step in Compliance Monitoring; as only after the
verification process on a property has been completed
(Section 35 NWA), can the water use be determined to
be legal or not.
compliance, monitoring and enforcement applies
to all water users, including individuals, industry,
municipalities and other government users. the aim of
the cme programme is ultimately to:
• Improve the quality of drinking water;
• Eradicate unlawful water use (e.g. irrigation);
• Ensure compliance of Waste Water Treatment
works;
• Ensure compliance of Waste Water Discharge
(e.g. Industry and mines); and
• Implement the Enforcement Protocol against
organs of state.
the aims and objectives of the cme programme will be
realised not only through legal action, but also through
finding alternative options and strategies to illegal water
use.
the conference was organised by the water research
together with the australian national University. the
conference had a programme of 94 papers (one of which
was presented by Dr s. adey of the bocma), workshops,
special sessions, panel discussions, side events and
role playing games (including the online game, aqua
african presenters, papers were presented by speakers
from europe, north and south america, India, asia and
the rest of africa.
On Sunday the 4th November, a special session was
held on the Incomati cma. the aim of the session was
to bring together the water managers and researchers
in order to identify and discuss the research needs and
future outcomes in this International river basin. and,
also to develop a strategic research focus that can be
applied both at the operational and policy level. later that
evening, eiman Karar, the conference chair welcomed
423 delegates from 32 different countries.
Governance For sustainable Development
The international conference on freshwater governance for sustainable development
was held in the Drakensberg from the 4th to the 7th of November 2012, with noted
academic and author Professor Ali Mazrui as the main speaker.
the chair of the wrc board, barbara schreiner gave the
opening address on Monday the 5th November and said
that: “water is a critical component of the development
scenario in south african and we need to ensure that it
is integrated into the governance systems of the country
as a whole, the mind-set of all decision makers: we need
to place water at the centre of the development agenda
of the country. our governance systems need to support
that approach”.
samantha adey of the bocma presented a paper in the
session on multi-level water Governance and adaptive
management, the title of her presentation was: the role
of water User associations in Viable Decentralisation for
My Masters Degree in ‘Innovation sciences’ looks at the impact of technology on
society from different perspectives: social, economic and political. this aligns well
with the bocma’s mandate to manage water resources within a social, economic and
ecological context. the bocma engages with the stakeholders in these sectors, and
the different interests that have to be taken into account raise the complexity of this
task. my research attempts to understand the stakeholder dynamics by analysing the
different interests, powers, relations and contexts of water resource management.
after this analysis, recommendations can then be derived for the bocma on how
to make use of the stakeholder dynamics as a way to deal more efficiently with
integrated water resource management.
It has been very interesting to learn more about water resource management from
a catchment management perspective, and especially exciting to do research in a
