Q. Mr. Bingham, between <strong>the</strong> time you first went <strong>the</strong>re to <strong>the</strong> property in 1913 and July 20, 1915, so far<br />

us you recall, how many visits did you make to <strong>the</strong> property?<br />

Mr. Hawkins: Objected to as incompetent, immaterial and irrelevant and certainly can have no bearing<br />

upon <strong>the</strong> question as to whe<strong>the</strong>r <strong>the</strong>se instruments were delivered as absolute conveyances or as security.<br />

A. The first time I went down <strong>the</strong>re I found <strong>the</strong> windows—well, I should say <strong>the</strong>re was half a dozen <strong>of</strong><br />

<strong>the</strong>m that were wide open, and in <strong>the</strong> big room such as was used for experimenting and things <strong>of</strong> that,<br />

kind <strong>the</strong>re was probably a dozen or fifteen desks in <strong>the</strong>re and a great many wardrobes, that is closets and<br />

things <strong>of</strong> that kind, and among <strong>the</strong>m was a—what you would call a model submarine. Well, this place had<br />

practically been wrecked.<br />

Mr. Hawkins: I ask that be stricken out.<br />

The Referee: Yes, strike out <strong>the</strong> "practically been wrecked." Just describe its condition.<br />

A. There had been a desk that <strong>the</strong> drawers had been opened, pulled out and thrown on <strong>the</strong> floor and all <strong>the</strong><br />

tops <strong>of</strong> <strong>the</strong> desks—<strong>the</strong>y were roll-tops desks—<strong>the</strong>y had been ripped <strong>of</strong>f and thrown on <strong>the</strong> floor, <strong>the</strong> doors<br />

were ripped <strong>of</strong>f <strong>the</strong> closets and <strong>the</strong> books and emit that was in <strong>the</strong>re, I would say <strong>the</strong>re was four truckloads<br />

<strong>of</strong> that thrown all over this big room, and I came back and made a report to Mr. Holdt <strong>of</strong> <strong>the</strong> condition we<br />

found things.<br />

Mr. Hawkins: I ask that be stricken out.<br />

The Referee: No, <strong>the</strong> fact that he made a report, let it stand.<br />

Mr. Hawkins: Exception.<br />

A. (Continuing.) And in two or three days I took a couple <strong>of</strong> carpenters and we went down <strong>the</strong>re and<br />

nailed up <strong>the</strong> windows.<br />
